00:00That's where we'll begin with a new story today.
00:05And we begin with Major League Baseball, but not the league, this time it's the players,
00:10the MLBPA.
00:12The Players Association is suing DraftKings and FanDuel on Monday, accusing the sports
00:16betting companies and two others of using the names and likenesses of hundreds of players
00:23on their platform without asking for permission.
00:27So the Players Union is seeking compensatory and punitive damages from these companies,
00:33DraftKings, Britain's Bet365 group in Philadelphia court, and from FanDuel and Underdog Fantasy
00:42in a New York state court in Manhattan.
00:45So essentially what does it mean?
00:46Sports books and fantasy companies using name and likenesses of players without getting
00:50their permission.
00:52And so here is the statement from the Players Association.
00:55For professional athletes, the ability to control the commercial use of their names,
01:00images and likenesses is a crucial return on their substantial career investment.
01:09And whether or not you agree or disagree with the statement is sort of irrelevant.
01:13If they don't have permission to use the players, then they're going to have to either gain
01:18permission or pay some punitive damages here.
01:20I think MLBPA may have a case indeed in this matter.
01:25The Carolina Panthers made their case to change quarterbacks.
01:27It was a really easy one.
01:28Bryce Young has had a really tough time since being drafted by the Carolina Panthers, lowest
01:33rated quarterback in the National Football League.
01:35They keep losing games over and over again.
01:37I believe he's 2-16 in his last 18 games he has appeared.
01:42And so the Panthers have made their decision to go to none other than one of those ageless
01:47backup wonders in the National Football League.
01:50Yes, Andy Dalton is back as starting quarterback in the National Football League.
01:56It feels like he's been in the league 20 years.
01:58If I had to look it up, I would guess that's probably close to accurate.
02:02And he'll take over and he's got a tough test.
02:03They got to go play the Raiders this week on the road.
02:06Raiders played very well against the Baltimore Ravens.
02:09Head coach of the Panthers, Dave Canales, talks about the move to the Red Rifle.

02:14I'd love to see this thing just continue to take the next steps offensively right now.

02:35You know, after yesterday, just went home, watched the film, had some conversations with
02:40coaches, with Dan Brandt.
02:44So had to gather a lot of information through this morning and made that decision after
02:49looking at it that this is the best decision for our group, for our team going forward.
02:54Yeah, there's a lot of factors.
02:56We want to play more football.
02:58A lot of factors that go into it, you know, for this decision, you know, and ultimately
03:02just kind of lands on my shoulders to be able to make the best decision for our group to
03:08give us our chance, our best chance to win this week.
03:11And we focus on the weeks.
03:12We focus on the challenge at hand and we feel like Andy gives us our best chance to meet
03:16the challenge.
03:17I think that going from 12 hours, 24 hours later, I feel like we needed that SpongeBob
03:24meme in there also as well.
03:26And by the way, let's read between the lines here.
03:28Make no mistake about it.
03:30Dave Canales, probably not making that decision.
03:34General manager, owner, someone else stepping in, telling him to make the decision.
03:37Andy Dalton's back.
03:38Pick him up in fantasy, if you dare.
03:41Atlanta Falcons, another team against the spread as an underdog, winning the game outright.
03:47That's exactly what the NFL has been through two weeks of the season, folks.
03:50Make no mistake about it.
03:52If the last two weeks you bet all the underdogs, you could go out to a nice dinner tonight.
03:5622 to 21, Falcons beat the Eagles.
04:00Couple of things went wrong for the Eagles, dropped the ball late.
04:02Also didn't try and kick a field goal at one point when they had an easy one, didn't get
04:05a fourth down.
04:07Sort of some bizarre play calling to say the least, as certainly the Eagles right now are
04:13one of those teams that definitely need to pick up some pieces and the Atlanta Falcons
04:17are flying high.
04:18We wanted to, they were running a certain defense and junking it up in the middle.
04:25So we're trying to go on around the outside and, you know, it didn't work.
04:30What was your thought pattern there on going, kicking a field goal at one point?
04:34What did you think about going for it?
04:36You know, again, in that scenario, I was thinking they might not have any timeouts there, but
04:42obviously they did with the incomplete pass, you know, that would have came down to maybe
04:49a minute.
04:51And so we wanted to go up six points, you know, and it didn't work.
