02:25The same four hadiths have been brought under different titles.
02:30Sometimes the narrators change a little.
02:33This is called repetition in a hadith.
02:36That is, to bring the same hadith again and again.
02:39And Imam Bukhari, you know that when he brings the hadith repeatedly,
02:44then sometimes his gaze falls on the first hadith,
02:47then he deduces one issue from it.
02:49Under that, he sets the same title and mentions the hadith.
02:53Then he takes the second issue.
02:55He sets the same title and mentions the same hadith in another place.
02:59Therefore, we read it for blessings.
03:01If we have to comment on it, we also comment on it.
03:04There is no problem in listening.
03:06When you take out a time and sit in front of it,
03:09then the mercy of Allah will descend on you.
03:11Inshallah, blessings will be at home.
03:13And Allah will bless you with the light of the hadith.
03:20Now the section is
03:28What conditions are permissible in making an appointment?
03:31And who has put such a condition that is not in the Book of Allah?
03:35There is a hadith under it.
03:37It is narrated by Sayyidah Aisha Siddiqa, may Allah be pleased with her.
03:42She informs that Hazrat Barira, may Allah be pleased with her,
03:46came to her to ask for help in exchange of an appointment.
03:52The exchange of an appointment means that the slave is told to earn money.
03:57Whatever money he will give is called the exchange of an appointment.
04:02So she came to ask for help.
04:05And she did not pay anything from her exchange of an appointment.
04:11Sayyidah Aisha Siddiqa, may Allah be pleased with her,
04:14that you go to your owners.
04:16If they like it, then I do it in such a way that
04:19I pay you an amount in exchange of an appointment.
04:23Their owner was a Jew.
04:25And he said in the installment that you give little by little.
04:29But Sayyidah Aisha Siddiqa, may Allah be pleased with her,
04:32offered a great offer.
04:33Leave this installment.
04:34I will pay you an amount in exchange of an appointment.
04:38I will give them.
04:39And your Wala will be for me.
04:41I have explained to you that if we release a slave,
04:45he collects money from him.
04:47Then he is transferred.
04:49And he has no heir.
04:51So whatever money he has left is called Wala.
04:54And this is given to the master who releases him.
04:57So Sayyidah Aisha Siddiqa said this.
04:59As in the previous narration, I will give you a certain amount.
05:02Then she will become their slave.
05:04Then Sayyidah Aisha Siddiqa said, I will release you.
05:07And your Wala will be for me.
05:09So when Sayyidah Aisha Siddiqa, may Allah be pleased with her,
05:12will release him, then he will deserve Wala.
05:16This is what she said to him.
05:17So Hazrat Bareera mentioned this proposal to his owners.
05:21So they refused it.
05:24And said that if they do this good deed and want to be kind to you,
05:28then do it.
05:29But your Wala will be for us.
05:32Hazrat Aisha Siddiqa, may Allah be pleased with her,
05:34mentioned it to the Prophet, may Allah be pleased with him.
05:38So the Prophet said, Aisha, buy Bareera and release him.
05:43Wala is only for the one who releases.
05:47That is, you make a deal, they will not get anything.
05:50Then the Prophet stood up and said,
05:53what is the condition of those who put such conditions
05:56which are not in the book of Allah.
05:59The one who has put such conditions which are not in the book of Allah,
06:02then that condition will not be for him.
06:04Even if he puts such a hundred conditions.
06:07It is more worthy and stronger to fulfill the conditions of Allah.
06:14That is, the conditions set by Allah are those.
06:17Now here some scholars have also taken this issue
06:20that the mercy of the two worlds, the Prophet said at one place,
06:23that do not add the condition and the condition.
06:27That is, if you are selling something, then do not put a condition in it.
06:31And the scholars then, in terms of the change of times,
06:34added it in such a way that only those conditions can be put
06:38which have become very common in our society.
06:42With the merchants, in the markets.
06:45That too with the permission of the scholars.
06:47It is not that everyone will make their own conditions and keep doing it.
06:50Will take permission from the scholars.
06:52Or if that condition has become common in a special way,
06:54then it will be allowed.
06:56One is, this hadith, the Qur'an,
06:59this verse, this hadith is also called Nas.
07:02Nas is the word that clearly expresses its meaning.
07:06It is known what the speaker is trying to say.
07:09That is Nas.
07:10So the hadith is also Nas.
07:12Remember that from our side,
07:14it is not permissible to change the hadith.
