00:00FBI agents have more power than almost any other authority out there, including the police.
00:05But what happens when undercover FBI agents get arrested by cops who have no idea?
00:11Face down now!
00:12You guys are making a big mistake.
00:14Here are four examples of this happening, starting with the case of Agent Hernandez.
00:18In the early hours of December 6th, 2016, shots were heard ringing out in a Grand Rapids parking lot
00:25towards a police officer.
00:26A team of armed units rushed to take down the threat, but they found something they never could have expected.
00:57Empty. He's got a badge.
00:59How old are you, sir?
01:00Federal Bureau. He's a FBI agent.
01:03The man who was allegedly shooting at a police officer turned out to be an FBI agent.
01:08The man was identified as Agent Ruben Hernandez, a Las Vegas agent in Michigan on undisclosed business.
01:15Obviously, there are too many questions to count, so to help shed a little light on the situation,
01:20the cops decided to call up his partner John Salazar, who arrived at around 5 a.m.
01:26We're gonna try to find out, maybe we can shed some light on what led up to all this.
01:30Right, and what I'm trying to just verify is to make sure who you have, basically.

02:01John receives confirmation that the man they apprehended is, in fact, his partner Ruben.
02:06Definitely not the news he was expecting at 5 in the morning.

02:13He looks scuffed up, but, you know, that wasn't done here, by us.
02:17That was before he made contact with us, so...
02:20We'll make sure he gets checked and everything.

02:25He wanted to see a picture before he talked to us.

02:28While everybody waits for a lieutenant to arrive,
02:30two of the cops decide to move over and have a secret conversation.
02:43Unfortunately for the cops, covering a camera doesn't stop it from picking up audio.
02:49In essence, one cop mentioned how he could smell alcohol on John
02:52and that he'd noticed him eating multiple sticks of gum
02:55to presumably hide the scent on his breath.
02:57From this moment on, the cops start getting more and more suspicious of him
03:01until they finally decide to question him.

03:10We're still trying to figure out who called us to say he was in trouble or something.

04:04It's at this point the cops decide to detain John
04:06on suspicion of DUI.
04:08So they take his firearm
04:09and bring him into a room with a breathalyzer.
04:11Need you to seal your lips and low and tell the beeps.

04:21Your BAC right now is 0.116 at 522 in the morning.
04:26Probably be holding on to your firearm.
04:29The legal limit for driving in Michigan is 0.08.
04:32So John is just over.
04:34And it's likely the number was higher an hour earlier
04:37when he was actually driving.
04:39Looking at the big picture, though,
04:40this is actually a very unfortunate situation for John.
04:44That night, he'd been drinking with a friend at a club
04:46while they were off duty.
04:48It was only when he was back at his hotel
04:50when the local PD called him
04:52to come and verify it was his partner they arrested.
04:55Obviously, John shouldn't have driven his car to get there.
04:58But nevertheless, you can see how he would make that mistake
05:01in such a stressful situation.
05:03But other than the body cam cover-up,
05:05the cops handled this perfectly.
05:07However, the same cannot be said for the cops in the next case
05:10who showed exactly what not to do
05:13when dealing with an undercover FBI agent.
05:38This agent was actually investigating police corruption
05:41in the Franklin County Police Department.
05:43But he had no idea just how corrupt
05:45this officer would turn out to be.
05:47The agent had called this officer to meet
05:49at a random location and refused to meet him at their offices.
05:52If it's not already obvious,
05:54everything this agent does and says from now on
05:57is a test to try and see how well this cop follows conduct
06:00and if his co-workers follow suit.
06:02This is why he asked him to turn off his body cam.
06:04And luckily for the cop, he passed this first test with flying colors.
06:07However, it doesn't seem as though
06:09it's going to last for very long.
06:27Things are understandably not adding up for the officer,
06:30so he decides to detain the agent
06:32and waits for backup to arrive.
06:39That's right.
06:40Your tag's not coming back to the FBI.
06:42Correct.
06:43I haven't seen a badge. I've seen an ID card.

