00:00Big breaking news that's coming in the Supreme Court has initiated an investigation
00:04Into the High Court Judge Varma at whose residence are piles of cash were found
00:09Now a report has been sought from in fact at the Delhi High Court Chief Justice
00:14The Supreme Court has started the process to investigate the allegations against Justice Yashwant Varma as per the procedure first
00:21A report is being sought from the Chief Justice of the Delhi High Court on this entire matter
00:27According to legal experts if any High Court judge is accused of misconduct
00:30The first of all the report is sought from the Chief Justice of that concerned court in this case
00:35It's the Delhi High Court now this has happened before and this is the process that's always been followed when such
00:42Allegations come to the fore in this particular case a report has been sought from in fact the Delhi High Court
00:49Chief Justice Sanjay Sharma is joining us with more details on this Sanjay
00:54I'll take us through what is the procedure an inquiry has been formally launched with the Supreme Court seeking a report now
01:01because
01:02allegations made against the Justice Varma and
01:05first of all Supreme Court Collegium decided that it should be immediately transferred because he's
01:12number two in Delhi High Court and
01:14That's why he's a he's a important part of Collegium High Court Collegium. So the Supreme Court Collegium just
01:23Initiated that first of all, he should be immediately transferred and today
01:28the sources are the highly placed sources are saying that
01:32Supreme Court Collegium again met today morning and
01:36They have started the inquiry
01:40According the process the inquiry should be started by to sort a report from
01:47Delhi High Court Chief Justice and
01:50After the report received the receiving
01:53By Supreme Court Collegium, then they will decide that what to do for the next course of investigation
01:59Okay, so this is due process that's being followed right now
02:02The next step usually after the transfer is to seek for in fact the Chief Justice of that respective court to hand over a report
02:09Thanks Sanjay for joining us with those details
02:13But let's tell you really what this entire issue is about a Delhi High Court judge has been transferred following a huge
02:21Seizure of cash from his residence large amount of cash being found at his bungalow after a fire incident
02:28Justice Yashwant Varma as a result has been sent back to his parent court the Allahabad High Court
02:33Sources said that a fire had broken out at Justice Yashwant Varma's residence
02:38Official residence and he wasn't in the city
02:40So his family members alerted the fire brigade and the police after extinguishing the fire the fire brigade personnel
02:46Discovered a huge amount of cash in different rooms of the bungalow upon receiving that information
02:52The Chief Justice of India Sanjay Khanna convened a meeting of the Collegium and it was unanimously decided to transfer Justice Varma back to the
02:59Allahabad High Court, which is very previously said till October 2021
03:03Discussions are underway about an investigation about perhaps even impeachment proceedings against Justice Varma
03:12Transfer is a normal thing. This is not a stigma and
03:16It is appropriate when such
03:19allegations I am not
03:22admitting that there can be any
03:26Really there is any
03:28situation of corruption because I feel sometimes
03:33Some people who are not getting favorable result
03:36they may also plant and
03:39here I feel when the
03:42Judge was himself not there family member were not there and such thing happens
03:49Fire happens and then video being made
03:53There's I feel there is some suspicion and the Collegium of the Supreme Court should make
04:00Thorough inquiry the way our system is structured. Is that the judiciary?
04:05Self-regulates itself. So it's really incumbent upon the Chief Justice and the Collegium to take appropriate action only after due process and formal inquiry
04:13So I really don't know the facts of the case beyond what's being reported in the paper
04:17But I'm sure the senior judicial minds of this country will will follow a process and then act on it
04:23Certainly the issue of corruption within the judiciary
04:27Is a very serious issue and this is not something that has been articulated by senior counsel and lawyers in this country
04:36For the first time it's been going on for years and public statements have been made
04:42So I think that it's time for the Supreme Court to start
04:46Looking at issues of how the appointment process should take place
04:50that it should be more transparent and
04:53And the issue also came up in Parliament with Congress MP Jairam Ramesh raising the same about the huge cash piles found at
05:01The residence of the Delhi High Court judge. He raised it in the Rajya Sabha. Here's what happened
05:10This morning we have read about a shocking case of
05:15Huge amounts of cash unearthed at the residence of a judge of the Delhi High Court
05:21Earlier 50 members of Parliament have submitted a notice to you
05:25Regarding certain remarks that were made by a judge of the Allahabad High Court. You yourself have repeatedly
05:33called into question
05:34the urgency for judicial accountability
05:38You have in fact directed the leader of the house on this issue
05:42So I request that you please make some observations on this and give necessary
05:47Directions to the government to come up with a proposal for increasing judicial accountability
