00:02Breaking tonight, Hunter Biden pleads guilty to charges of avoiding tax payments.
00:08Jury selection was scheduled to begin.
00:09Instead, lawyers for the president's son requested to change his plea, surprising prosecutors
00:14who urged the judge to reject the new course of action.
00:18The case follows his conviction in Delaware on gun charges, for which he's still waiting
00:22sentencing.
00:23We head to the U.S. courthouse in downtown Los Angeles, where chief correspondent Jonathan
00:27Hunt reports on how this case developed through the day, changed.
00:32Good evening, Jonathan.
00:34Good evening, Bret.
00:35Just about 30 minutes ago, we wrapped up what has been an extraordinary day with Hunter
00:42Biden walking out of the courthouse here, having pled guilty to all nine tax evasion
00:49and tax fraud related charges.
00:52As he walked out, he said nothing.
00:54He held hands with his wife, Melissa, and he left it to his lead attorney, Abby Lowell,
01:00to explain why he changed his plea to guilty.
01:04Listen here.
01:05Hunter decided to enter his plea to protect those he loves from unnecessary hurt and cruel
01:15humiliation.
01:17This plea prevents that kind of show trial that would have not provided all the facts
01:24or served any real point in justice.
01:28It was Lowell who earlier in the day had dropped the bombshell in court that the plea was going
01:34to be changed.
01:35At that point, it was a so-called Alford plea in which Biden would plead guilty while not
01:40while maintaining his innocence to some of the charges against him.
01:46The Department of Justice objected to that.
01:48The judge then heard from both sides and indicated he would be open to what is called
01:55an open plea agreement.
01:57In other words, an admission on all charges, an admission of guilt.
02:02So then the prosecution was allowed to read out the entire 56-page indictment, including
02:08all the lurid details about strippers, fast cars, fast women, as prosecutors had put it.
02:15And then Judge Mark Scarsey put each of the nine charges individually to Hunter Biden,
02:23asking him how he pled.
02:25He said guilty nine times, and that wrapped up the court proceedings.
02:30He will now be sentenced, Brett, on December 13th, December 16th.
02:35On November 13th, he'll be sentenced on that gun conviction you mentioned in Delaware.
02:41We will then all await to see whether President Biden on his way out of the White House either
02:47pardons his son or commutes those sentences.
02:51Up until now, President Biden himself and today his White House press secretary, Kareem
02:56Jean-Pierre, said no, that will not happen.
03:00We'll find out for sure around noon on January 20th.

