00:17:52That's a two-year-old that might be worth a segment on her own in the future
00:17:57because that was one of the most impressive two-year-old races.
00:18:00You'll see this early in the year, got a 101 buyer, which is basically unheard of for a June two-year-old.
00:18:05So definitely a horse worth watching.
00:18:07There was a story earlier this week in the TDN about her,
00:18:10and it's definitely a horse to keep an eye on for the summer at Saratoga
00:18:14because that's serious precocity to win by 14 lengths, stopped the clock in like 56-2.
00:18:20So basically went home in 34 flat, basically around the turn.
00:18:25Those Munnings can really run, man.
00:18:27And she looks like the world is her oyster if she can stay healthy
00:18:31because that was super, super impressive.
00:18:34All right, so we had a little bit more news on the Richard Baltus front.
00:18:37If you remember, this was a little bit mysterious about a month or so ago
00:18:40that Santa Anita wasn't going to take his entries.
00:18:43There was actually a late scratch on one of his horses,
00:18:45and there was a bunch of the rumor mill started spinning about what that meant
00:18:48and why he was being kind of soft suspended.
00:18:52And now we have more details based on a CHRB complaint, which was dated yesterday.
00:18:56Dan Ross reported on this in yesterday's TDN.
00:18:59It says between April 15th and May 8th this year,
00:19:0223 horses trained by Richard Baltus were allegedly administered a substance on race day
00:19:07in violation of the CHRB's rules.
00:19:10The complaint states that surveillance video caught Baltus's employees
00:19:14allegedly administering the substance on the days they were entered to race.
00:19:18In California, trainers face tight restrictions about what medications
00:19:22and supplements can be given to a horse within 48 hours of a race.
00:19:26He's been ordered to appear at a hearing at Los Alamitos
00:19:29before the Board of Stewards on July 1st.
00:19:32Now, I don't know.
00:19:33I mean, the two substances that supposedly were found were
00:19:38hygienamine and paenol, which I don't know what either of those things are.
00:19:42I don't know how much of a performance enhancer they are.
00:19:45It says, according to USADA,
00:19:47hygienamine is a chemical found in a variety of plants.
00:19:50It can act as an anti-asthmatic to open up airways.
00:19:53And then the other drug or the other substance is a plant extract as well.
00:19:59So I don't really care about what these drugs in particular,
00:20:02what these substances in particular do to horses.
00:20:04The fact that he was administering them on race day is the important thing
00:20:08because like we were saying, like the article was saying,
00:20:11very tight restrictions on that.
00:20:13And it's just something that you can't do as a trainer and something that
00:20:16why would you even risk it?
00:20:17If you know that there's increased surveillance and there's this increased,
00:20:21you know, very rigid program in California that they've instituted
00:20:25in the last couple of years,
00:20:27why would you even take that chance that you're going to get busted
00:20:30for something like this?
00:20:31That says to me, now I don't have any proof of this,
00:20:34but that says to me that there's other stuff that he's been doing along the way
00:20:38that maybe have not been caught by the CHRB or the California stewards
00:20:42or anybody because it does not seem to me like this would be the first time
00:20:46that he would take that chance.
00:20:47So what do you guys think?
00:20:49Well, John, a couple of things, excuse me, Joe, a couple of things here.
00:20:52I think you're right.
00:20:53I mean, I never heard of these drugs either.
00:20:55I kind of, you know, reading between the lines,
00:20:57it doesn't seem like they're real super potent performance enhancers.
00:21:01But again, that's not the point.
00:21:02You can't give it to the horses on the day of a race.
00:21:06And he wasn't just caught doing it once.
00:21:08He was caught 23 times.
00:21:10The other thing about this that jumped off the page to me is that how was he
00:21:15caught surveillance cameras?
00:21:16And, you know, this is something we've mentioned before.
00:21:20Shouldn't there be a surveillance camera in every barn,
00:21:23in every racetrack in the United States of America?
00:21:26And then we're going to get into some good, some, you know,
00:21:29another thing where we're going to pat Sandy down the back in a minute was
00:21:32about their safety record.
00:21:33This is, again, the Stornik group slash San Diego slash first racing,
00:21:37doing it right.
00:21:38They're putting these darn cameras in there.
00:21:40And if you're doing something, you're going to get caught.
00:21:42It does beg the question.
00:21:44What was he thinking?
00:21:45You know, you're doing this, you know, there's these cameras here.
