00:25Iqtaba fir zikar karte hain, Hazrat-e-Urwa bayan karte hain

00:30ki unhone Hazrat-e-Ayesha Siddiqa radhiya Allah-u-taala anha se is ayat-e-mutaalik suwal kia.

00:37Ayat yeh thi, aur agar tumhe yeh andesha ho ki tum yateem ladkiyon mein insaaf na kar sakoge

00:44to tumhe jo aurtein pasand hon se nikah karo 2-2 se 3-3 se 4-4 se.

00:51Yeh surah-e-nisa ki ayat number 3 hai.

00:54To unhone poocha ki yeh kya muaamla hai ki agar yateem ladki se insaaf na kar sako

01:35Yeh Bukhari mein hi riwayat guzar gayi, aap khud apne baare mein taahdis-e-nimat ke taur pe kehti hai

01:40ke jab tak mujhe koi baat samajh mein nahi aati thi,

01:43mein Nabi-e-Karim Sallallahu-Alaihi-Wa-Sallam se sual kiya karti thi,

01:47hatta ke muamala waazih ho jata.

01:50To jab is aayat ke tafseer malum ki gayi, to aapne firmaaya ki

01:53Ae mere bhanje, yeh aayat us yateem ladki ke baare mein naazil hui hai,

01:59jo apne wali ke zere parwarish ho.

02:03Yani aisi ladki ke jo aise kisi sarparast ke matahat aa gayi ho,

02:09ke jo usse nikah bhi kar sakta ho.

02:11Jaise misal ke taur pe, walid waghara ke intiqal hogiya walidein ka,

02:15to chacha ke bete ki kafalat mein woh bachi aa gayi,

02:18aur woh usko paal raha hai,

02:20to ab woh hai yateema bachi,

02:21aur yateema aapke pehle bataya tha,

02:23ke us naabalik ko kehte hain, jiska walid fauth ho jaye.

02:26Balik hone ke baad, yateem ka tasawur nahi hota.

02:29Hamare yaan to jab koi balik ke walidein fauth ho jaate hain,

02:32to kehte hain ke aaj hum yateem ho gaye.

02:34To yateem sirf naabalik ko kehte hain, balik ko nahi.

02:37Doosri baat hi hai ke ab jaise chacha ka beta,

02:40apne taya ki, ya doosre chacha ki beti ki kafalat kar raha hai,

02:45to yeh isse nikah kar sakta hai.

02:47Agar bachi bhi isse raazi ho, to usse nikah kar sakta hai.

02:50Ab woh yateema bachi se iske nikah karne ka kya hukum tha,

02:53uski wazaahat aapne bayan farmahi.

02:55Ke iss yateem ladki ke baare mein naazul hui hai,

02:58jo apne wali ke zire parwarish ho,

03:00aur tarke mein uski sharik ho.

03:03Jaise misal ke taur pe, dada ka tarkat milega,

03:06to iss bachi ko bhi milega,

03:08jaise walid hai, iske phir bachi ko,

03:10aur doosra beta hai, uska yeh chacha ka,

03:13yeh jo beta hai ladka, yeh chacha ka beta hai,

03:15to yeh dono kisi tarke ke andar sharik ho rahe hoon,

03:19uska maal aur uska husn iss wali ko pasand ho,

03:23woh se shadi karna chata ho,

03:25magar usko raawaaj aur dastoor ke mutaabik,

03:28mahar na dena chata ho,

03:30aur usko itna mahar na dena chata ho,

03:33jitna mahar usko doosre den.

03:35To aise wali ko us yateem ladki se nikah karne se,

03:39mana kar diya gaya,

03:41yaani yeh khayanat ke yeh ladki pasand hai,

03:43kyuki zaman-e-jahliyat mein aisa hota tha,

03:45jo kafalat mein ladkiye hoti hain,

03:47agar husanseen hoti hain,

03:49to woh usko apne aqd mein leke mahar dabha leta tha,

03:52aur agar aisi nahi hoti,

03:54khufsura jisse woh khud nikah kare,

03:56to phir usko nikah hi nahi karne deta tha,

03:58apne paas muqayyad rakta tha,

04:00takiski warasat mein mujhe hisa mil jaye.