03:08Meantime, former President Donald Trump will not go to trial in the nation's capital over
03:12his alleged attempts to overturn the 2020 election before the 2024 election.
03:19Lawyers representing both special counsel Jack Smith and the former president appeared
03:22in court today.
03:23The case was supposed to go to trial in March, but was put on hold after the U.S. Supreme
03:28Court ruled the president's actions, presidential official acts are immune.
03:34The judge has yet to set a new trial date, but it won't happen before the election day.
03:39Let's bring in Fox News chief legal correspondent, anchor of Fox News Sunday, Shannon Bream.
03:44Shannon, good evening.
03:45Let's start with the Hunter Biden plea ask and then pleading guilty to all of these counts.
03:53Pretty rare for this day in court.
03:55It is such a bit of whiplash today to watch what has happened there to come in after the
03:59DOJ has spent months and spent millions of dollars getting this case to today and without
04:05even notifying them in advance, apparently saying, oh, by the way, we want to work out
04:09a deal now when we're in the courtroom and we're about to start jury selection.
04:13And you heard what his attorney said.
04:15He did this for his family.
04:16And that may be in part because just days ago, Judge Scott Scarcey, in this case, said
04:21all of this information that they want to bring in the government and the prosecutors
04:24want to bring in about sex workers and porn and prostitutes and memberships at sex clubs.
04:30He said this in an order last week.
04:31The court generally agrees with the government that evidence of the precise nature of Mr.
04:36Biden's expenditures is necessary for the jury's assessment of Mr. Biden's state of
04:40mind.
04:41So listen, if he was going to allegedly claim these as business expenses, the judge said
04:45all of that stuff was likely to show up in the courtroom.
04:48Yeah, here's Jonathan Trilley earlier when it all started going down.
04:53I have never, ever heard of any defense team walking in and without first telling the prosecutors.
05:00And I think that's one of the reasons there was a very fast opposition to the Alford plea
05:04from the prosecutors.
05:05They are clearly miffed.
05:07And I'm not too sure I blame them.
05:10Yeah.
05:11And the other thing, Shannon, is we heard Jonathan Hunt in his report talk about whether
05:15there would be a pardon or what the White House is saying here.
05:19Maybe that was the ulterior motive here with this ploy, this this effort that they made
05:25in court today.
05:26Here's what Kareen Jean-Pierre has said about that.
05:28It is still very much a no to the questions that I've gotten about if the president's
05:33going to have a pardon.
05:34But I don't have anything else to add.
05:35Can you comment on whether a commutation would be on or off the table?
05:38That's also no.
05:41That's also no.
05:42She said, obviously, that doesn't mean that it's not going to happen.
05:45Yeah.
05:46I mean, they've maintained that position.
05:48And even just yesterday, when she was pressed on this issue about Hunter going to trial,
05:52Kareen Jean-Pierre said, listen, he's a private citizen.
05:54The president is staying out of this and letting it go.
05:56And so maybe the position is no to pardon, no to commute as long as these legal cases
06:01were still pending.
06:02But I think just about every parent across America out there.
06:05Also, if the president decided, listen, he's done with his public life, he's leaving office,
06:10he decides to pardon or commute any sentence for his son on the way out the door.
06:15I think a lot of Americans are going to say we get it.
06:19And finally, very quickly, former presidents not going to trial on this 2020 case before
06:24the election.
06:25Yeah.
06:26And listen, they had said to Judge Chuck and who has been on hold for almost a year while
06:30the Supreme Court ironed out that immunity issue you talked about.
06:33They've said to her, we have all kinds of motions.
06:35We're going to try to get Jack Smith kicked off the case like happened with Judge Cannon
06:38in Florida.
06:40Very challenging.
06:41His appointment as special counsel.
06:43So they've got a whole list of motions.
06:44They want to push this well into twenty twenty five.
06:46And of course, as you know, the election has everything to do with how these cases will
06:50or won't continue.
06:51A lot moving today, Shannon, as always.
07:02Former President Trump and Vice President Kamala Harris are promising to lower inflation,
07:06support the middle class and lower costs.
07:09But their plans to do these things while they're vastly different.
07:12Former President Trump touted his record today at the Economic Club of New York while
07:16outlining proposals for a possible future Trump administration.
07:20The Harris campaign, meantime, saying the Trump plan helps billionaires and big corporations.
07:25Correspondent Alexis McAdams takes a closer look at the former president's economic platform
07:30from that speech today in New York.

07:34Yeah, that's right.
07:35Donald Trump stood here in New York City in a room packed full of some of the biggest
07:38economic heavy hitters in the world and outlined his plan for the economy, quite simply telling
07:43people he'll take America in the right direction while Kamala Harris will take everyone backwards.
07:49Kamala Harris will take more money out of American pockets.
07:54My plan will leave the typical family with many thousands of dollars more than they have
07:59right now.
08:00Former President Trump rolling out a list of economic policies that he believes will
08:04put the country back on track.
08:07Speaking to members of the Economic Club of New York, Trump announced he will take up
08:10Elon Musk on his idea to audit the federal government.
08:14I will create a government efficiency commission tasked with conducting a complete financial
08:19and performance audit of the entire federal government.
08:23And Elon, because he's not very busy, has agreed to head that task force.
08:29Trump says when it comes to running the country, he runs it like he'd run his own business.
08:33What's best for the people, what makes the most money and overall what policies will
08:37make this country stronger.
08:40Energy was what caused our problem initially.
08:43Energy is going to bring us back.
08:45And Trump said this about his opponent's economic agenda during the Fox News town hall with
08:50Sean Hannity.
08:51This country will end up in a depression if she becomes president like 1929.
08:56This will be a 1929 depression.
09:00She has no idea what the hell she's doing.
09:02As Trump aims to lower the corporate tax rate, Vice President Harris plans to offer
09:06tax breaks to small businesses.
09:11And now tonight, breaking news, Brett, a judge in North Carolina has refused to take RFK
09:16Jr.'s name off of the ballot in that battleground state of North Carolina.
09:20And tomorrow, absentee ballots are set to be sent out.
09:22So that could delay things.
09:24We're hoping to get an update tomorrow morning.
09:26So we'll keep you posted on how that plays out.

