00:00Retired Supreme Court Senior Associate Justice Antonio Carpio
00:03has decided that it is time for the Philippines to file a new arbitration case against China.
00:09In the middle of the Philippines and U.S. Coast Guards' training on Lubang Island,
00:12a Chinese ship was spotted.
00:14Let's go back to Chino Gaston.
00:19Despite the use of water cannons, this rubber boat was used for fishing.
00:24But this is not a new incident of harassment in the West Philippine Sea,
00:28but a part of the training of the Philippine Coast Guard and U.S. Coast Guard
00:32near Lubang Island in Occidental Mindoro.
00:39Search and Rescue and Medical Evacuation
00:41is the main focus of the training,
00:44where the USCG Cutter Waysh
00:48and one of the largest ships of the PCG, the BRP Melchorra Aquino.
00:53During the training,
00:55the China Coast Guard Vessel 5303 approached 15 nautical miles to dock.
01:00In the last monitoring of the PCG, it left towards the direction of Palawan.
01:04It was reported that it came close to Lubang Island
01:10at a distance of 16 nautical miles.
01:13So that is also true in response to the incursive presence
01:19of the Chinese Coast Guard in Lubang Island.
01:22The commandant of the Philippine Coast Guard, Admiral Ron Hilgaban,
01:25has also deployed the BRP Melchorra Aquino.
01:30We show the flag by deploying our vessel
01:34and then at the same time, see to it that they are going to depart.
01:38The BRP Melchorra Aquino is 97 meters long.
01:41The BRP Teresa Magbanwa was docked for several months
01:45in Sabina or Escoda Shoal.
01:47Teresa Magbanwa is 600 meters away
01:51from the Chinese Coast Guard's monster ship.
01:54So I would like to confirm the last image that I got
01:57from our Coast Guard personnel from 9701.
02:01The Chinese Coast Guard monster ship remains to be inside the Escoda Shoal.
02:06It never departed and is still anchored there.
02:09We also periodically challenged them over the radio,
02:14calling them out and telling them that they are within our exclusive economic zone
02:19and that they have to tell us what is their intention.
02:24China previously said that their ship is still anchored in Escoda
02:28because the Philippines will build an outpost there.
02:32According to the retired Supreme Court Senior Associate Justice Antonio Carpio,
02:36it is time for a new arbitration case to be filed against UNCLOS
02:40after China opposed the Philippines' request
02:43for an extended continental shelf in the West Philippine Sea.
02:47Joint patrols are one of the strongest enforcement measures of the arbitral award.
02:58They are telling China, we can conduct these naval drills, aerial drills,
03:04because these waters constitute the exclusive economic zone of the Philippines
03:10in accordance with the arbitral award.
03:12In the exclusive economic zone under UNCLOS, that is the strongest enforcement so far.
03:18Eight years since the arbitral award was issued in 2016, China still does not recognize it.
03:24One of the ways to strengthen it is the Philippine Maritime Zones Bill
03:30which was just signed by the President.
03:33It will establish the limits of the Philippine Maritime Zones
03:37and the rights of the country within it.
03:40We included the Philippine Maritime Zones in Palawan and the Philippine Maritime Zones in the Philippine Rise.
03:44Our rights and boundaries are clear.
03:48It is clear that we have a law where we can sail and fish.
03:54With that act, we're also now laying the groundwork
03:59for improving our law enforcement within these maritime zones.
04:05China has been pushing the so-called arbitral award
04:08because it is also included in the agreement between Panatagsol and Spratlys.
04:13According to the Chinese Foreign Ministry,
04:15their support is a direct negotiation between China and the Philippines.
04:20This is in line with the repeated arrangement on improving the Philippines-China maritime communication mechanisms
04:26that our Department of Foreign Affairs has signed.
04:29This will be given in different ways for the two countries to discuss maritime issues.
04:36It can be through the so-called leadership of their leaders
04:40through the DFA and the Ministry of Foreign Affairs of China
04:44up to the level of Foreign Minister and Vice Foreign Minister
04:47and through their Coast Guard.
04:50The DFA is coordinating with China for its guidelines.
