00:00Some party lists have already been nominated, but what is a party list, and what is their role in the country?
00:08That is what Professor Antonio Contreras will tell us in Punto de Vista, Professor.
00:17Thank you very much, Tayan, and good morning.
00:21The party list system was created by the 1987 Constitution.
00:27It is applicable only to the House of Representatives.
00:30Here, instead of candidates in the district, we vote for a party.
00:37What is a party list? Who are these people?
00:41Before 2013, the general perception of a party list is that it represents the so-called marginalized sectors.
00:50These are the sectors that are on the margins of society, usually the poor, like the workers, peasants, farmers, fishermen, urban poor, and farmers.
01:03But in 2013, the interpretation of the party list changed because the Supreme Court ruled that the party list system is not only reserved for the marginalized sectors.
01:15In fact, national parties and organizations, or regional parties or organizations, can also join and participate in party list elections.
01:25Even sectoral parties or organizations can also join, and they do not need to represent any marginalized or underrepresented sector.
01:36In fact, the Supreme Court added that an established political party can also join a party list election
01:45even though their requirement is that they should not run in a legislative district.
01:51And if they are going to run in a party list, they should also register as a candidate in the party list.
01:58And their party list wing, for example, ELP has a party list, will register separately and will consider a separate political party even though they are allies.
02:10These sectoral parties or organizations, according to the decision of the Supreme Court,
02:16can be marginalized or underrepresented.
02:19That is why what I said earlier is still included here, like the workers, farmers, fishermen, urban poor,
02:26farmers, and those who have relatives, veterans, or overseas Philippine workers.
02:33But it is also included here the sectors that do not have well-defined political constituencies,
02:39such as nurses, professionals, LPG operators, groups of engineers that can depend on their profession.
02:51It is also included here the women and the youth who were first seen as marginalized,
02:58but the court found that there are women who are not marginalized because they cut across social classes.
03:04So the party list system has expanded.
03:09Not only that, because many are wondering why this is not marginalized.
03:15In 2013, the Supreme Court changed its interpretation.
03:22So the party list system aims to expand the representation of all sectors in society.
03:29Although according to the Constitution, it should not exceed 20% of the total House of Representatives of its members.
03:37And the party will only have one seat if it gets at least 2% of all votes cast in the party list system.
03:45It should not exceed 3% of all votes cast in the party list system.
03:51Even if it exceeds 6% of all votes cast in the party list system, it will still have 3% of all votes cast in the party list system.
03:56So the formula of the party list system will be limited.