07:00When backup arrives, the officer explains the full situation to them,
07:03saying the suspect is armed, uncooperative,
07:06and above all, incredibly suspicious.
07:09Receiving a call on your personal phone number from an FBI agent
07:12would definitely ring alarm bells as a cop,
07:15but it's important that they continue to be professional
07:17and follow the rules.
07:19The officers proceed to handcuff the agent
07:21and place him in the back of their patrol car,
07:23where he starts to complain that the heat is way too high in the vehicle
07:26and that he desperately needs air.
07:28But all of a sudden, they receive a call from HQ
07:31that should put the entire event to rest.
07:3433, go ahead.
07:36I'm on the phone with your supervisor out of Tallahassee, over.
07:39He is legit.
07:41So they just said...
07:45Alright, that's what I'm doing right now.
07:48They just called back. He is legit.
07:51Even after this, though, the officer still decides
07:54to keep the agent inside the patrol vehicle,
07:57despite being explicitly told that he is actually an FBI agent.
08:00Instead of letting him out as instructed,
08:04the officers continue to talk about the situation
08:07while he begs to be let go.
08:09But after an extra 3 minutes of completely unnecessary conversation,
08:12the agent is finally let out of the vehicle,
08:15but it seems as though he's not feeling too good.
08:18We're releasing you right now, sir.
08:20No, call 911 now.
08:22Call 911. I need 33.
08:24I see they're begging you to cut off your freaking heat.
08:29After a further 10 minutes, medics arrive,
08:32and the agent is taken away in an ambulance.
08:35Thankfully, despite what can only be described
08:38as disrespect and neglect from the officers,
08:41the agent suffered no serious injuries,
08:44but things ended differently for ATF Agent Burke,
08:47who was treated so badly by police
08:50that he had to file a lawsuit against them.
08:53Agent Burke was dispatched to a house
08:56to confiscate a firearm that had been illegally acquired by the residents.
08:59The residents called the police.
09:02The cops were given Agent Burke's badge number,
09:05but still treated the incident as a break-in,
09:08and Burke as a criminal.
09:11Turn around, let me see your hands.
09:14I need to see some ID. Get on the ground!

09:30Agent Burke refuses immediate orders to get on the ground,
09:33likely so police can check if he's armed or not,
09:36and continues the investigation safely.
09:39Burke believes that because he's a federal agent,
09:42he's not subject to the orders of municipal police.
09:45But if that was the case, any criminal could falsely claim
09:48there were a federal agent to bypass police orders.
09:51While he may not think he looks like a threat himself,
09:54so the cops could figure out the situation easily.
09:57But instead, things continued to escalate.

10:12Once a second officer arrives, Burke finally follows the orders
10:15and lays down on the ground.

11:25In the distressing footage, Burke continues to tell the officers
11:28that he's an ATF agent out on a call
11:31and to simply take his ID from his back pocket.
11:34After finally looking at his ID, officers keep him under arrest
11:37and take him to their patrol vehicle.
11:40Why would you make us do this?
11:44Guys, please, just talk to me for one second.
11:47Please get in the car. We'll talk later.
11:50The cops then force Burke into the vehicle, talking over his pleas and explanations
11:53regarding his medical condition.
11:56If you are a real police officer, you ought to be ashamed of yourself!
11:59I was trying to give you my creds!
12:02We got him in the car. He might even be a real cop,
12:05but he wouldn't tell us, wouldn't do anything.
12:08We had to tase him because we got a medic coming.

12:23Police continue to detain Burke in their patrol vehicle for over an hour longer
12:26before eventually releasing him without charges.
12:29Despite not necessarily showing perfect conduct himself,
12:32Burke decided to sue the Columbus Police Department,
12:35citing excessive force and unlawful arrest.
12:39The original complaint says that after the incident,
12:42which caused him both physical and mental harm,
12:45he was taken from active duty and confined solely to administrative and support roles,
12:48with adjustments having to be made to the department to accommodate him.
12:51As of this video's upload, the case is still ongoing.
12:54Realistically, both parties involved in this case
12:57were in the wrong to some extent,
13:00but in the case of Mac Proctor, things are totally different.
13:03Mac is supposedly an undercover agent with a very strong knowledge of the law,
13:07and he's about to show exactly how corrupt police officers can be completely unprovoked.
13:13Mac was parked in a private parking lot waiting for a takeout order
13:16while on his shift as a delivery driver.
13:19While his vehicle wasn't in a designated parking spot,
13:22it wasn't blocking the flow of traffic,
13:25and he'd only left it there unattended while picking up his food.
13:28Upon returning to his vehicle, Mac was approached by a police officer
13:31stating he was violating parking rules.
13:34The officer was then asked to leave the vehicle,
13:37but Mac refused to do so.
14:00Of course, Mac has every right to stay silent
14:03about the officer's questions,
14:06especially ones that don't at all pertain to criminal proceedings.
14:09At no point did he raise his tone or say anything out of line,
14:12yet the officer asks why he's being so angry.
14:15Many people think that some police officers are used to
14:18consistently being in command and control on these interactions,
14:21and it's possible the same is true with this officer.
14:24When Mac exercised his rights and just asked for things to be moved along,
14:27this cop was surprised and took it as a combative statement.
14:33I'm not giving you a break on it, but you know what I'm saying?

16:27The cop later found out that Mac wasn't even a federal agent or officer himself
16:30and simply managed to prove just how valuable it is to know the law.
