00:00Talking about housing and rent is one of the most important issues that many families in the country are facing.
00:07And not only that, recently, the National Human Settlements Board issued a new resolution
00:13on the limitation of increasing rent for residential units.
00:18And to give us more information about this,
00:21let's listen to the Undersecretary of the Department of Human Settlements and Urban Development,
00:28Henry Yap, good morning and welcome to Rise and Shine Pilipinas.
00:32This is Prof Feeds together with Dianne, Rise and Shine.
00:37Good morning to all of you and Happy New Year.
00:40Happy New Year, Usec Yap.
00:41But I think this will also benefit our renters.
00:45Recently, the National Human Settlements Board issued a new resolution
00:50on the limitation of increasing rent for residential units.
00:55Tell us more about this, Usec Yap.
00:57What is the purpose of this and how will it help our fellow citizens?
01:03We would like to inform our residents that starting January this year,
01:08until December 31, 2025,
01:11the National Human Settlements Board issued a ceiling or cap on rent
01:18for those occupying units and are renewing this year.
01:23And they are paying P10,000 and below per month.
01:27The maximum that can be increased in rent is 2.3%.
01:32So if we use the example of P10,000, the maximum that can be increased is P230.
01:40If the rent is lower than P10,000, then that amount multiplied by 2.3%
01:47is our maximum cap this year.
01:51All right. Yes, you've mentioned about a 2.3% increase in rent for units, Usec,
01:57for monthly rent that is not more than P10,000.
02:00Could we have other details or give a detailed explanation
02:05on how the residents and tenants benefit from this?
02:10Okay. The purpose of our rental cap is to avoid an increase in rent.
02:18As we remember, in 2009, we passed the Rent Control Act of 2009
02:24where the law stipulates that the rent should not be increased.
02:30So they set a limit so that the increase of our landlords will not be abrupt and abusive.
02:37And since 2009, the rental cap has been implemented.
02:41But every year, our adjustments are different.
02:44Last year, between January 1 and December 31, our maximum cap was 4%.
02:51This year, it went down, which is beneficial to our landlords.
02:55It went down to 2.3%.
02:58All right. Usec, when you say residential unit,
03:02so that our countrymen can better understand,
03:06what is the cover of this? Are these apartments or dormitories?
03:11Can you expound on that, sir?
03:12So that our countrymen who are renting,
03:15when the rent goes up, it can go up, but it can also not go up.
03:19Yes.
03:20So that they are aware of this rental cap, Usec.
03:25Yes. It is defined in the law what is the cover of the Rent Control Act.
03:31So basically, what is covered here is a residential unit.
03:35But they define residential unit to include houses, apartments, and the like.
03:41But in addition to this, it is also allowed to have a cap for bed spacers, units, and rooms that are also occupied.
03:51So these are also covered by our rental cap.
03:55But I just like to mention that this rental cap only covers for those units that are currently occupied by the same tenant
04:03and they will renew their rent this year.
04:08So it is not for the new tenants.
04:12So it is important for us to know that only those that are renewing this year will be covered by the rental cap.
04:21All right. Usec, what are the mechanisms to ensure that the landlords are following the new rules?
04:30And what steps are being taken by the DSUD to protect the tenants from not being able to raise their rent?
04:40Okay. First, we are conducting this information and educational campaign to make sure that we understand
04:47what the Rent Control Act sets for the renters and landlords.
04:52Second, we are also coordinating with the Bureau of Local Government Finance, the barangay offices.
04:59Through the Department of Interior and Local Governments.
05:02Because if there are misunderstandings, the first thing they can do is to complain to our barangay captain and barangay judicial system.
05:14So if they have a complaint on exceeding the rental cap of 2.3%, they can go to the barangay and complain.
05:24The purpose of our barangay is to talk to the landlord so they can explain that this is based on the Republic Act 9653 or Rent Control Act so they can understand.
05:41In the worst scenario, if there is no agreement or the dispute cannot be settled,
05:48they can go to the court. Based on our law, those who violate the rent control can be fined P25,000 to a maximum of P15,000
06:02or imprisonment of one month and one day to six months maximum or both at the discretion of our courts.
06:11You mentioned earlier that the rent should be P10,000 below. That is the scope of this resolution.
06:19How can we provide protection for the high rent?
06:24If the rent is not below P10,000, the monthly rent is higher than P10,000.
06:31What about the new rent? Because you mentioned earlier that this will only apply for renewal of contract.
06:36What are the protections for them?
06:40Unfortunately, the Rent Control Act of 2000 sets the limit at P10,000.
06:46But what I like to mention is that most of our families are already paying within this range.
06:53Based on the statistics that we have available based on the 2023 FIES or Family Income and Expenditure Survey,
07:01about 5% of our families are actually renting.
07:06And of this number, 94.89 or almost 95% of our renters are actually paying P10,000 and below.
07:15So this is a great majority already of our people.
07:19Most of those who are renting now are only paying P10,000 and below.
07:25Alright, Usec, how do you see the effect of these government measures on the overall housing situation in the country?
07:33And how does this help in improving the lives of ordinary people?
07:38We also want to understand the effect of this on the tenants and the renters' side.
07:44What were their stories upon the execution of this?
07:49We want to know. Usec, go ahead.
07:52Yes, actually this has been a social protection cover for many of our low-income groups, including our middle-income groups.
08:02It is important that they are not subject to unwarranted increase of landlords.
08:08It is also important for our landlords to understand that this is not just because we want to implement it,
08:14but because we want to have a fair and equitable share for our low-income groups.
08:20So it is important to know that with this, we can stabilize our price increase.
08:27We can also control the unwarranted increase.
08:30And in the end, it will also rebound to better growth for the whole country.