07:17Changing the hadith means that we take a verse of the Qur'an or hadith
07:20and finish the command in it forever.
07:23And finish it from the whole world,
07:25that now this command will not work.
07:27We cannot do this.
07:28Neither can we copy the Qur'an,
07:30nor can we do the command of the hadith.
07:32Now, it is necessary that in this way,
07:34according to the change of times,
07:36the scholars make the distinction of Nas.
07:38What does the distinction of Nas mean?
07:40It means that the command in the Qur'an or hadith,
07:43that command is for the individuals,
07:45to exclude one or two of them.
07:47That now it will be for all of them,
07:49not for these two.
07:50Since we have excluded two,
07:52made it special,
07:54and to make it special is called distinction,
07:57that we have made it special in this Nas,
08:00that is, we have excluded some people.
08:02Now, all the conditions in the world,
08:04that is, buy and sell,
08:06with whom you make a condition,
08:08understand that this is one person,
08:10this is the second person,
08:11this is the third,
08:12this is the fourth,
08:13this is the fifth.
08:14And the government has said,
08:15do not combine buy and sell,
08:16it means that all these conditions,
08:18which are with the conditions,
08:19have become unlawful.
08:20But we have excluded some of them,
08:22who are available in the market,
08:23that is why we have excluded them.
08:26This is called distinction.
08:27We have not excluded everyone else,
08:28they will remain in their place.
08:30So, for example,
08:31the warranty,
08:32you must have seen that,
08:33when you buy an electronic item,
08:35you say,
08:36how long is the warranty?
08:37He says,
08:38one year.
08:39He gives it in writing,
08:40he gives you a paper,
08:41and it means that,
08:42if there is a failure in one year,
08:44then they will replace it,
08:46or maintenance will be their responsibility.
08:48Now you are making a condition,
08:49that I buy,
08:50on the condition that,
08:51for one year,
08:52you will be responsible for its failure,
08:54you will be responsible,
08:55for its maintenance,
08:56for its failure,
08:57you will be responsible.
08:58But since this condition,
08:59is prevalent in our market,
09:01that is why the jurists,
09:02have allowed it.
09:03Please have mercy.
09:04Now,
09:05look here,
09:06here too,
09:07a condition was made.
09:08The mercy of the Prophet,
09:09peace and blessings of Allah be upon him,
09:11gave its answer,
09:12in a better way,
09:13that you buy,
09:14and this condition,
09:15means that,
09:16this condition,
09:17is not real.
09:18This is that,
09:19which the Shariah,
09:20has already proved.
09:21Therefore,
09:22Syed Ayesha Siddiqa,
09:23peace and blessings of Allah be upon her,
09:24said that,
09:25what you said,
09:26that I buy you,
09:27on the condition that,
09:28you will be responsible for it,
09:29this is not a real condition.
09:30This will be proven,
09:31by itself,
09:32according to the religion.
09:33Therefore,
09:34you can remove this,
09:35this will be a bai,
09:36you can do it.
09:37This is exactly like,
09:38if I buy a mobile phone,
09:39and I say to the shopkeeper,
09:40look I buy it,
09:41but the condition will be,
09:42that I will use it.
09:43So,
09:44it is a must,
09:45that this is,
09:46the result of bai,
09:47that my money,
09:48will be used,
09:49and I will buy it.
09:50Now,
09:51the condition is,
09:52that my money,
09:53will be used,
09:54and I am buying it,
09:55if I use it,
09:56then I am buying it.
09:57So,
09:58if I use the word,
09:59condition with it,
10:00will it become a condition?
10:01The condition,
10:02that which the Prophet,
10:03has forbidden,
10:04that do not use bai and condition.
10:05This is certainly not the case.
10:06This condition is also like this.
10:07If Syed Ayesha Siddiqa,
10:08peace and blessings of Allah be upon her,
10:09had not mentioned this,
10:10as a condition,
10:11it was understood,
10:12that if you had bought it,
10:13and released it,
10:14it would have been for you.
10:15Just understand this,
10:16that this bai and condition,
10:17was not to be used.
10:18Already,
10:19for Syed Ayesha Siddiqa,
10:20this condition,
10:21is proving to be,
10:22a condition.
10:23The next section is,
10:24bai'ul muqatabi,
10:25idha radhiya.
10:26When the recipient,
10:27is satisfied,
10:28then it is the section,
10:29to sell it.
10:30It is 2564.

11:10that Syed Ayesha Siddiqa,
