00:00Cops have to arrest all different types of people.
00:02However, what happens when it's a cop's own boss that he has to put in handcuffs?
00:07There's things that we can do to fix this, but, uh, you know...
00:10Here are four examples of this incredibly rare situation,
00:13starting with the case of Michael Yarbrough.
00:15On June 20th, 2023, a Georgia police officer pulled over a Dodge Charger
00:20that was going way over the 35-mile-an-hour speed limit.
00:23However, when he walked up to the window, he got a huge surprise.
00:27Really?
00:35The man behind the wheel was chief deputy of the local PD, Michael Yarbrough,
00:40not the person this officer expected to pull over.
00:43But in reality, this changes nothing,
00:45and the officer asks Yarbrough to give over his license and registration,
00:49something he's not pleased with at all.
00:52Guess who I just pulled over?
00:54Who?
00:55Yarbrough.
00:57Yeah, the chief deputy driving a f***ing Dodge Charger,
00:59a souped-up Dodge Charger that belongs to the sheriff's office.
01:02I just clocked this f***ing 96 in a 35.
01:08No, no reason. He's in an unmarked f***ing car.
01:10He just got a high horsepower car and decided he wanted to play.
01:19Okay, well, you know I don't care for him, so I'm gonna ride his f***ing car.
01:23If body cams weren't around, this stop could have gone a totally different way.
01:27But it seems like this officer isn't the biggest fan of Yarbrough
01:31and decides to issue him a citation for speeding.
01:34For some, handing your boss a $500 fine is a dream come true,
01:38and it looks like it's the same way for this officer.
01:40Sir, here's your ID back.
01:42This is your copy of the citation.
01:45If you would sign right here.
01:46It's got a court date, time, it's a must-appear.
01:51Please slow down and have a safe day.
01:53In Georgia, speeding tickets are priced based on how much you're exceeding the speed limit.
01:58For example, if you're over 24 miles an hour over, you're looking at $500 in fines.
02:03However, there's an extra super speeder charge you're liable to
02:07if you're going as fast as Yarbrough was.
02:09But it looks like this officer decided to mess with his boss even more,
02:12as this ticket excluded the extra fee but instead required him to appear in court.
02:17After the incident, Yarbrough was also suspended for 40 hours without pay.
02:22However, that's just a fraction of what Corporal Scott Birdsick was hit with
02:26after crashing his car while drunk.
02:46Obviously, Brooke and Scott are familiar with each other,
02:48and curiously, Scott holds nothing back when describing exactly how the incident went down.
02:54It's clear that Scott is the one at fault here, so before going any further,
02:58Brooke decides to call back to the base to
03:00ask whether or not it's okay for her to be handling this incident.
03:03This crash, um, Birdie, ESO come work it?
03:06Okay.
03:07I can't remember.
03:08It's been a long time since I've worked a crash with one of us in it, so...
03:11No, he's not on duty.
03:12He's in his POV.
03:14I just didn't want there to be any, like, conflict of interest type issues.
03:18All right, that was it.
03:19I just wanted to make sure.
03:20Yay, bye.
03:23Damn it, Birdie.
03:25Brooke is given the go-ahead and told that there should be no issues with her handling this case,
03:29but that was before she noticed this.
03:32You good?
03:33Yeah, I'm awake.
03:34Huh?
03:35Way down this way.
03:36He's not coming.
03:39Good?
03:40Walking home, but yep, I'm good.
03:42So, Birdie, you giving me some indicators?
03:47Oh.
03:48Listen, listen.
03:50Listen, Valdez is coming out just to...
03:55I'm not gonna lie to you about it.
03:56She's on her way?
03:57Yeah, she's on her way.
03:59I'm not really comfortable with this whole thing at all,
04:01but I'm not gonna lie to you about it.
04:03Oh no, I don't mean to put you in any...
04:07Yep.
04:08From now on, you know how it goes.
04:09You can't consume anything, okay?
04:11Because right now, you're being detained.
04:14Like what?
04:15It's obvious that Scott is under the influence of something.
