00:00There is a proclamation in the Congress that the death penalty for heinous crimes is returned as a plunder.
00:06And if the public official is punished through the firing squad,
00:11that is what Professor Antonio Contreras will discuss in Punto de Vista, Professor.
00:22Thank you very much, Diana, and good morning to all of you in the studio.
00:26There is a proclamation in the Congress that the death penalty for heinous crimes is returned as a plunder.
00:40And the new proclamation is that if the public official is convicted,
00:48the method of execution is through the firing squad.
00:54And if the public official is convicted, the method of execution is through lethal injection.
00:59Let us think about this proclamation because the question here is whether the death penalty is effective.
01:06What is the purpose of the death penalty?
01:08To stop or scare people who have not committed a crime.
01:12But is it effective?
01:14And let us think about this because if we look at the world trends,
01:19now, 7 out of 10 countries do not have a death penalty.
01:24Only 3 have it.
01:26In fact, there are countries that even though they have a death penalty,
01:30they do not use it as much, like Indonesia, Thailand, and even Malaysia.
01:36So the only countries that use it are China, Iran, Somalia,
01:44and the United States because they have a death penalty.
01:46It is only in some states and not in others.
01:49The rules of the death penalty are based on the experience
01:54that sometimes, the death penalty is not really guilty.
01:59It is easy for us to say that those who have committed a crime are punished.
02:03What if at that time, it was proven that it is not a crime,
02:07especially if there is a DNA testing and it has been studied?
02:11Will you be able to return the life of that person?
02:14And sometimes, it is also in the law that the limitation,
02:18not just sometimes, but the limitation,
02:20for people who have a death penalty,
02:22is that they have no ability to defend themselves.
02:25If they are rich, they can buy a lawyer,
02:27they can hire a lawyer de campanilla who can defend them.
02:33But for the poor, they do not have that ability.
02:36That is why the limited punishment of death is for the poor and the poor.
02:42But one thing we should talk about here,
02:44is the death penalty effective?
02:47According to many studies,
02:49it is not effective to have the so-called deterrence effect.
02:53In fact, in America, the states that have a death penalty,
02:57the rate of criminality is even higher
03:00compared to states that have no death penalty.
03:04So, let us think about this.
03:07Especially when we will be using the term, firing squad.
03:15It is already 2024, we are already taking away everyone's rights.
03:20And when people ask,
03:22can we not just use the term life imprisonment?
03:26You know, my point of view here is not the punishment,
03:31whether it is a death penalty or life imprisonment.
03:34What is more serious is that it gives negative incentives
03:42or disincentives to commit a crime.
03:45What stops us from doing it is the assurance
03:49that if you are guilty, you will be punished.
03:52The assurance, the system of justice,
03:55is to treat people equally.
03:58And the assurance that if you are rich, you will be saved.
04:02That is what is more important.
04:04Because according to many studies,
04:06it doesn't matter whether you have a death penalty or not,
04:09crimes will be committed.
04:11However, the deterrence to crime,
04:13the most effective deterrence to crime,
04:15is the certainty that you will be prosecuted,
04:17the certainty of justice,
04:19and that the rule of law will be upheld.
04:21That is my point of view this morning.
04:24Thank you very much.