04:02mazhab-e-islam ne iss zulm se bachiyon ko najat dilwai,

04:06to aap firmati hain,

04:08ke woh iss se shadi karna chata ho,

04:10magar usko rawaaj aur rastoor ke mutaabik mahar na dena chata ho,

04:13aur usko itna mahar na dena chata ho,

04:15jitna mahar usko doosre den,

04:17to aise wali ko us yateem ladki se nikah karne se,

04:21mana kar diya gaya,

04:23sewa iss surat ke,

04:24ke woh inke saath adal se kaam le,

04:26aur iss yateem ladki ke wali,

04:28usko rawaaj ke mutaabik umda mahar den,

04:31phir kar sakte hain,

04:33aur iss yateem ladki ke sarparaston ko yeh hukam diya gaya,

04:36ke iss yateem ladki ke sewa,

04:38aur auraton se nikah kar le,

04:40jo inko pasand ho,

04:42yehni muraad wahi hai,

04:43ke agar yeh adal-e-insaaf kaim na kar sakein,

04:46to phir aise yateem bachi se na karein,

04:48nikah ke agar nikah kar lenge,

04:50aur sirf mahar ke liye to mahar dabha lete hain,

04:53aur agar nikah na karein,

04:54to uske shadi nahi hone dete,

04:56taaki doosre iska mahar na le jayein,

04:58to yeh bilkul na-insafi wali baat thi,

05:00haan jab agar iss tarah ka zulm ke koi surat na ho,

05:02to bilkul ijazat hai,

05:04iske baad urwa ne bayan kiya,

05:06ke hazrat-e-ayesha-siddiqa radhiya Allah-u-taala,

05:08anha ne farmaya,

05:09phir iss ayat ke nuzul ke baad,

05:11logon ne Rasool-Allah-i-Sallalahu-wa-sallam se sual kiya,

05:14to Allah-u-taala ne yeh ayat nazil farmai,

05:17aur musalmaan aap se,

05:19auraton ke mutaalik hukam malum karte hain,

05:22aap kahiye ke Allah tumhe,

05:24auraton ke mutaalik wahi,

05:26pehle wala hukam deta hai,

05:28aur wo ahkaam bhi,

05:30jo tum par in yateem ladkiyon ke mutaalik,

05:32padhe jaa rahe hain,

05:34jin ka wo haq tum,

05:36unhe nahi dete,

05:38jo unke liye fars kiya gaya hai,

05:40aur tum unse nikah karne ke raghbat rakte ho,

05:42aur kamzor bachon ke mutaalik,

05:44bhi tumhe hukam deta hai,

05:46aur yeh ke yateemon ke saath,

05:48insaaf par qaim raho,

05:50aur tum jo bhi nek kaam karte ho,

05:52to beshak Allah ko,

05:54iska ilm hai,

05:56pehle surah nisa ke aayat number 127,

05:58phir yeh poori naazil hui,

06:00aur jis ka Allah ne zikr kiya hai,

06:02jis ke tum par tilawat ki jaati hai,

06:04yeh wo pehli aayat hai,

06:06jis mein Allah ta'ala ne farmaya hai,

06:08aur agar tumhe yeh andesha ho,

06:10ke tum yateem ladkiyon me insaaf na kar sakoge,

06:12to tumhe jo auratein pasand hun,

06:14unse nikah karo,

06:16do do se, teen teen se aur,

06:18chaar chaar se,

06:20to isse dekhe andaza hua,

06:22pehle surah nisa ke aayat number 3 naazil hui,

06:24to quran e paak,

06:26baduq aayat e,

06:28ek hisa doosre hisi ki tafseer beyan kar raha hota hai,

06:30Sidh Ayesha ne farmaya,

06:32aur Allah ta'ala ka irshaad,

06:34jo doosri aayat me hai,

06:36wo ke aayat hai,

06:38aur tum inse nikah ki raghbat rakte ho,

06:40aayat number 127,