04:19Judging by his slurred speech, slowed reactions, and slight loss of motor control,
04:24Brooke is fairly sure he's been drinking.
04:27At this point, Scott is no longer her supervisor.
04:30He's just a suspect in a case.
04:32And what's more, he's drunk and likely unpredictable,
04:36a combination which can be incredibly threatening to a female officer.
04:40Please don't make my life difficult.
04:43I would never do that to you.
04:44Okay, I'm very uncomfortable right now.
04:48And I apologize for putting you in that position.
04:52Are you on?
04:53Yes, yes I am.
04:54And I'm going to remain on.
04:57Integrity.
05:03You know you can't smoke right now.
05:05Why?
05:06Because if I'm going to do a DUI investigation,
05:08it impedes it so you can't consume anything.
05:10I want to get that dog.
05:15That is a really cute dog.
05:17Fear aggression issue.
05:20You can always train a dog.
05:23You can't consume anything.
05:26You're killing me.
05:28I'm trying.
05:30It's too late now.
05:34After a short wait, another officer arrives at the scene,
05:37meaning they can finally start getting to the bottom of all of this with some sobriety tests.
05:42These lasted over 10 minutes,
05:44but it's not hard to tell how they went by just looking at a few seconds of them.
05:48You may begin the test.
05:51One, two, three.
06:01Judging by this and the overwhelming amounts of evidence against him at this point,
06:05the officers thought it was safe to conclude that Scott had been drinking that night
06:09and decided it was time to put him in cuffs.
06:12Something he was far from happy about.
06:14There's things that we can do to fix this.
06:28Despite Scott being one of the most polite and respectful suspects ever on this channel,
06:32he was actually hit with a better sentence than the majority of criminal cops.
06:36After blowing a .156 back at the station,
06:39he was charged with driving under the influence and damaging property.
06:43He was ordered to pay just under $1,000 in fines,
06:46serve 50 hours of community service,
06:48and take multiple substance abuse and DUI classes,
06:51and had his driver's license suspended for six months.
06:55He was also sued by the driver of the vehicle he hit,
06:58and a cash settlement was reached.
07:00And on top of all of that, he also was suspended without pay for a week
07:04and given a last chance agreement,
07:06meaning one more slip-up and he was out for good.
07:09Realistically, that's exactly how one of these cases should be handled.
07:13But when New Mexico police were put in the same position,
07:16they instead showed just how corrupt America's cops can be.
07:23This cop pulled over a truck in Lordsburg after suspecting the driver may have been drinking.
07:28However, after walking up to the window,
07:30he was hit with a wave of shock and disappointment.
07:41The driver was the city's mayor,
07:43and this was the third time she's been pulled over for this exact offense.
07:48And what's worse, she was driving like this with her foster child in the car.
07:58Just be quiet.
07:59The cops are now in an extremely awkward position,
08:02but after a short chat,
08:03they decide that they should proceed with the stop normally and do their jobs,
08:07at least for now.
08:08Hey, Glenda, you might step in another vehicle
08:10where we both would be picking her up on my unicycle.
08:12Yep.
08:13How much would you like?
08:16Three or four.
08:17Three or four?
08:18Okay.
08:18Yeah.
08:19As Glenda exited the vehicle,
08:21both of the officers noticed a strong smell of alcohol on her,
08:24and she quickly admitted to having a few drinks that night.
08:27Her slow speech and movement implies that she's definitely over the legal limit to drive,
08:32but this is the third time she's been pulled over for driving drunk.
08:35Will this really be the time she's punished for it?
08:38This officer certainly thinks there's a chance.
08:40Let me just get him home.
08:42Get who?
08:43Hit him.
08:44You know I'm the type of cop that doesn't give breaks.
08:46Okay?
08:47You're the type of cop that what?
08:49That doesn't give breaks.
08:50When I approached the vehicle,
08:51I did notice an awful odor of alcohol coming from the car,
08:54from alcohol coming from inside the vehicle.
