03:55Therefore, what will be the interpretation of this hadith?
03:58Imam Tahawi says that this hadith has been narrated,
04:04according to us, at the time when interest was permissible.
04:09And the Prophet, peace and blessings of Allah be upon him,
04:11did not forbid that loan from which any benefit was obtained.
04:15And he did not forbid anything more than that.
04:20Then later on, the Prophet declared it as interest,
04:24and declared it as Haram.
04:26And forbade any loan from which any benefit was obtained.
04:30So, according to the Hanaaf, this hadith has been abrogated.
04:34Those hadiths in which there is any possibility of taking benefit in return for a loan,
04:40therefore, it will not be right to argue with this.
04:44But anyway, if the Shafi'i, while imitating their Imam,
04:48argue with this, they cannot stop it.
04:50Okay, they follow their Imam.
04:52But according to the arguments of Imam-e-Azam ibn Hanifa,
04:56we will have to avoid this work.
04:59We come to the next hadith.
05:01Hadith number 2512 of Hazrat Abu Huraira, may Allah be pleased with him,
05:06is the narrator of this hadith.
05:08He says that the Prophet, peace and blessings of Allah be upon him,
05:10said that anything which is interest,
05:12it will be used instead of its expense,
05:15and its milk will be consumed instead of its expense,
05:19when it is interest.
05:20And whoever will ride or drink milk,
05:22it will be used instead of its expense.
05:24This is the same pure hadith.
05:26Now, we also have an objection in this,
05:28that where has the Hadith been stated by the government,
05:31that whoever has a loan,
05:33he will take benefit from it, he will drink its milk.
05:35It was definitely said that the milk will be drunk,
05:37and the expense of the animal will be taken out.
05:39Therefore, this can also be for the accused,
05:42that he was kept as a guarantor,
05:45but it can also be for the traitor,
05:47that he was kept as a guarantor,
05:49and the government is saying about him,
05:51that he can ride his animal,
05:53but its expense will be given to him.
05:55And in the same way, if he has drunk milk,
05:57then the expense of the milk will be given.
05:59So, it is possible that there are such kinds of hadiths,
06:02but for the accused himself,
06:04for the one who has a loan,
06:06there is no objection,
06:08that he is being allowed to take benefit from it.
06:11The next point is the same,
06:13Baab-ur-Rahni Indar Yahudi Wa Ghairihim.
06:16The Jew or the one who has a loan.
06:20In Hadith number 2513,
06:23our mother, Sayyeda Ayesha Siddiqa,
06:25may Allah be pleased with her,
06:27narrates that the Messenger of Allah,
06:29bought food from a Jew,
06:31i.e. he bought a pot,
06:33and he kept his Zira as a loan.
06:38I have spoken about this.

06:45There is an explanation in it,
06:47that the Messenger of Allah,
06:49did this for the education of the Ummah,
06:51and he did it temporarily.
06:53And to explain this,
06:55that there is no objection to taking loan
06:57by keeping it as a loan.
06:59We come to the next point,
07:01Arabic
07:09When there is a difference between
07:11Rahin and Murtahin,
07:13and in the same way there is a difference
07:15among other people,
07:17then Muddai, i.e. the one who claims,
07:19must be witnessed,
07:21and Mudda'a alaih,
07:23the one against whom the claim was made,
07:25must be sworn.
07:27There are such words in the second Hadith,
07:29Arabic
07:33The one who is a claimant in a case,
07:35must be witnessed,
07:37and if he is not,
07:39then it is necessary to swear
07:41on Mudda'a alaih.
07:43Now it is a little difficult
07:45to define Mudda'i and Mudda'a alaih,
07:47but there is a principle in it,
07:49that the one who is claiming for the real,
07:51he is a Muddai,
07:53and the one who is claiming
07:55against the real,
07:57he is a Mudda'i,
07:59and the one who is claiming
08:01against the real,
08:03he is a Mudda'a alaih.
08:05Now what is the difference
08:07between the real and the one
08:09against the real?
08:11In terms of order,
08:13the first thing is the real,
08:15and the latter is the one
08:17against the real.
08:19For example,
08:21we are unmarried first,
08:23and married later.
08:25And being unmarried
08:27will be against the real.
08:29Similarly, when husband and wife
08:31are married,
08:33and divorce comes later,
08:35then in husband and wife,
08:37marriage is the real,
08:39and divorce is against the real.
08:41Now suppose the wife says
08:43that her husband has divorced her,
08:45and the husband says
08:47that he did not divorce her,
08:49meaning his marriage is still.
08:51So marriage was the real,
08:53and the husband is claiming
08:55the marriage,
08:57and the wife is claiming
08:59the divorce,
09:01and the one who is claiming
09:03against the real,
09:05he is a Mudda'i,
09:07and it is necessary
09:09to bring a witness.
09:11So we ask the wife
09:13to bring a witness
09:15against the divorce.
09:17If she says that she does not
09:19have a witness,
09:21then it is said that
09:23you have to swear
09:25that you did not divorce her.
09:27If the husband swears,
09:29then it is decided for the husband.
09:31If he swears falsely,
09:33then it is decided for him.
09:35But if the woman
09:37brings a witness,
09:39then it is decided for the woman.
09:41Then even if the husband
09:43swears a lot,
09:45because the first government
09:47has given the witnesses.
09:49I am not talking about
09:51Pakistani people,
09:53but every person who is born,
09:55the child is indebted,
09:57but the child who is born
09:59has not taken a loan,
10:01he is not indebted,
10:03he takes a loan later.
10:05So the state of not being indebted
10:07is the real for us,
10:09and the one who is indebted
10:11is against the real.