06:42jo yateem ladki tumhare zire parwarish ho,

06:44aur iska maal aur husn kam ho,

06:46isse tum nafrat karte ho,

06:48to unko isse mana kiya gaya,

06:50ke jis yateem ladkiyon ke maal aur husn me tumhare raghbat hai,

06:52inse bighair insaaf ke nikah karo,

06:54to malum ye hua ke,

06:56ye jo aayat naazil hui,

06:58ke yateem bachiyon ke saath,

07:00agar tum insaaf kar sako to theek,

07:02warna phir aazaad auraton se,

07:04alayada auraton se nikah karo,

07:06to zamane jahiliyat me yi hota tha,

07:08ke agar kisi bachi kisi ke kafalat me aati,

07:10aur wali usse nikah kar sakta ho,

07:12to agar haseen aur jameel hoti,

07:14pasand aata to nikah kar leta,

07:16ab wo kahin aur jaani sakti thi,

07:18aur iska maharuah kar sakta ho,

07:20ab wo kahin aur jaani sakti thi,

07:22aur iska maharuah kar daba leta,

07:24aur agar kam husn wali hoti to,

07:26unhi chahata tha ki kisi aur se iska nikah ho,

07:28warna sari warasat wala chali jaayegi,

07:30to phir usko apne paas muqayyad rakha karta tha,

07:32to isliye,

07:34iss se ek nateeja yeh nikla,

07:36jo humare maatahat log hain,

07:38hume ghor karna chahiye,

07:40aisa to nahi ke hum unke saath,

07:42naa insaafi wala muaamla kar rahe ho,

07:44aur unhe unke buniyadi hukook se rok rahe ho,

07:46ab ye to yateem bachi ka muaamla hai,

07:48lekin issi se zimnan hum yeh nateeja nikal sakte hain,

07:50ki jaise humare ahkaam-e-shariat programme me bhi yeh questions hua,

07:52ke baaz afraad,

07:54apne hi bachon ka nikah,

07:56aisi jagah kar diya jaata hai,

07:58ki jo unse,

08:00jani,

08:02rishta mein jod nahi hota,

08:04ek jaise nahi hote hain,

08:06bachi bohot padhi likhi,

08:08kisi jahil ladka se nikah kar diya,

08:10ya jahil,

08:12bacha bohot achha khusurat padha likha hai,

08:14aur aisi hi kisi jahila bachi se nikah kar diya gaya,

08:16sirf iss lalach ke tahad ke paisa milayega,

08:18to iss yahi lalach,

08:20dekhein yaha kar farma hai,

08:22ke paise ke lalach ki bina par,

08:24yateem bachi par zulm,

08:26aur aaj aazad hazarat bhi aise hi kar dete hain,

08:28yeh to main maabab ki misal deraun,

08:30ki bahose aise bhi hain,

08:32jo apne bachon ka nikah,

08:34sirf paise ke lalach mein,

08:36ghalat maqamat par kar dete hain,

08:38bachay cheekhte rahen,

08:40chillate rahen,

08:42kehna nahi maante,

08:44yeh to zamane jahiliyat ke baad thi,

08:46muslim maashre mein ho raha hai,

08:48ki agar koi bachi kafalat mein a jaati hai,

08:50jaisi saghe bhai ka intiqal hogi,

08:52accident mein mar gaye bhai bhabhi,

08:54to unke bachon ki kafalat kar li,

08:56to un bachon ka koi pursane haal nahi hota,

08:58ek to ghar mein sara kaam wohi karenge,

09:00jhaade pocha,

09:02unke apne bachay bethe unge,

09:04inse kaam karwaya jaayega,

09:06aur thodi thodi baaton par marna,

09:08daatna, dapatna, jhadakna,

09:10taane dena, ke tuare maabab mar gaye,

09:12kambakht aur yeh aur woh,