08:55When I observed you walk out,
08:57you were kind of swerving all over the place, okay?
09:01And then right now you're just,
09:02as you're standing,
09:03you're kind of swaying side to side.
09:04Thing is,
09:05you're the mayor,
09:06okay?
09:07I'm your employee.
09:08It doesn't matter.
09:09I'm your employee.
09:10Now that you're standing downwind,
09:11I can smell it.
09:13Okay?
09:14I'm not denying it.
09:15Yeah, we can smell it on you,
09:16and the way you got out of your vehicle,
09:18Glenda, it's not good.
09:19As the officer said,
09:20Glenda is their boss,
09:22so there's clearly a conflict of interest here.
09:24So they call up New Mexico State Police to handle it from here.
09:27But when the original cops learn of the outcome,
09:30they realize they probably could have done a better job themselves.
09:34Four,
09:36five,
09:37six.
09:40It doesn't matter.
09:42So you're right there at that point.
09:47I don't think you're quite over the limit off of the clues that I saw,
09:50but I think you're right close to it.
09:52Where the limit might be 0.08,
09:54I think you're about a 0.06.
09:56My house is literally right around the corner.
09:59I'm not going to arrest you tonight.
10:01Okay?
10:01But if you've had any,
10:03I just say don't drive.
10:05Somehow, despite all the clues that the first two officers picked up,
10:09the state cops decided she wasn't over the limit when they arrived
10:13and was therefore free to drive.
10:15Now there's obviously the debate of corruption here,
10:18given that she's the mayor,
10:19but let's take his word as fact for now.
10:22The cop decided he thinks Glenda is at a 0.06 right now,
10:26but this was an hour after the initial stop was made.
10:28Taking into account that your blood alcohol level drops at a rate of
10:32around 0.015 an hour,
10:34Glenda was getting extremely close to the coveted 0.08 she'd be charged for.
10:39You may also be wondering why the cops didn't just use a breathalyzer
10:42to test her blood alcohol level immediately.
10:45The answer there lies in the fourth amendment.
10:48Cops have to provide probable cause that a driver is impaired
10:51before they're allowed to collect chemical evidence that proves this.
10:54That's what the sobriety tests are for.
10:56The combination of these two problems is what led to Glenda going home that night
11:00instead of to jail,
11:02why this is her third time being pulled over for this,
11:04and why it probably won't be her last.
11:07But unfortunately for this next boss,
11:08his employee wasn't so kind when it came to his DUI stop.
11:12Stay in your vehicle.
11:16Get back in your car.
11:18Drunk?
11:19No, I'm a captain.
11:21Huh?
11:22A what?
11:23Captain.
11:24A what?
11:25Don't reach in your pocket.
11:26Get back in your car.
11:27Have a seat.
11:28I will.
11:30I'm not.
11:35You've been drinking tonight.
11:37I just got a ride.
11:39You've been drinking tonight, sir.
11:41I'm a captain.
11:42I'm a police department.
11:44What police department?
11:45Oklahoma City.
11:50What division?
11:51Investigations.
11:53How much we had to drink tonight, sir?
12:00Police.
12:01Huh?
12:03I'm not turning my camera off.
12:05Okay.
12:05This guy isn't just drunk,
12:07he's absolutely hammered,
12:09even to the point where he thinks the camera can't hear him whispering.
12:12But despite the captain's pleas,
12:13the officer refuses to turn off his camera
12:16and continues with the investigation.
12:18Go ahead and step out of the vehicle.
12:22You gotta be kidding me.
12:25How much did we drink tonight, sir?
12:26I was at a poker game.
12:28Uh-huh.
12:30Because you're swerving all over me when you turn off your camera.
12:33You didn't use your signal.
12:34I'm sorry.
12:35How much did you drink at your poker game?
12:38Not much.
12:39Not much?
12:40How much is not much?
12:41I don't know.
12:42Beer?
12:43Liquor?
12:44How many beers?
12:46Three or four.
12:47Three or four?
12:48How long ago was that?
12:50It's been going on a while.