00:21:48You know, why would you go ahead and do it?
00:21:50I think some, you know,
00:21:51maybe these guys just think that they're bulletproof because they probably
00:21:54been doing these sorts of things for years and never getting caught.
00:21:57But again, you know,
00:21:59I don't know how many surveillance cameras there are at the backstretch of
00:22:02Saratoga, the backstretch of Churchill Downs,
00:22:04the backstretch of Keeneland or whatnot.
00:22:06But my understanding is that at Santa Anita,
00:22:09they're in every single barn and that's absolutely the way it should be.
00:22:12So good for Santa Anita.
00:22:14We'll see what happens to Richard Baltus down the road,
00:22:16because not only does he have the CHRB potential suspension,
00:22:20but he was also, and again,
00:22:21Santa Anita has been real careful about what they say,
00:22:23but it appears that they put a ban in on him as well.
00:22:26So if he gets a 45 day suspension or something like this,
00:22:29then the next question is, well, Santa Anita let him back.
00:22:31You know, that's something we don't know yet.
00:22:34And it's great for the industry that at least we have the ability to go
00:22:39ahead and police in this way.
00:22:41And if we have video cameras and surveillance cameras,
00:22:43then it's just one more piece of evidence to show against,
00:22:47you know,
00:22:49with regard to how they're handling horses on race day.
00:22:53And I know, and you guys know this as well from being on the backstretch,
00:22:56when a horse is entered, I mean,
00:22:58it's gotten to the point where like you can't get within 10 feet of the
00:23:01horse. I mean, there's a cone there.
00:23:03There's a stall sign that says racing do not disturb, you know,
00:23:08or in today do not, you know, do not touch.
00:23:10I mean, and it's in three different languages. I mean,
00:23:12and basically you can't get near one of your horses on race day.
00:23:17And quite frankly,
00:23:18that's the way it should be because these horses should be running on their
00:23:21own talents, not on what the chemical advances can be.
00:23:24Do the drugs that are allegedly, you know, in question here,
00:23:29do they really enhance? It doesn't matter how much they enhance.
00:23:31If they enhance a little bit and give somebody a little bit of an edge,
00:23:34you've seen how many races have been won or lost, you know,
00:23:36based on you know, feet run and based on, you know,
00:23:39maybe it opens up their bronchioles 1% more well,
00:23:43then that's an advantage that they have over a different horse.
00:23:45So it shouldn't be, it shouldn't be happening.
00:23:47And you guys mentioned also the timing of it. You can't,
00:23:49you just can't mess with these horses 24, 48 hours before they run.
00:23:53It's just against the rules, irrespective of what they gave the horse.
00:23:57So, you know,
00:23:58kudos to the Santa Anita for really taking it seriously because again,
00:24:03a couple of years ago, guys,
00:24:04we were talking about how California racing may be extinct.
00:24:08I mean, it was getting to that point politically and,
00:24:12and with some of these other strong groups like PETA that were coming in and
00:24:15banging at the gates and correctly.
00:24:17So about how it was an unsafe industry and,
00:24:20and Santa Anita in particular has done a really good job of safety measures,
00:24:24of changing the racetrack, of getting surveillance cameras,
00:24:27of really taking this seriously. And I really, you know, I, as a,
00:24:31as an owner appreciate the fact that the group is doing this and they're on
00:24:36the forefront of really making this, you know, a serious charge.
00:24:39So I don't know what's going to happen, you know, in,
00:24:41in the court of appeals with, with Baltus and his,
00:24:43and his attorneys and everything like that.
00:24:45But it's got to make some of these trainers pause and at least think about what
00:24:50they're doing now,
00:24:51may not change them for what they're doing because Bill, as you,
00:24:54as you mentioned before, when somebody gets away with something,
00:24:56they think they're bulletproof and they can continue to get away with it over
00:24:58and over again.
00:24:59But it's nice to know that,
00:25:00that a couple of these racetracks are starting to implement some of these
00:25:03safety precautions and security cameras.
00:25:06And that that should be the way it is all around, you know,
00:25:09United States racing, because it's still to this day, you can still,
00:25:13you know,
00:25:14with a wave and a nod and maybe a donut and a coffee get by the security at
00:25:17most of the, most of the racetrack, you know,
00:25:19security groups at this point in time,
00:25:21if you look like you know what you're doing and they don't want to come out
00:25:24of their, their security shed,
00:25:26then you probably just can wave and go on your business and do whatever you
00:25:29want to any horse. So, you know,
00:25:32I think it's great that we're implementing these things and it doesn't
00:25:35matter why we're implementing it because of political reasons or because of
00:25:39Haise or whatever the reason is,
00:25:42it's that we're doing it and that now it's not a, he said,
00:25:45she said kind of situation.