10:13Now if a person claims
10:15that he has taken a loan
10:17and I am saying that
10:19I have not taken a loan,
10:21that is, I am claiming to be
10:23not indebted,
10:25and this is the real.
10:27The claimant is against the real,
10:29it is necessary to bring a witness
10:31on it, so he will be told
10:33to bring a witness on it.
10:35If he brings it,
10:37then I will have to give it.
10:39And if he cannot bring it,
10:41then I will be told
10:43to swear and deny it.
10:45So it is necessary to bring a witness
10:47on the claimant and
10:49to swear on the claimant.
10:51Now look at Hadith no. 2514
10:53It is narrated from
10:55Hazrat Ibn Abbas
10:57that
10:59he asked
11:01two women
11:03about their
11:05case,
11:07he asked
11:09two women
11:11about their case,
11:13they replied
11:15that the Prophet
11:17had decided that
11:19the oath is on the claimant.
11:21i.e. there were issues
11:23between the two women
11:25so he said
11:27that first decide that
11:29there is a claimant,
11:31there is a claimant,
11:33then the oath is on the claimant.
11:35Let's come to the next Hadith
11:37Hadith no. 2515
11:39and
11:41Hadith no. 2516
11:43Both of these Hadiths are
11:45in one place.
11:49In this Hadith
11:51Hazrat Abdullah
11:53is the narrator.
11:55He says that
11:57if a person swears
11:59on a claimant
12:01and he is
12:03a liar,
12:05then he will meet Allah
12:07in such a state
12:09For example,
12:11if someone swears on a glass
12:13and people say that
12:15this is our glass,
12:17he can swear on it
12:19and the judge decides
12:21that this glass should be given to him
12:23then he swears falsely
12:25that he took the wealth in his possession.
12:27Our brothers and sisters should learn from this
12:29that in the matter of properties,
12:31in the matter of inheritance,
12:33if a person dies,
12:35he swears falsely
12:37that he took so much of our property
12:39that he swears falsely
12:41and takes the wealth.
12:43He should listen to this carefully.
12:45Hazrat Abdullah
12:47said that if a person
12:49swears on something
12:51that he deserves the wealth
12:53and he is a liar in this oath,
12:55then he will meet Allah
12:57in such a state that
12:59Allah will be angry with him.
13:01Then he says that
13:03Allah has confirmed this.
13:05This is the statement of the Prophet.
13:07Then Allah revealed this verse
13:09in its confirmation.
13:11Its translation is
13:13Those who buy a little
13:15in exchange for the promise of Allah
13:17and their oaths,
13:19for them there is no share in the Hereafter
13:21and Allah will not speak to them
13:23in the Hereafter
13:25and on the Day of Resurrection
13:27He will not show mercy to them
13:29and He will not purify them
13:31and for such people
13:33there is a painful punishment.
13:35This is the verse number 77
13:37of Aal-e-Imran.
13:39Then Hazrat Ash'af bin Qais
13:41came to us
13:43and asked what Abu Abdur Rahman
13:45had said to you.
13:47So we told him
13:49and he said that
13:51Hazrat Ibn Masood
13:53has said the truth.
13:55No doubt this verse is about me.
13:57There was a dispute
13:59between me and a person in a well.
14:01We both
14:03went to the Prophet
14:05and he said
14:07You bring a witness
14:09He said
14:11You bring a witness
14:13or else the opponent
14:15will take an oath.
14:17I said O Prophet,
14:19he will take a false oath
14:21because he was a well known
14:23carefree person
14:25and no one will care about him.
14:27Then the Prophet said
14:29The one who deserves wealth
14:31and he is a liar
14:33he will meet Allah
14:35in such a state that
14:37Allah will be angry with him.
14:39Then Allah revealed this verse
14:41to confirm this.
14:43I told you that
14:45those who take an oath
14:47will be punished.
14:49Then Allah revealed the whole verse.
14:51The last hadith
14:53of Kitab-ul-Rahan
14:55will start with Kitab-ul-Itq.
14:57I told you as a warning
14:59that our brothers and sisters
15:01feel bad when their bad deeds
15:03are exposed.
15:05Especially those men
15:07whose families know everything
15:09or an elderly person
15:11has done something like this.
15:13When our words reach them
15:15the elderly person or husband
15:17feel arrested.
15:19The family members question
15:21that you have taken
15:23the oath by lying.
15:25Sometimes
15:27some people
15:29get some guidance
15:31and say that we did not do it right.
15:33We repent in the presence of Allah.
15:35Some people
15:37are stubborn.
15:39They say that what we did was right.
15:41These are the people
15:43who may have less share
15:45in the hereafter.
15:47Or God forbid
15:49if they try to
15:51violate the law
15:53or violate the law
15:55then they may
15:57lose their faith.
15:59Therefore, all our brothers and sisters
16:01who are listening to our Dars,
16:03thank Allah
16:05that Allah
16:07has given you the opportunity
16:09to learn the knowledge of religion.
16:11If you have any doubt
16:13that you have taken
16:15someone's property
16:17by lying
16:19even if it is
16:21on the footpath
16:23you have to beg
16:25otherwise nothing will happen
16:27in the hereafter.
16:29Once you die
16:31all your luxuries and comforts are gone.
16:33An elderly person
16:35said something very beautiful
16:37that he is lucky
16:39that he himself dies
16:41but his good deeds remain alive.
16:43He is unfortunate that he himself dies
16:45but his sins remain alive.
16:47If he gives his children,
16:49he should give his property back.
16:51This is the end of our Dars.
16:53All praise is due to Allah, Lord of the worlds.
