01:28Faiz Hamid, the involvement of the retired General Faiz Hamid came out, events related

02:23appointed as the Court Commander Peshawar, and General Nadeem was appointed as DGI, so
02:28the Prime Minister's Office did not approve it for three weeks, and then three weeks later

02:39And they said that this matter is being investigated separately, that is, this is an open FIR, and

02:52the ISPR said that the Supreme Court has given an order, in the case of Top City, to investigate

03:16Then on August 15th, another interesting information was given to us by the ISPR, it was written
03:21that in connection, in the same proceedings, there are three more retired officers, who
03:26are also in military custody, and they are still in custody, and now obviously their
03:31trial will also take place at the same time.

03:38Some sources are also claiming that maybe there are also officers of the Brigadier level,
03:43that maybe one or two of those officers had also become a promise maker.
03:47Earlier we used to hear that General Faiz Ameen Sahib is not becoming a promise maker,
03:51but now it is possible that there might be a third person who is a promise maker.
03:55This is important because, let me make one thing clear to you, many friends have messaged
04:01me asking me to find out, that what will be the violation of the Official Secrets Act,
04:07if according to the government and other sources, they were playing games with Khan Sahib,
04:13whatever, so Official Secrets.
04:15So I talked to some very senior people of the army, they told me that in our country,
04:22there is another very serious charge in the Official Secrets Act, that if you leave your office,
04:28especially if it is a sensitive office like DGI, if you have such files which you should not have,
04:35then it goes into the espionage account, in the heading, because those documents can be such
04:41that if someone else gets hold of it, then it can be a betrayal for the country as well.
04:46So, Official Secrets Act applies there as well, where you have the official documents,
04:52which were not there before.
04:53And I am pointing that out to you because you might remember that when General Bajwa was the Army Chief,
04:58at that time, two Brigadiers were sentenced to death, and one General, Lieutenant General Bin,
05:04was imprisoned for 14 years.
05:06He was imprisoned for 14 years because he was charged with meeting hostile agencies,
05:15but the thing in which he was imprisoned for 14 years, the biggest charge was that he had official documents,
05:21which he should not have had before.
05:23So, he was also punished under the Official Secrets Act.
05:26And if we talk about espionage, then we are also looking at the death penalty,
05:31which also goes to that extent.
05:34There is no word for mutiny, as we were saying, mutiny, mutiny,
05:37many people from the government were saying that it is very difficult to establish mutiny,
05:41but espionage at one level becomes easier under the Official Secrets Act.
05:46And according to what they have said, in today's press release of the ISPR,
05:52you should not underestimate the Official Secrets Act.
05:55This is a very, very serious charge.
05:57What was the process?
05:58The process is that there is a Court of Inquiry when a complaint is filed.
06:02After that, if there are initial findings that there is a lot of life in the case,
06:07then there is a Summary of Evidence.
06:09This is a sort of charge sheet.
06:11When the Summary of Evidence was given to Faiz Hamid Sahib,
06:14then there is the same system in it that the evidence is recorded in front of the accused
06:19and he is allowed to cross-question the witnesses.
06:23He also did that.
06:25After that, the findings of the legal branch of the Army are sent to the Court of Inquiry.
06:33If the Court of Inquiry feels that there is a lot of life in the case after the Summary of Evidence,
06:38then it goes to the JAG branch.
06:40When the JAG branch vets and says that there is a lot of life in the case,
06:44then the charge sheet is served.
06:46The minimum condition in that is that it should be done 24 hours in advance
06:50and you give it to the accused.
06:53After that, the trial will begin.
06:56After the trial, when the verdict reaches the court,
06:59and this trial will be done by a Major General and two Brigadiers.
07:02This will be done in the JSC.
07:03This will be done in some formation, 10th Corps, 5th Corps, whatever.
07:06They will decide, Army Chief or whatever their system is.
07:09There will be a trial.
07:11And Major General plus two Brigadiers will do this trial.
07:14If the verdict is guilty, then it goes back to the JAG branch.
07:19The JAG branch finalizes its opinion on it and sends it to the Army Chief.
07:23The Army Chief also has the right to either set aside the punishment
07:27or ratify it.
07:29If it is ratified, it will be implemented.
07:31If it is a big punishment and it is implemented,
07:33then the accused has a chance to go to the High Court or the Supreme Court.
07:38This is the process.
07:39When I spoke to people today, they told me that when a charge sheet is issued,
07:43the Army is usually given a maximum of one week to engage a lawyer.
07:47You can take an Army lawyer or a civilian lawyer.
07:50And after that, the trial will go on for a maximum of two to four weeks.
07:54So, if a charge sheet has been issued today,
07:56then if they also apply for one week,
07:58and then apply for four weeks,
08:00then we are seeing this in January.
08:02And I think the verdict will be given before January 21st or 20th.