00:25:46We actually have hard facts to show and video surveillance to show that these
00:25:51guys are cheating.
00:25:52Yeah. And like you said,
00:25:53you guys are saying the video surveillance is so huge because you don't,
00:25:56and generally in general, you do not catch guys with testing,
00:26:00especially if they're ahead of the test in terms of what you can test for.
00:26:03So surveillance is huge and there's no,
00:26:05there's no excuse not to have surveillance cameras at every major racetrack,
00:26:09every racetrack period in America.
00:26:11It's never been cheaper to buy like a ring camera for your door like this.
00:26:14It's just, it's,
00:26:15it's easy with technology these days to have surveillance and,
00:26:18and that's, that's the way you catch guys.
00:26:20Because in general, as a general rule,
00:26:22I don't think guys are going to be injecting stuff or,
00:26:26you know, administering stuff to horses day of the race,
00:26:29unless it's for something that they think is going to improve their
00:26:31performance.
00:26:32I don't think it's going to be a vitamin supplement.
00:26:34I don't think they're going to take that risk for something that's going to
00:26:36have no effect on how well the horse is going to run.
00:26:38So I think that that's, that's so huge.
00:26:40And like you guys are saying,
00:26:41Santa Anita is doing a great job,
00:26:43but it shouldn't just be on there.
00:26:44It shouldn't be,
00:26:45they shouldn't have to be the industry leader.
00:26:46And that's what we're kind of hoping for with Hyza to eventually come in and,
00:26:50and wrap their arms around all of racing and all of the jurisdictions.
00:26:53And we talked to Lisa Lazarus,
00:26:55Lazarus was the CEO of Hyza.
00:26:58We talked to her yesterday.
00:26:59That's this week's green group guest of the week.
00:27:01So stay tuned for that.
00:27:02And you know, it's the,
00:27:03obviously there's still a lot of questions to be answered in that regard and
00:27:06how much power they're actually going to have and how well that's going to
00:27:09work out.
00:27:10But at least it's something that,
00:27:11that aims to get all of this under one umbrella so that it doesn't have to
00:27:15be on Santa Anita, but kudos to them.
00:27:17Kudos to Santa Anita and kudos to California racing for being proactive and
00:27:21taking these steps because it's working.
00:27:23And I say, you know, I sometimes on the show,
00:27:26one of the things I complain about is that one of the reasons that guys have
00:27:29been able to get away with stuff for so long is that they fill stalls and,
00:27:33and, you know,
00:27:34racetrack officials generally would look the other way for guys who fill stalls
00:27:39and fill fields.
00:27:40And it's,
00:27:41it's a little bit of a crisis in Santa Anita right now in terms of short
00:27:44fields, but sometimes you got to take that.
00:27:46Sometimes you got to eat that to do what's best for the horses.
00:27:49And, you know,
00:27:50Richard Baltus has had 400 plus starters every year going back to 2016.
00:27:55In 2018,
00:27:56they have 534 starters a year before that he had 511.
00:28:00This is the guy who fills the entry box at Santa Anita and in California,
00:28:04but it shouldn't matter.
00:28:05You know,
00:28:06you shouldn't get better.
00:28:07You shouldn't get preferential treatment just because you start a lot of
00:28:10horses.
00:28:11You should get the same rules that apply to you for a guy who has five horses
00:28:15and runs maybe 40,
00:28:1650 starters in a year.
00:28:18It should all apply equally.
00:28:19And,
00:28:20you know,
00:28:21I hats off to Santa Anita for saying,
00:28:23you know,
00:28:24that's the most important thing is to make sure that the guys are,
00:28:27aren't cheating their horses and aren't treating their horses in a way that,
00:28:30that we would not want to be broadcast to the public because this stuff
00:28:34eventually gets out.
00:28:35You know,
00:28:36this story in particular,
00:28:37probably not a big enough deal.
00:28:38Richard Baltus in particular,
00:28:40not a big enough deal to,
00:28:41to catch the attention of the general public.
00:28:43But if you let those things fester for long enough,
00:28:45eventually it's going to blow up into a huge story.