09:31Vice President Kamala Harris arrived in Pittsburgh earlier today.
09:34While she had no public events today, the Democratic nominee plans to mix in meet and
09:39greets with Pennsylvania voters between preparations for next week's debate.
09:44That's Tuesday.
09:45Correspondent Brian Yennis is traveling with the vice president.
09:48Reports from Pittsburgh.
09:50This is his seventh general election presidential debate, probably the most of anybody in history.
09:56And Donald Trump's a showman.
09:57So we know he's going to come in ready to debate.
10:01Vice President Kamala Harris's campaign lowering expectations for the Democratic nominee ahead
10:08of Tuesday's debate after accepting final debate rules, stipulating the candidate's
10:13microphones will be muted while the other is speaking.
10:17After publicly lobbying for the mics to be unmuted, Harris's team, seemingly frustrated,
10:22wrote a letter to debate host ABC News, arguing the VP will be, quote, fundamentally disadvantaged
10:28by this format, which will serve to shield Donald Trump from direct exchanges with the
10:33vice president.
10:34They were willing to agree to all of Trump's terms because they want this debate.
10:38They want to speak to the 20 percent of undecided voters.
10:41The Trump campaign is unwilling to relent on the muted microphones, claiming both campaigns
10:46had agreed to the same rules as the debate against President Biden.
10:50The Trump campaign mocking a familiar Harris phrase, writing Americans want to hear both
10:56candidates present their competing visions to the voters unburdened by what has been
11:01no notes, no sitting down, no advanced copies of the questions.
11:05According to the rules, candidates will not be permitted to ask each other questions,
11:10which could derail a strategy then Senator Harris deployed back in 2018 during Justice
11:16Brett Kavanaugh's confirmation hearing.
11:18Yes or no.
11:20Is there a person you're talking to?
11:21I'm asking you a very direct question.
11:23Yes or no.
11:26Polls show the race here in Pennsylvania is tied.
11:30It's a must win for VP Harris.
11:32And as she prepares for the debate in a hotel room here in Pittsburgh over the weekend,
11:37her husband, the second gentleman, Doug Emhoff, will be campaigning in Philadelphia suburbs
11:42while her running mate, Governor Tim Walz, will complete a two day tour with a campaign
11:47event here tonight in the Commonwealth.

12:13The data is expected to set the stage for the Federal Reserve to begin cutting interest

12:26Up next, the latest in the investigation into that Georgia school shooting.
12:29Plus, we look into claims of bias when it comes to addressing foreign election interference.
12:35Breaking tonight, users of a social media site reportedly told the FBI about threats
12:40from the Georgia school shooting suspect more than a year ago.
12:43The 14 year old now faces murder charges after yesterday's attack that left four people dead.
12:49We're also learning more about the two students and two teachers who were killed.
12:54Correspondent Steve Harrigan is at that high school in Winder, Georgia.

