00:00A secretary to the CEO of a government-linked company was driven to resign after her boss
00:08uttered several remarks that were tantamount to sexual harassment, the industrial court
00:12ruled.
00:13Court Chairman Salahuddin Hidayat Sharif allowed the secretary's constructive dismissal claim,
00:18citing the CEO's request for a massage as one example of harassment.
00:22Despite witnesses from Construction Labor Exchange Center Berhad claiming the CEO was
00:27joking, Salahuddin maintained it was harassment per the employee handbook.
00:31The CEO is also said to have asked his secretary to book a connecting hotel room or rooms next
00:36to each other during a trip, told her over lunch that she could strengthen her current
00:40position if she did a certain thing, and instructed her to sit next to him in his car.
00:45Salahuddin criticized the company's handling of the secretary's complaints, noting the
00:48investigation committee's lack of independence and failure to question her.
00:53The court found the company's investigation inadequate, obstructing justice for the secretary.
00:58The claimant was awarded R158,760, made up of R136,080 in back wages and R22,680 in compensation
01:08in lieu of reinstatement.