00:28:47And what,
00:28:48what,
00:28:49you know,
00:28:50what goes on in the darkness eventually comes to lights.
00:28:52So I'm,
00:28:53I'm happy to see that happy to see the surveillance system working.
00:28:55And I think that this is at least partially related.
00:28:58It came out after this past weekend when the Santa Anita meet wrapped up
00:29:03track officials at Santa Anita.
00:29:05I'm quoting a story from NBC,
00:29:06Los Angeles here,
00:29:07which is great to see period.
00:29:09These things getting reported,
00:29:10the good news getting reported.
00:29:11According to track officials and CHRB records,
00:29:14there were three racing fatalities at the track during the meet from among
00:29:18more than 4,800 starters.
00:29:21So that's one in every,
00:29:22every 1600,
00:29:23which is obviously less than one per a thousand,
00:29:26which is what we're striving for right now is to try to get that number
00:29:29below one and Santa Anita has done that.
00:29:32And there were none,
00:29:33there was zero musculoskeletal racing fatalities that occurred on the main
00:29:37track at Santa Anita.
00:29:39And you look,
00:29:40go back to a couple of years ago,
00:29:42there were 40 or 50 at that meet in 2019.
00:29:45So it's park official called park officials called the safety record,
00:29:49a 62.5% improvement over the previous year and a 74%
00:29:54improvement since the spring of 2019,
00:29:57when a total of 42 horses died at the facility,
00:30:00obviously sparking that huge controversy and,
00:30:03you know,
00:30:04basically putting the rate,
00:30:05the entire racing industry,
00:30:07but especially in California on life support and on the edge,
00:30:10teetering on the edge of extinction.
00:30:13And it took a lot of work.
00:30:15And we've spoken about this on the show before,
00:30:17but it's worth bringing up over and over again,
00:30:19as long as these safety records continue to improve and continue to be
00:30:23sparkling, like they are in Santa Anita right now,
00:30:25how much work it takes not,
00:30:27not just from track officials or from trainers and from vets and from
00:30:31jockeys and everybody on the grounds of Santa Anita that has to go along
00:30:35with these new protocols and has to kind of adjust their lives and,
00:30:39and their training regimens to,
00:30:41to really adapt and do what's best for the horse first and foremost.
00:30:45And then, you know,
00:30:46it seems like that's,
00:30:47that's what's going on in California.
00:30:49And I wish that it were reported on CNN and,
00:30:52you know,
00:30:53Washington post.
00:30:54And I,
00:30:55I wish this were on front pages all across the country.
00:30:57And,
00:30:58you know,
00:30:59unfortunately that's,
00:31:00it's not going to happen because it only,
00:31:01if it bleeds,
00:31:02it leads kind of thing where it's only,
00:31:03you know,
00:31:04bad news tends to get reported a lot more than high profile,
00:31:06you know,
00:31:07a lot more high profile than good news.
00:31:09But this is something that we should be talking about in racing that
00:31:12people inside of racing should be championing and should be,
00:31:14there should be a public re relations push to get people to know this,
00:31:18to say,
00:31:19look,
00:31:20we were in a really bad place and there were,
00:31:22you know,
00:31:23a lot of horses were dying,
00:31:24unfortunately,
00:31:25and it was horrible,
00:31:26but here's what we've done to,
00:31:28to rectify the situation.
00:31:29And here's why racing should stick around because people do care about their
00:31:33horses.
00:31:34You know,
00:31:35we're not an exploitative industry overall.
00:31:36Yes.
00:31:37There are some people who don't do right and we're trying to weed those
00:31:40people out.
00:31:41But for the rest of us,
00:31:42we care about the horses.
00:31:43And,
00:31:44you know,
00:31:45this,
00:31:46this game is everything in these animals are everything to us.
00:31:47And that's,
00:31:48you know,
00:31:49that that's exactly what these numbers say is that there,
00:31:51there is,
00:31:52there is now a concentrated effort to,
00:31:54to put the horses first and,
00:31:56and to show everybody that there's no game without the horses and the horses
00:32:00safety.

00:34:31who is the Haiza CEO.
00:34:33She's been doing a pretty good job and I think Haiza has been doing a pretty

00:34:38Obviously this is,
00:34:39this is kind of a scramble here to get everybody ready for the July 1st
00:34:43implementation date.
00:34:44We still have six months to January 1st after that for the,
00:34:47for the drug enforcement program.
00:34:49So we asked her a bunch of questions.
