00:00The Industrial Court has awarded RM703,664 in compensation to a former Maxis Broadband
00:09Sindhiriyan Berhad manager for wrongful dismissal.
00:13In an award dated July 16, the court noted that Ang King Singh's performance had never
00:18been appraised as unsatisfactory throughout his 25-year stint with the firm.
00:24Chairman Zul Bahrain Zainuddin said, between 2016 and 2019, Maxis rated Ang's performance
00:31as partially meets expectations, but despite this, it went on to thank him for his contribution
00:37and commitment, even awarding him RM26,132 as a token of appreciation of his efforts.
00:45On September 1, 2020, after three consecutive PMA ratings, Ang was placed on a three-month
00:52ad-hoc performance improvement plan by the Human Resources Department.
00:56He was given 12 deliverables to accomplish over and above his core duties, which Zul
01:01Bahrain said caused Ang hardship and affected his concentration when carrying out his daily
01:07duties.
01:08As a result, Ang failed at all three appraisals and was told that his services would be terminated
01:14with effect from February 28, the following year.
01:18Zul Bahrain, however, found that the PIP deliverables had obstructed Ang's discharge of his core
01:24duties and was not designed to improve his performance.
