Oct 28 decision on Dr M’s bid to nullify RCI proceedings

The Kuala Lumpur High Court on Wednesday (Sept 4) has fixed Oct 28 to decide on the judicial review application by Tun Dr Mahathir Mohamad to nullify the Royal Commission of Inquiry’s (RCI) proceedings on the handling of the Batu Puteh, Middle Rocks, and South Ledge sovereignty issues.

Judge Datuk Amarjeet Singh fixed the date after hearing arguments by the former premier’s lawyer Zainur Zakaria who was assisted by Muhammad Rafique Rashid Ali and senior federal counsel Shamsul Bolhassan who acted for the Attorney General’s Chamber.

00:00The Royal Commission of Inquiry examining issues surrounding the sovereignty of Batu Puteh, Middle Rocks and South Ledge
00:07has never made Tun Dr Mahathir Mohamad a subject matter in the inquiry, the Kuala Lumpur High Court heard on Wednesday.
00:14Senior Federal Counsel Shamsul Bolasan said that the RCI's terms of reference
00:20made no mention of Dr Mahathir as a subject matter in the investigation.
00:25SFC Shamsul also told the court that the matter has become academic as the inquiry was completed last month.
00:33The report on the inquiry was handed to the Young Dipertuan Agong in August,
00:37with the Parliament expected to debate the inquiry's findings.
00:40Dr Mahathir's lawyer Zainur Zakaria, however, submitted that the matter could not be seen as academic just yet
00:47because Section 18 of the Commission of Inquiry Act 1950 was a statutory requirement
00:54and non-compliance could nullify the proceedings.
00:57Justice Amarjeet Singh told parties that he needed time for deliberation and fixed October 28 for decision.
01:04On June 12, the same court dismissed Dr Mahathir's leave application for a judicial review in his bid
01:11to seek open proceedings for the RCI on Batu Puteh, Middle Rocks and South Ledge sovereignty issue.