00:34:50We had a little bit of technical difficulties where we couldn't hear some of
00:34:53what she was saying.
00:34:54So we didn't get to ask the followups,
00:34:56all the followups that we quite wanted to,
00:34:58but you'll be able to hear and see everything and the quality is perfect in
00:35:02that regard.
00:35:03So it was a good conversation.
00:35:05And then I think we're going to try to have her on maybe a couple of months
00:35:08into Haiza after,
00:35:09after July 1st to just kind of follow up and see where things are at and see

00:35:40integrity and safety authority,
00:35:41which is the governing body of the horse racing integrity and safety act.
00:35:45Lisa Lazarus, thank you so much for coming on.
00:35:47I'm very happy to be here and thank you for inviting me.
00:35:50Yeah, no, we're super excited to have you.
00:35:52And then I think you guys have been done a good job answering questions so far
00:35:55as we creep towards that July 1st implementation date.
00:35:58And we have a lot more questions for you, but before that,
00:36:01let's just do a little brief background on your,
00:36:03your history and how you came to be involved in racing.
00:36:06Sure. So I am a lawyer by training.
00:36:09I spent really the first 10 years of my career actually following being at a,
00:36:15at a law firm at the national football league representing teams and management
00:36:21on some of the similar, you know,
00:36:23same issues that I'm actually addressing now in horse racing,
00:36:26such as their anti-doping program, although it was obviously a human program.
00:36:30Following that, I was general counsel of the international question federation
00:36:34where I completely revamped launched and,
00:36:37and ran an equine anti-doping program for 133 national federations from
00:36:42different countries and sport horses, obviously following that,
00:36:46I was at a, I started an equine law practice where I represented primarily
00:36:50horsemen in the sport horse sport world.
00:36:53And then I was delighted to get the opportunity to,
00:36:56to lead Haiza as its first CEO, first permanent CEO.
00:37:00And I guess that's, that's where we are now.
00:37:03Well, great. Thank you, Lisa.
00:37:05And thanks for joining us. And we're now, what is it?
00:37:08So nine, 10 days away from the implementation on July 1st,
00:37:11I guess the big push now is to get as many people,
00:37:14get people in the horses registered kind of a two part question.
00:37:16How is that going? And come July 1st,
00:37:20is there a possibility that if people are not registered,
00:37:23their horses not registered, we may see some horses have to be scratched,
00:37:27or is there going to be a grace period?
00:37:29So the first question I'll answer is, you know, from my metrics,
00:37:34I feel like it's going quite well.
00:37:36Now we have about 26,000 persons plus horses registered.
00:37:42And the sort of trajectory of registrations is on a very steep incline.
00:37:48So we're seeing, you know, more registration sort of every day,
00:37:51obviously, as we get closer to the deadline,
00:37:54we're doing everything possible in order to answer people's questions
00:37:58and try to make sure people know how to get registered.
00:38:00We're making sure that people have the tools to get registered.
00:38:03What we're going to roll out,
00:38:05and I'm actually going to be announcing it now for the first time on your show
00:38:07here, is we've heard some concerns from people that, you know,
00:38:11if they register, they're giving up a lot of rights.
00:38:14They don't know what the antidote medication control program is going to look like.
00:38:17So we're going to be rolling out a feature that allows people to unregister
00:38:20very easily at any time.
00:38:22So they ultimately change their minds.
00:38:24They don't have this. I mean, well, you know,
00:38:26my view is that once we get going on July 1,
00:38:29everyone's going to realize this program is actually supportive,
00:38:32that it's not going to be punitive, that we're really going to kind of do our best.
00:38:34And then the other thing to answer your question on will horses be scratched,
00:38:39the way the system is set up is that racing offices can take entries
00:38:43of unregistered persons and unregistered horses.
00:38:46What's going to happen is that the racing office will be notified
00:38:49when they do that, that those persons are not registered.
00:38:52And then we sort of built in a warning system,
00:38:55although then be notified and said, you know,
00:38:57you've got two, three days before the race itself,
00:38:59you know, please go ahead and register.
00:39:00If we get to July 2nd and because we will also give July 1
00:39:04as a registration day as well, since that's the effective date.
00:39:07If we get to July 2nd and we don't have a responsible person,
00:39:13which is usually the trainer, one designated owner,
00:39:16and the horse registered, then we will be forced to scratch.
00:39:21But what I'm really hoping, as I said, that we don't get to that
00:39:24and that we're able to basically answer everyone's questions
00:39:27and get everyone registered.