04:54So you know, the decision to pass it there, again, like I said, you know, where they were
05:01junking it up inside with it being fourth and three to go for it, I thought, you know,
05:06with them not having any timeouts, I wanted them to be down a touchdown and see if they
05:10could drive the field.
05:11And they did.
05:12So it was tough to them.
05:13Yeah.
05:14Bottom line.
05:15Another loss for the Philadelphia Eagles and another disappointing loss if you date back
05:18to last year.
05:19I guess they're fortunate, you could say, to be one and one, honestly, in the season.
05:23All right, let's go and hit on Cooper Cup and the injuries to the National Football
05:27League.
05:28There are a ton.
05:29First two guys are my first two receivers in fantasy football.
05:31I know nobody wants to hear me talk about my fantasy team, but I'm a Cooper Cup guy.
05:35I'm a Debo Samuel guy.
05:36What am I going to do this week?
05:37I have no idea.
05:38Cooper Cup going to be probably placed on injury reserve would be a guess from me.
05:41I don't know that as a fact.
05:43We'll find out tomorrow.
05:44And then yesterday, out of nowhere, late in the day, Kyle Shanahan comes out, says Debo
05:48Samuel's got a calf strain.
05:49Oh, by the way, he's going to miss two weeks.
05:52So he is out for the 49ers.
05:54And so is Christian McCaffrey.
05:57And the 49ers are already in trouble this early on the season.
05:59But you know what?
06:00They're not the only ones.
06:01Adam Kaufman is going to join us.
06:02A ton of injuries at this point of the season.
06:04Also, Juwan Bentley, who has totaled more than 100 tackles each of the past three seasons
06:09tore his left pectoral muscle.
06:10He's on the Patriots.
06:12He's expected to miss a lot of time.
06:13Usually, this is season-ending.
06:14Also, Graham Gonneau.
06:15The Giants went into the game with a hurt kicker.
06:16And guess what?
06:17He got hurt in the game.
06:18Shocker.

06:20Going to miss a few weeks.
06:21Maybe the Giants will have a kicker this weekend.

06:24All right.
06:25Quarterback changes across the board, especially with Michigan and Wisconsin.
06:28So let's get to those.
06:30Sharon Moore makes a big announcement yesterday.
06:32Alex Orji is going to be at the helm at starting quarterback for the Wolverines.
06:39They're just trying to score points.
06:40They've had all kinds of issues.
06:41Of course, their former quarterback is in the NFL with the Minnesota Vikings and not
06:46playing.
06:47And also, Tyler Van Dyke, the transfer from Miami to Wisconsin, has a torn ACL, and he's
06:53going to miss the rest of the season.
06:54They play against USC.
06:56And Wisconsin also had a hard time scoring points early on in the year.
07:00NC State is turning to C.J. Bailey as starting quarterback.
07:03Rayson McCall was knocked out last week with an undisclosed injury against Louisiana Tech.
07:08And sources say that Air Force has emerged as a serious target, potentially to move to
07:12the AAC.
07:13Again, a lot of conference movement going on.
07:16The AAC has 14 football schools this season, including a couple of the academies, Army
07:21and Navy.
07:22So Air Force would make some sense there.
07:23Okay.
07:24We're down to less than two weeks in the regular season for Major League Baseball.
07:28National League Wild Card is going to come right down, probably to that series next week,
07:31between the Braves and Mets.
07:32The Mets right now hold a one-game lead for the Wild Card.
07:37They walk off the Nats and win 2-1, and the Braves got shut out again.
07:40I don't remember the last time the Braves have been shut out so many times in the season.
07:43Nine to nothing last night against the Dodgers.
07:46Tigers win again.
07:47They beat the Royals.
07:48They're now a game and a half back of the final Wild Card spot in the American League.
07:51The Detroit Tigers, yeah, remember them from years and years ago?
07:54They're back in the playoff mix.
07:55Hey, Luis, the rise of the Padres had a great few months here.
07:59Finally struck out for the first time, ending a streak of 141 consecutive plate appearances
08:04without striking out.
08:06Speaking of striking out, Mike Trout hasn't struck out, hasn't done anything, missed most
08:10of the season.
08:11He says, he told the LA Times, that he's open to moving from center field to right field
08:17coming up next season.
08:19One big game in the WNBA tonight amongst the schedule, and I'm sure we will be watching.
08:24It is the Lynx taking on the Sun on the road.
08:27The Sky will visit the Dream.
08:29The Aces will take on the Storm.
08:31Those are the three games.
