The KL High Court on Monday (Jan 13) dismissed a judicial review application by Tun Dr Mahathir Mohamad for him and his lawyer to be present during the Royal Commission of Inquiry (RCI) proceedings regarding the handling of the Batu Puteh, Middle Rocks, and South Ledge sovereignty issues.

Judge Datuk Amarjeet Singh dismissed the application without costs at a proceeding attended by lawyers Zainur Zakaria and Muhammad Rafique Rashid Ali, representing Dr Mahathir, and senior federal counsel Shamsul Bolhassan and Nur Hafizza Azizan, appearing for the respondents.

00:00Assalamu'alaikum warahmatullahi wabarakatuh.
00:01Today is the decision
00:05for the RCI challenge
00:08that was made by Tun Dr Mahathir
00:10regarding the RCI Pulau Batu Putih.
00:12As everyone is aware,
00:14on the last day, the court has allowed
00:17to pass the judgment,
00:19leave or just the truth on one issue,
00:22which is section 18.
00:23Section 18 of the RCI Act 1950
00:26states clearly,
00:27all individuals who are affected
00:29or become the subject matter
00:31of an RCI
00:33must be allowed,
00:35must be allowed to present
00:37through the judge or himself
00:39to the entire RCI.
00:41So, when the court heard
00:43the substantive arguments
00:45on the last day,
00:46the court has determined
00:47for today's decision,
00:48we are present in the court,
00:50the court has refused to pass the judgment
00:53and the court did not give any reason,
00:55the court stated that
00:57the court will provide a written reason,
00:59the instruction from the judge is clear,
01:01we will appeal to the court
01:03and from time to time
01:05we will inform.
01:06We feel that
01:08this issue should not be
01:10an academic issue
01:11or has been resolved,
01:12because as all Malaysians know,
01:14this RCI issue
01:16has been brought to the parliament
01:18and clearly in the parliament,
01:20everyone can see and know
01:21and also hear clearly
01:23that the target of this RCI
01:25is none other than
01:26Tuan Dr Mahathir.
01:27Therefore, we feel that
01:29there is a need
01:30for us to appeal
01:31and God willing,
01:32in the near future,
01:33we will appeal.
01:35So today,
01:36on section 18,
01:38the court has stated
01:39there is no issue,
01:40the court has refused
01:41our request
01:42for the judgment,
01:44so we will go to the court
01:46to let the court
01:48decide the issue.