00:39:28Gotcha. You mentioned the drug enforcement partnership.
00:39:31I think, you know, a big part of the initial bill being passed
00:39:35and what everyone got excited about was getting USADA on board
00:39:38because they brought instant credibility
00:39:40with their drug enforcement history.
00:39:42Obviously that fell through and we're still working through that.
00:39:44We have six months beyond the effective date of HISA
00:39:48before the drug enforcement program is scheduled to go into effect.
00:39:51So where are we with that?
00:39:53I know you guys are talking to new partners
00:39:55and how close is that to getting up and running?
00:39:56So that's very close to getting up and running.
00:39:58In early May, we appointed the Center for Drug-Free Sport
00:40:02to be the enforcement agency and they've created an entity
00:40:05called the Horse Racing Integrity and Welfare Unit.
00:40:08And that unit has essentially like five pillars.
00:40:11It has the testing pillar, the lab accreditation pillar,
00:40:15education, science, and also prosecutions.
00:40:18Oh, and investigations as well.
00:40:20So we're basically working on equipping all of those pillars
00:40:24to be ready to go on January 1.
00:40:26We have some top people and experts in their field involved.
00:40:31And we also have, and this is important I think for your listeners,
00:40:34that the anti-doping and medication control rules
00:40:37are actually posted on our website now for public comment.
00:40:41So if anybody wants to have their say
00:40:43or wants to be heard on any particular issue,
00:40:45please make sure to comment before the end of the month.
00:40:47Lisa, on the same question of the drug test in USADA,
00:40:50and this is a personal feeling,
00:40:52I was very disappointed when USADA dropped out
00:40:53because I felt that they were the kind of a gold standard
00:40:57when it comes to this.
00:40:59And I think that racing has learned
00:41:01through the indictments of Service Navarro and the rest
00:41:03that drug testing alone is just not good enough,
00:41:07that there's too many ways you can evade the test
00:41:09and people don't get caught.
00:41:11So reassure me, what can Drug-Free Sports International do
00:41:14above and beyond standard drug testing?
00:41:17And are we going to come to January 1,
00:41:20are we going to catch the bad guys?
00:41:21I'll put it as simple as that.
00:41:23Yeah, so I actually feel really comfortable
00:41:25that the alternative that we selected
00:41:28is going to be as effective or more
00:41:31than what we were initially discussing.
00:41:33And that's because we put a lot of investment
00:41:36into the investigation component.
00:41:39You know, we have one of the sort of top people internationally
00:41:43from the World Anti-Doping Agency on our advisory council.
00:41:46And we also are in the process of staffing up
00:41:48with some really, I think you'll be very impressed
00:41:51by the people that are going to be actually running that.
00:41:54The testing is one component, but it's only one component.
00:41:57It has to work in conjunction with investigations,
00:42:01in conjunction with lab accreditation and prosecutions.
00:42:03So all of those areas need to be strong.
00:42:06And, you know, I'm really confident
00:42:09that the industry is going to see
00:42:11that we have that in place come January 1.
00:42:14All right, so then the other question is,
00:42:16since we still have a little bit of time
00:42:18before the Drug Enforcement Program is set to take form
00:42:19and kick in, what are the main benefits now
00:42:24from July 1 to January 1?
00:42:26I'm all for unification in racing just in general,
00:42:30but just what are some of the specific reforms
00:42:32that you're going to implement starting July 1
00:42:35that people need to get behind?
00:42:37So first of all, you're going to see a uniform crop rule,
00:42:40which we haven't had in place before.
00:42:43So every racing jurisdiction will be essentially limited
00:42:46to the same, you know, governed by the exact same rule
00:42:50around the crop, how many strikes,
00:42:52the way the strikes can actually be administered, et cetera.
00:42:56I think that's going to be an important change
00:42:58because it's very hard for people to follow state to state.
00:43:01There are also obviously sort of welfare and concerns
00:43:04that we believe are associated with crop use.
00:43:07You're also going to see enhanced health
00:43:10and safety requirements and oversight for jockeys,
00:43:13which I think is a population
00:43:14that has traditionally been underserved.
00:43:17You're going to see enhanced veterinary reporting
00:43:19and enhanced veterinary inspections,
00:43:21which we think are a key to reducing equine fatalities
00:43:24and equine breakdowns.