08:32The Aces, of course, are very good.
08:33They're big road favorites.
08:35We'll keep an eye on a couple of those games as well.

08:39We've got Sam McQuillan with us from Legal Sports Report.
08:42Sam, it has been a slow year across the United States for news on legalizing sports betting.
08:49I guess partially the reason why is because it was such an incredible first few years
08:54when they repealed PASPA and all of these different states started legalized sports
08:58gambling.
08:59Last year, the big story was Florida, obviously, getting it in the hard rock, back and forth,
09:02everything else.
09:03It does appear that our story to cover in the final quarter of the year is Missouri
09:09with it going on the ballot in November, but it's now being met with people who do not
09:14want this legalized.
09:15I guess the question becomes is not, is it going to get legalized or not, Sam, but what
09:19does this opposition really look like?
09:21Yeah, definitely, Craig, you're spot on with the more states that have legalized, the less
09:26you have left to legalize, unless we would add more states to the 50 we already have.
09:32It's been a slow year for companies.
09:35They're focusing on Missouri, as you mentioned, which will bring sports betting to the ballot
09:41in November.
09:42Now, ahead of November, we have some opposition that's popped up.
09:46We hadn't really had much either side for or against this ballot, but as we get closer
09:52to November, I imagine we'll get more and more of this kind of groups coming out opposing
09:59it or being for it.
10:00The group that came out against it, surprisingly, is actually Caesars.
10:04They donated $4 million to a newly formed political action committee called Missourians
10:10Against the Deceptive Online Gambling Amendment, which was obviously formed to have commercials
10:17or pass out pamphlets, whatever it may be, any sort of information that would have people
10:22vote against this ballot.
10:24Now, you might ask, why Caesars?
10:26Don't they want sports betting in Missouri?
10:28The answer to that question is, yes, they do want sports betting in Missouri, but they
10:32want it on their terms.
10:35As the language is written in this amendment, it would allow each of the state's casinos
10:40to have one sports betting license and also create two more, which would be called untethered,
10:46basically no requirements that you have a partnership with a land-based casino or racetrack,
10:51which we've seen a lot of other states do.
10:55This is a departure from previous attempts to legalize in Missouri, which would have
10:59given each casino multiple licenses.
11:02There's about six in Missouri, so that would have created up to 12, 15 sports books, each
11:07of which would be controlled by the casinos and no untethered ones.
11:12The PAC says this question was written by and for the financial benefit of out-of-state
11:17corporations and sponsors and funders, which would probably be FanDuel and DraftKings,
11:23who are the two sports books that have donated to the campaign to legalize.
11:28They've donated $11.5 million to get this on the ballot, to get it passed by the people
11:35to create an amendment.
11:37Caesars is the first.
11:38It's pretty notable.
11:39Caesars is the first company that owns a casino or owns sports betting to oppose it.
11:45Others like BetMGM, MGM doesn't have any casinos in the state.
11:49They haven't gotten involved yet, so pretty notable that Caesars is coming out here and
11:53sort of directly opposing FanDuel and DraftKings.
11:55Now, if you ask me whether or not this will pass, I'd have to lean on yes, because there's
12:00more money coming in on one direction.
12:03I know Missouri has wanted to legalize sports betting for a while.
12:07If sort of the only argument that's being put out there is by a casino that just wants
12:11more control over it, it'd be sort of a tough hill to climb.
12:15But you never know.
12:16Missouri's been a tough one for a while, so we'll check back in in a few weeks, I'm sure,
12:19and more money comes the other way, and I'll have to see in November.
12:22Yeah.
12:23No, look, this is going to be the big story for us at the end of the year to see if this
12:26ends up happening.
12:27All right.
12:28So we know that FanDuel and DraftKings, especially DraftKings in particular, we know are upset
12:33with the tax rate in some of these different states, including New York, above 50 percent.
12:37Some other places, 30 percent, 40 percent.
12:40But Sam, the interesting story, and I know that you guys wrote about this, the legal
12:42sports report, is it appears as though they're going to try and make that money up in some
12:48way.
12:50They tried once by, you know, DraftKings tried once by essentially saying that they were
12:54going to do something that they got walked back on.
12:57But do they really think, Sam, that they're going to get away with, like, raising their
13:00minus 110s to minus 130s with nobody noticing and things like, because there are other options
13:05for people to take to.