12:53How long ago did you drink your last beer, sir?
12:55What time is it now?
12:57It's zero one forty.
13:00Midnight.
13:02You think you should drive it?
13:03No, but I came from four blocks.
13:06And your mom lives here?
13:08I live here.
13:10You live here?
13:11Yes.
13:12Forward to the rear of your vehicle.
13:14Okay.
13:15You got any weapons or anything on you?
13:16I do not, sir.
13:18Those must have been a strong few beers, as not only was he stumbling over his words,
13:23but apparently also swerving across both lanes on his way home.
13:26The captain is then searched and told to stand in the open,
13:29where he's tested on his balance and sobriety.
13:31Hands down by your side, please.
13:35Look straight ahead.
13:36You see the tip of my pen, sir?
13:37I do.
13:37I want you to follow the tip of my pen without moving your head, okay?
13:44Come over here where it's a little bit more level.
13:48I'm going to demonstrate for you first.
13:49While I'm demonstrating, I want you to stand with your feet together.
13:52Hands down by your side, just like this.
13:53All right, sir.
13:54What's your name?
13:55Matt French.
13:56Matt French.
13:57Mr. French, stand just like that for me.
13:59When I tell you to begin, okay, I'm just going to demonstrate for you first.
14:02I want you to pick a foot of your choosing.
14:03It doesn't matter if it's your left or your right foot.
14:05I'm sorry.
14:07And I want you to lift it approximately six inches off the ground.
14:10And while you look at your toe, I want you to count by one thousand.
14:13It's one thousand one, one thousand two, one thousand three, one thousand four, one thousand five.
14:18So on and so forth until I tell you to stop.
14:20At any point in time, you lose your balance, your foot touches the ground.
14:23Just go ahead and pick your foot back up and continue to count, okay?
14:26Do you understand these instructions that I've explained to you, Mr. French?
14:30You may begin.
14:42I cannot, sir.
14:44I know you're aware of our body count policy.
14:47I do, but I'd like to talk to you.
14:52I can't do that, sir.
14:53Please.
14:55Are you going to do the test or not?
14:57Will you please talk to me?
14:59I'll talk to you once we're done.
15:00You can turn it off.
15:01You can turn it on.
15:02I can turn it off once I'm done with my investigation, sir.
15:04Okay.
15:05I'm a Capcom's police officer.
15:07I understand that, sir.
15:09I get that.
15:09And I am a sergeant on this police officer and I've taken an oath to uphold the law.
15:13I am not.
15:14I don't show favoritism to anyone regardless.
15:16I don't care if you're a gangbanger or the president of the United States.
15:19Sir, I'm not asking you for that.
15:22If I was to treat you differently than I was to treat like some south side loco or some pedo,
15:27how's that look on me?
15:29Okay.
15:29I'm not asking you for that.
15:31Because I wouldn't do that for any of them.
15:33Even as the captain begs him to turn his camera off and just talk,
15:37the officer stands his ground and states that he has to treat everyone the same
15:41or his job and livelihood could be at risk.
15:44He's showing a fantastic amount of integrity that unfortunately,
15:47we don't get to see too often.
15:49Likely due to people like this trying to pull rank.
15:52They then continue with the third and final test
15:54involving simply walking heel to toe for 10 steps.
15:57All right.
15:58Anytime you're ready, you may begin.
16:001, 2, 3, 4, 5, 6, 7, 8, 9.
16:111, 2, 3, 4, 5, 6, 7, 8, 9.
16:20Go ahead and turn around for me.
16:21Put your hands behind your back.
16:23Are you going to arrest me, sir?
16:24Yes, I am.
16:25Can I talk to you?
16:27Go ahead and put your hands behind your back, sir.
16:34Now that the investigation is concluded and the perp is placed under arrest,
16:38the officer turns off his camera and returns the captain to the police department.
16:42Not only was he suspended from his position as Oklahoma police captain,
16:46but he was also hit with the regular punishments for DUI,
16:49likely amounting to a small fine and a few months in jail.