00:43:26And you're going to see something called
00:43:28the voided claim rule across the country,
00:43:30which also we think is going to contribute
00:43:32towards equine welfare and also a level playing field.
00:43:35Gotcha.
00:43:37Lisa, where do we stand in Texas right now?
00:43:39And obviously there's some controversy there
00:43:41with the Texas Racing Commission saying
00:43:43that as of July 1,
00:43:45they're not going to be simulcasting the races anymore.
00:43:47Is there an 11th hour solution to this problem?
00:43:50And if not, kind of what does that mean
00:43:52for the bigger picture?
00:43:54Sure. So as you may know, and you might've read,
00:43:56I went down to Texas and I met
00:43:58with the Texas Racing Commission
00:44:00and their executive director, Amy Cook,
00:44:02as did my general counsel, John Roach.
00:44:04We tried really hard to find a solution.
00:44:07Ultimately, Texas's view is that given the way
00:44:11that their Texas Racing Commission regulations
00:44:13are written, are structured,
00:44:15they don't have the authority
00:44:17to allow another regulator to come in
00:44:19and regulate any portion of horse racing.
00:44:21Obviously, we believe that's not consistent
00:44:23with the federal law
00:44:25and essentially what Congress ordered.
00:44:27In Texas right now,
00:44:29the only racetrack running is Lone Star
00:44:31and they only run until July 23rd.
00:44:33So ultimately it's really sort of 22 days of racing
00:44:36that's at issue and I had really hoped
00:44:38that we could reach a resolution.
00:44:39However, what I believe is going to happen
00:44:42and what I'm hopeful will happen is that
00:44:44we then have from the end of July to January 1
00:44:46to try to find a way forward with Texas.
00:44:49And what Texas essentially did was
00:44:51they, in my view, acknowledged
00:44:54the impact of the federal law
00:44:56by essentially taking themselves
00:44:58out of federal authority
00:45:00or out of HISA's authority
00:45:02by ordering their racetracks
00:45:04not to export their signal
00:45:06for paramutual wagering,
00:45:07which is ultimately the remedy
00:45:10that the act provides us with
00:45:13in order to enforce our regulations
00:45:16against the racetracks.
00:45:18Gotcha.
00:45:20So my question is,
00:45:22because there are states that have opted out
00:45:24and there's still questions
00:45:26about the cost structure of the bill
00:45:28and how it's going to be implemented.
00:45:30How does that affect the way you guys
00:45:32will end up deciding the cost structure
00:45:34when states do opt out like when Texas,
00:45:35I assume you guys were banking
00:45:37on having the fees come in
00:45:39from that state or this state.
00:45:41So how does that affect the way
00:45:43the cost structure is going to be distributed?
00:45:45So I think there's a bit of confusion
00:45:47about what the impact of the opt-ins are.
00:45:49So if the state opts in financially,
00:45:51all that means that the racing commission
00:45:53gets to decide how the fees are collected.
00:45:55But if the racing commission
00:45:57doesn't opt in financially,
00:45:59the responsibility for collecting fees
00:46:01goes to the racetracks in that state
00:46:03under a certain cost model
00:46:05for the person to come up with an allocation.
00:46:07So at this stage,
00:46:09essentially almost,
00:46:11I think maybe one or two racetracks
00:46:13we don't have their split yet,
00:46:15but we have the cost resolutions
00:46:17or agreements from every racetrack
00:46:19in this country.
00:46:21And so that falls under our authority,
00:46:23I should say.
00:46:24That is a thoroughbred horse race
00:46:26that exports their signal for simulcast.
00:46:28And so it just changes.
00:46:30It only changes where the fees come from,
00:46:32not whether or not we get the fees.
00:46:33So if Texas is not under our authority,
00:46:35the Texas,
00:46:37what we would have otherwise collected from Texas
00:46:39will have to be redistributed
00:46:41to other racetracks or other states.
00:46:43Lisa, yesterday you were meeting
00:46:45via Zoom with horsemen in Kentucky.
00:46:47And there was a lot of talk about
00:46:49why don't you just,
00:46:51there's too many moving parts here.
00:46:53It's not all coming together.
00:46:55Why don't we just delay this?
00:46:57What would be the problem to that?
00:46:59And what was your answer to them about that?
00:47:01So first of all, I met in person.
00:47:03I met with horsemen.
00:47:05The second thing is what I've essentially said is
00:47:07we've delayed implementation and enforcement
00:47:09of those areas we can control.
00:47:11But Congress and the FTC
00:47:13does not want this delayed.