09:14maabab ko bura kehna,

09:16disheart karna bahut zyada,

09:18aur phir apni bachi ke liye,

09:20to pachaz rishte dekhna,

09:22aur in bachon ke liye,

09:24bas jaisa bhi mil gaya,

09:26koi do bachon ka baap bhi bazukat mil gaya,

09:28to kaha shohar se bhi isko ghar se bhar nikalo,

09:30bas theek hai, aise rishta,

09:32taaki hamari bachi ke hampalla na ho jaye,

09:34yeh thodi dab kar hi rahe,

09:36aise nainsaafi wale muaamlaat,

09:38bahut zyada hamare maashre mein ho raha hai,

09:40shirkati fil ardina wa ghairiha,

09:42zameeno wa ghaira mein shirkat ka hukum,

09:46hadith number hai 2495,

09:50aur hadrat-e-jabir-bin-abdullah radhi-allahu ta'ala anhu,

09:52iske raabi hai,

09:54kehte hai ki nabi-e-karim sallallahu-alaihi-wa-sallam ne,

09:56har ghair munqasib maal mein shufaa ko lazim kar diya,

10:00pas jab hudood mutaayyan ho jayein,

10:02aur raste mukarrar kar diya jayein,

10:04to phir koi shufaa nahi hoga,

10:06agli hadith bhi liye lete hain,

10:08agli hadith bhi liye lete hain,

10:10wo isi se mutalik hai,

10:12babun iza qatasama shuraka-ud-dua,

10:14duara, au ghairaha,

10:16falaisa lahum ruju'un wala shufaa,

10:18yaani jab shuraka apne gharon,

10:20waghara ko takseem kar lein,

10:22to ab wo ruju kar sakte hain,

10:24na shufaa kar sakte hain,

10:26hadith number 2496,

10:28hadrat-e-jabir-bin-abdullah iske raabi hai,

10:30ki nabi-e-karim sallallahu-alaihi-wa-sallam ne,

10:32har ghair munqasib maal mein,

10:34shufaa ka faisla farmaya,

10:36pas jab hudood mutayyan ho jayein,

10:38aur raste muqarar ho jayein,

10:40to phir koi shufaa nahi hoga,

10:42yeh pehle bhi hadith guzar gayi,

10:44iska matlab yeh hai,

10:46pehle samajh lein ki agar mere paas ek makaan hai,

10:48main usko beshna chahta hun,

10:50to mere padosi ko zyada haq hai,

10:52ki wo us makaan ko kharidein,

10:54kyunki naye aadmi aayega bahar se,

10:56to phir yeh pure mahalle wale,

10:58baad oqaat,

11:00ek doosre ke aadi ho chuke hote hain,

11:02doosra aadmi aata hai,

11:04aur pura mahalle uski wajah se parashaan ho jata hai,

11:06aur bhi kayi masayil,

11:08jiski bina peh shariyat ne padosi ko haq diya,

11:10liyaad agar main apne makaan farz ka lein,

11:1280 lakh ka beshna chahta hun,

11:14to pehle mujhe padosi ko offer karni hogi,

11:16ki aap kharid rahe hain,

11:18agar wo kharidein theek,

11:20warna phir main usko besh sakta hun,

11:22aur yaar jisse wakala kehte hain,

11:24ki aap akhbaar mein ishtihar de den,

11:26ki main yeh makaan beshna chahta hun,

11:28kisi ko koi haq waghara hai,

11:30to ishtihar ke baad phir,

11:32to ishtihar ke baad phir,

11:34to ishtihar ke baad phir,

13:05Pehle shufaa ke Baab meinh kaafi tafseel beyaani hu jaahegi ye.

13:09Agli Baab ki taraf hatayen

13:11baab ul-ishtiraqi fi zdahabi wal-fiddat wa ma yakoono feehi minas-sarf

13:15Soonay, Chanday aur un-tamam cheezoon men sharkat

13:20jummain baay-e-sarf hoti hain.

