00:00An industrial court has ruled that a former Malaysia Airports Holdings Berhad aviation
00:08security assistant was wrongfully dismissed despite being cleared by a domestic inquiry
00:13of misusing his medical benefits.
00:16The tribunal heard that the claimant, Tony Chan, had accumulated more than RM30,000 in
00:22medical bills for 222 clinic visits he and his family members made in 2019.
00:28In the first five months of 2020, he also incurred more than RM12,000 for 92 visits.
00:34Eight days after a domestic inquiry cleared him of wrongdoing, the management sacked him
00:39on the same grounds.
00:41Sabah Industrial Court Chairman Indra Ayub said falling sick was beyond the control of
00:46Chan or his dependents, and they also had no say in the medication they were prescribed.
00:51Chan, whose last drawn monthly pay was RM3,089, was awarded RM107,513 in compensation by the
01:00court.
01:01Indra also said the claimant's employment contract had no guidelines on medical claims.
01:06In particular, it did not limit the number of visits the claimant or his dependents could
01:10make, nor did it set a price cap.
01:14He described MAHB's decision to terminate the claimant just eight days after the domestic
01:18inquiry as hasty, pointing out that it didn't follow the terms in his employment offer letter.