00:47:15That's who we report to.
00:47:17And I don't have the authority
00:47:19to actually delay the bill itself
00:47:21or the act itself.
00:47:23What we are trying to do
00:47:25is phase in a lot of the elements
00:47:27and not make enforcement
00:47:29overwhelmingly harsh or difficult
00:47:31for horsemen to adjust come July 1.
00:47:33I think you guys have done a good job
00:47:35going on listening tours and talking to people.
00:47:37What are some of the reasonable concerns
00:47:40from horsemen that you've heard?
00:47:42And how have you guys adjusted
00:47:44or maybe kind of explained things
00:47:46to assuage those concerns?
00:47:48So, you know, the horsemen
00:47:50are really the heart of the sport.
00:47:52And so it's really important
00:47:54that we listen to them
00:47:56and we hear their feedback.
00:47:58And we have made adjustments for them.
00:48:00We've made adjustments to
00:48:01some of the crop specifications
00:48:04and the horseshoes to allow time
00:48:06for our horsemen to be able to adapt.
00:48:08We've made modifications
00:48:10to some of the restrictions
00:48:12on treatments like pin firing.
00:48:14There was a lot of concern about that.
00:48:16And we made it clear
00:48:18that it's only prohibited on the shins.
00:48:20And we've also delayed, you know,
00:48:22implementation where we can
00:48:24allow people to adjust.
00:48:26And we're constantly asking horsemen for feedback.
00:48:28We obviously can't respond to everything.
00:48:29But we're trying to be responsive
00:48:31to those legitimate concerns.
00:48:33All right, cool.

00:53:45So can't wait to put that up on my wall.
00:53:47But yeah, my head can't get much bigger,
00:53:49but it's definitely a concern with the things
00:53:53that have been going on the last few weeks for this show,
00:53:55but it's always exciting.
00:53:56And yeah, I cannot wait to see her run
00:53:59and we'll be rooting her on for sure.
00:54:01And just as an update,
00:54:03cause I know Skip, you know, super super fan Skip
00:54:06was asking me,
00:54:07Standard Goodside was shipped to Churchill Downs,
00:54:10breezed on that racetrack and is still on course
00:54:13to run in the Bashful Matter July 4th weekend.
00:54:16So we're super excited about that.
00:54:18And depending on how he and Writer's Room run,
00:54:21you know, in the next couple of weeks,
00:54:22there could be another naming contest in the mix.
00:54:27Lane's End, did you hear that?
00:54:28The last one, you got a lot out of that naming contest.
00:54:31Week after week after week,
00:54:33somebody else wants to outbid Lane's End
00:54:35and do a naming contest.
00:54:37No, that was so much fun.
00:54:38And yeah, it's, you know,
00:54:40Standard Goodside looking like a little bit of a monster.
00:54:44Yeah, why not?
00:54:44Why not send in some names
00:54:46and see if we can get another one.
00:54:48And John, three or four years from now,
00:54:50you'll have to breed Writer's Room
00:54:52to stay on our good side, right?
00:54:53You know, if only that would happen, Bill,
00:54:55and maybe he'll stand at Lane's End
00:54:57with his father and grandfather.
00:54:59I mean, that would really be good.
00:55:01But, and just, if we do another naming contest,
00:55:03can we just make sure that everyone understands
00:55:05that you can't just beat up on Bill.
00:55:07You can't just name horses,
00:55:08like Bill's a curmudgeon or Bill's ass,
00:55:11or, you know, like, or the Red Sox suck,
00:55:13because those names have already been taken, actually.
00:55:15So we need to come up with some really good names
00:55:18about like what Skip did with his 30 entries.
00:55:21I would say 29 of Skip's 30 entries were really solid
00:55:23and right on the mark, you know,
00:55:24with regard to the breeding.
00:55:25So if we do it again, if we get a sponsor for, you know,
00:55:28for this and we do it again,
00:55:29then it'll be extra juice for the show.
00:55:32And it's just so much fun to have a horse named
00:55:35after the show.
00:55:36And like you said, Joe,
00:55:37it does inflate our egos that much more,
00:55:40but we deserve it.
00:55:41Totally.

00:55:48that every time John misses an interview,
00:55:50it's because he pulled a muscle from patting himself
00:55:52on the back a little bit too much, like Barry Horowitz.

00:58:59you know, with Wit and Girl With a Dream
00:59:01and many other graded and black type winners.
