00:00Following the arrest of former President Duterte, experts on the legality of the case also expressed their different opinions.
00:09Let's find out the details in the news center of Christian Vascones.
00:15The issue of the legality of the arrest of former President Rodrigo Duterte is being discussed because of his case of Crimes Against Humanity
00:24which is included in the treaty or agreement called the Rome Statute of the International Criminal Court.
00:29Some experts expressed their interpretations on this issue.
00:33According to the Dean of University of St. LaSalle, Atty. Ralph Sarmiento,
00:38even if former President Duterte denied that the Philippines withdrew as a member of the ICC,
00:43the warrant of arrest is still valid because the ICC has a jurisdiction in his case
00:48before the withdrawal became effective on March 17, 2019.
00:52The ICC will only have jurisdiction in Duterte's case if the state does not prosecute the perpetrator.
00:59Where the ICC saw that the Philippines is wrong in its investigation that supports the ICC's laws,
01:06said Atty. Yvcar Cruz Pereira, former Legal Counsel of Human Rights and International Human Rights Counsel,
01:13that the warrant of arrest of Interpol is legal because the ICC, Office of the Prosecutor, and Interpol have cooperation
01:21that was passed in 2004.
01:23Pereira stated that in November 2021, the Philippines submitted a referral request to the ICC
01:31to postpone the investigation because the country has already started its own investigation
01:36on extrajudicial killings in war on drugs.
01:38But in June 2022, the ICC prosecutor requested to continue the investigation
01:45because the country was unable to investigate and prosecute
01:48that was approved by the ICC Pre-Trial Chamber on January 23, 2023.
01:54Atty. Mike Thieu, Professor of UP College of Law, explained that in Article 59 of the Rome Statute,
02:01that the competent judicial authorities in the custodial state must be brought immediately
02:07to carry out the right process and respect for human rights.
02:11That's why Duterte brought the arresting personnel to the Hague Netherlands
02:15to start the hearing on the case.
