Former Nenggiri assemblyman Mohd Azizi Abu Naim has once again failed to stop the Nenggiri state by-election after the High Court dismissed his injunction application in his originating summons, Malay language daily Sinar Harian reports.

00:00Former Nengeri Assemblyman Mohamed Azizi Abu Naim has once again failed to stop the Nengeri
00:06state by election after the High Court dismissed his injunction application in his originating

00:13Judicial Commissioner Rozmawa Rozain made the decision on Monday after finding that
00:19the plaintiff did not meet the requirements for the court to grant him the interim injunction.
00:24The Election Commission set the Nengeri state by election on August 17, following an unexpected
00:30vacancy after the incumbent, Mohamed Azizi, was declared to have lost his membership in
00:36Parti Pribumi Bersatu Malaysia on June 13.
00:40Mohamed Azizi filed the originating summons on June 24 and named Bersatu President Tan
00:47Sri Muhyiddin Yassin, the party's Secretary-General Datuk Seri Hamzah Zainuddin, Kelantan Speaker
00:53Datuk Mohamed Amarnik Abdullah, and the EC as defendants.
00:58In the originating summons, Mohamed Azizi, who is also Guamusang MP, sought a declaration
01:04that the Nengeri state by election could not be held or conducted by the EC, as he still
01:10held the seat, and that his dismissal from Bersatu was invalid.
01:15On June 27, the High Court dismissed the interim injunction application, deciding that he had
01:21not suffered any damage as he could still participate in the election.
01:26The plaintiff's full injunction application will be heard on August 28.