13:23Baay-e-sarf pehle sumajh lijiye

13:25means to sell the goods in exchange for the goods.

13:29Saman is the currency or the value of something.

13:35So, when it is sold, it is called the book of goods.

13:40Now, consider that the thing which the Prophet

13:45called Saman, for example, a book will be called Mabi

13:49and in return, the money that I will give will be called Saman.

13:53In the era of the Prophet, the Saman that was determined

13:57was gold and silver.

13:59They used to buy and sell through Darahim and Dananeer.

14:03Dirham is called the coins of silver.

14:06And Dinar is called the coins of gold.

14:09And then there used to be Daliya of gold and silver.

14:12Things were bought and sold from them.

14:14So, the Prophet said that this is Saman.

14:17Now, because the Prophet of Allah first called it Saman,

14:20it is called Saman-e-Khalqi.

14:22It is Saman by birth.

14:24So, all the exchanges that are of gold and silver,

14:28gold and silver, gold and silver here and gold and silver there,

14:32it is called the exchange of gold and silver.

14:34And apart from this gold and silver,

14:36for example, we have notes, coins, copper and brass,

14:40or some other currency, dollar, pound.

14:42The Prophet did not call it Saman, it was invented later.

14:46This is called Saman-e-Istilahi.

14:49Although the exchange of Saman-e-Khalqi is called Kitab-e-Sarf.

14:54But when a new currency was made,

14:56the rules of this currency, wherever they are stated,

14:59they are stated in Kitab-e-Sarf.

15:01The difference is, as I told you before,

15:04if you are buying and selling gold with gold,

15:07then the Prophet of Allah, with two conditions,

15:10allowed this buying and selling.

15:13If one of these two is not there, it will become interest,

15:16and this will be wrong.

15:17What are those two conditions?

15:19The first is that the amount of gold that is here,

15:23the same amount of gold should be here.

15:25Exactly equal.

15:26Two tolas here, two tolas here.

15:28And there should be a credit, not a loan.

15:32Therefore, if you are buying gold through gold,

15:36and if there is even a little bit of interest in the body,

15:41then remember that this will become interest.

15:43Or if you give one now and you say,

15:45give your gold later,

15:47this loan will also create interest in a moral sense,

15:50and both situations are haram.

15:52If there is such a silver, then this is the order.

15:55Yes, if it changes, if the two sexes become separate,

15:58I am buying gold from you in exchange for silver,

16:02then this is also Sarf.

16:04But since the sex has now changed,

16:06it is separate,

16:07then there is only one condition for this to be correct,

16:09and that is that there should be a credit.

16:11There cannot be a loan.

16:12There can be a decrease in weight.

16:14Ten kilos of silver, five kilos of gold,

16:17fine, it will work because they are not the same sex.

16:20So, this means that gold in exchange for gold,

16:23or silver in exchange for silver,

16:25because they are the same sex,

16:27therefore, the weight of both should be equal.

16:29And if there is a credit, then it will be the same.

16:31Otherwise, interest will be required.

16:33So, now what happens in our country,

16:36like the old gold is good,

16:38the new gold is less,

16:39then they say,

16:40I will give you two kilos of old gold,

16:42and you give me three kilos of new gold.

16:44This is an interest,

16:45it is haram,

16:46it is a sin.

16:47In the same way,

16:48there is no trust in the manufacture of gold.

16:50For example,

16:51I have a bundle of five kilos of gold.

16:54So, you say,

16:55I have made jewelry of three kilos of gold,

16:57it is very beautiful.

16:58I give you jewelry of three kilos of gold,

17:00you give me a bundle of five kilos of gold.

17:02So, this deal will also be illegal.

17:04Remember,

17:05New,

17:06old,

17:07made or not made,

17:08there is no trust in it.

17:10Whenever there is gold on one side and gold on the other,

17:13then the deal will be legal with two conditions.

17:15One,

17:16the weight should be equal,

17:17and the other,

17:18there should be a credit.

17:19We will explain this further in the next program.

17:21And finally,