13:06And I also wonder if the competitors to DraftKings and FanDuel, if they choose to do this, just
13:12kind of stick it to them by saying, hey, look, same bets.
13:15You guys are charging minus 130, we're only minus 110.
13:18I don't understand how they think they're going to get away with this.
13:21Yeah, so the companies themselves have not outright came out and said anything about
13:26adjusting the prices.
13:27Now, they do have a lobbying group called the Sports Betting Alliance, which represents
13:31all of the companies and has essentially threatened, hey, states, if you raise your tax
13:35rates like they did in Illinois when they were fighting the tax raise there, it's going
13:39to make prices worse for the customer.
13:41So essentially saying the companies are going to do this, companies themselves have not
13:44actually come out and said anything.
13:46Another group that has been very vocal on this issue is Wall Street's, you know, they
13:51have a lot of stake in the game.
13:53They want they don't want these companies to be losing 200 million dollars a year from
13:57just one state raising its taxes.
13:59So the firms have done a lot of research.
14:01One called Truist came out this week and said that if FanDuel and DraftKings raise their
14:07prices across the board, that's pretty interesting, not just in a single state, but
14:11across the nation.
14:12They could add about 240 million dollars in revenue, which sort of fits perfectly in that
14:18whole of revenue that they're projecting just from the Illinois tax increase next year.
14:23Pretty interesting that it's not a state by state measure.
14:27They've kind of threatened that in the past or at least talked about it.
14:30But it seems like it would be difficult just in the market, the way you market your odds
14:33to say, hey, in New York, it's minus 140, but in a state like New Jersey, it's plus
14:39110. It seems like that would be pretty difficult to do.
14:42They have never really gotten into why they might do it or why they might not do it.
14:47Now, overseas in Germany, a sort of similar thing has happened in the past where the
14:53country made a tax on handle and operators dealt with it by passing the cost down to the
14:59customers there.
15:00The operator that now leads there actually got around it by just driving people towards
15:04more profitable bets.
15:06More profitable bets lately have been parlays and same game parlays, which these
15:10companies have repeatedly driven people to.
15:13So if I had to guess what they would do, I would just guess that they'll try to drive
15:17more people towards those more profitable bets and hold off on raising prices for now.
15:22But it is something that sort of is in the back that's being threatened and being
15:25thought about and pushed by at least some investors in Wall Street.
15:29OK, well, look, again, you know, to know that people won't notice this is silly.
15:34So it just depends like a minus 112 instead of a minus 110, Sam, maybe they could get
15:38away with that minus 113 15.
15:40But, you know, raising it significantly, there are a lot of different options.
15:44And it's interesting that that coalition is involved because it sounds like to me it
15:47would have to be everyone agreeing to do it as opposed to just one or two of the sports
15:50betting companies. All right.
15:52Finally, NFL try to make heads or tails of what's going on this year, Sam, amongst all
15:57years. The only thing that that I can tell you, and I've said this earlier in the show,
16:01I'm going to say it again, is that laying points in the NFL above like one or two is a
16:05losing proposition. These teams are very similar, if not the same.
16:09The look ahead lines not look ahead for this week, Sam.
16:12There's only one team that's a seven point favorite in the NFL this week.
16:15Only one. That's it.
16:17Everybody else under. I think that's the big adjustment we're going to have to see from
16:20the books. Yeah, you see the big reaction there, people probably hesitant to bet on
16:25teams getting more than seven points.
16:28Obviously, the Ravens had a huge upset this past week.
16:31The Cowboys got destroyed by the Saints.
16:33Underdogs went ten, five and one against the spread in eight and eight straight up after
16:38last night, after Philly faltered to Atlanta.
16:40So it's pretty interesting to see the sports books adjust the spreads down.
16:44They had a great week, according to McQuarrie, which estimates that they held about 16
16:48percent on all bets, which is double what you would usually expect in a week that
16:53bounces back from a really bad week.
16:55One, the public was on the favorite and 14 of the 16 games.
17:00So obviously the sports books cleaned up there as well.
17:02It's really interesting to see how these odds move throughout the week.
17:05Obviously, there's about only one game, but a huge spread.
17:08We'll see how high that goes and we'll see if people bet it down before next week.
17:12But definitely an interesting start to the season in terms of betting and what the
17:15books are making. Yeah, San Francisco right now, seven point road favorites.
17:19That's the biggest one at the Rams and the Rams, of course, have like a ton of injury.
17:24So that does make sense. But so does San Francisco, too.