13:01We're finding out more about the suspected shooter and also what went on during the shooting,
13:06including some incredible acts of bravery.
13:11New details coming from law enforcement on Wednesday's mass school shooting.
13:15The 14 year old suspect is currently being held in a youth detention center about 30
13:20miles away.
13:21He will be tried as an adult and face murder charges.
13:24He will make his first court appearance virtually on Friday.
13:29New details, too, about the fear students and faculty felt.
13:33One teacher was shaking and she was scared, hiding under a desk.
13:36The other one was telling us to shut off our phones and be really quiet and that it would
13:41be OK.
13:42Students were just holding on to each other and like crying, really scared.
13:46And the acts of heroism they witnessed.
13:48My friend, my neighbor, she was going to get shot, but Miss Ernie stood up and took the
13:53bullet for her.
13:55So yeah.
13:56But, you know, that's very, very strong for her to do.
14:01Math teacher Christina Irimi was killed, along with teacher and assistant football coach
14:06Richard Aspinwall and 14 year old students Mason Schermerhorn and Christian Angulo.
14:12As a nation, we cannot continue to accept the carnage of gun violence.
14:18The suspect has been on law enforcement's radar for a year after being accused of making
14:22an online threat to shoot up a middle school.
14:25The FBI alerted local law enforcement authorities who interviewed the suspect and his father.
14:31But there were no grounds to make an arrest.
14:34Police here were alerted to yesterday's shooting by a new security system that's been in place
14:39just one week.
14:41Teachers wear badges with emergency buttons to alert authorities of an active shooter.
14:47This school and schools all across the county will be closed for the rest of the week.
14:51A high school football game scheduled for tomorrow night, which Aspinwall was supposed
14:55to coach, has been canceled.

15:01FBI agents have searched the homes of New York City's police commissioner and at least
15:05three top deputies to New York Democratic Mayor Eric Adams.
15:09Officials seized electronic devices from the first deputy mayor and the deputy mayor
15:13for public safety.
15:15The home of a public safety adviser was also searched.
15:18Adams has denied any wrongdoing and says he and his team are cooperating with the inquiry.
15:22A lawyer for City Hall says investigators have not indicated that the mayor or staff
15:27are targets in their investigation.
15:30The Biden administration is focusing on combating possible election interference by Russia.
15:34We showed you that yesterday.
15:36Some critics say other serious threats are not being addressed with the same force.
15:42Senior White House correspondent Peter Ducey looks at the possible bias behind election
15:45interference claims.

15:50Officials here have told Russia not to interfere with elections.
15:53They have sanctioned Russia for interfering with elections, but now they warn that for
15:57the third presidential election in a row, Putin is meddling.
16:03Just think about how far we've come.
16:05And Biden's team has a new warning for Russia's president.
16:08We would greatly appreciate it if Mr. Putin would, A, stop talking about our election
16:12and B, stop interfering in it.
16:14Dimitri Symes, a 2016 Trump campaign adviser, has now been indicted for working with Russia's
16:19Channel One in violation of U.S. sanctions.
16:22And a handful of conservative online influencers were apparently unwitting participants in
16:26a $10 million Russian influence scheme, according to a separate indictment.
16:31It is possible that there are many other mainstream conservative websites that are
16:38in the pocket of the Russian government.
16:41Weeks ago, the U.S. intel community warned of interference by Iran.
16:45So it looks like Russia likes Trump and Iran likes Harris, OK?
16:50Some Republican critics are accusing the DOJ of downplaying Iran's efforts to bankroll
16:55anti-Israel campus protests and Iran's plots to kill Donald Trump.
17:00And yet Russia 2.0, we're just going to blow it up two months before election day.
17:06It's completely hypocritical.
17:08Vladimir Putin expressed a preference for Harris today.
17:12Mr. Biden, he's been taken out of the race, but he advised all his supporters to support
17:16Mrs. Harris.
17:17That's what we'll do.
17:18We'll support her as well.
17:19The Harris campaign quickly sought distance.
17:22I think everybody knows who dictators and bullies around the world prefer in this election.
17:27They prefer President Trump.
17:29Although it appears maybe Putin was joking.
17:32Her laugh is so expressive and infectious.
17:35That means that she's doing well.
17:38Donald Trump talked about Putin's pitch for Harris today, saying he doesn't know if he
17:42should be insulted or if Putin did him a favor.

17:49Up next, we will hear from supporters of both Vice President Harris and former President
17:54Trump about their economic policies specifically.
17:57Right now, the two vice presidential nominees are holding events in two different swing
18:02states.
18:03Democrat Tim Walz hosting a rally in Erie, Pennsylvania.
18:05Republican J.D. Vance giving remarks in Phoenix, Arizona.
18:08We're monitoring both of these events right now live, and we'll turn around to any news
18:13that comes out of them a little later with the panel.
18:20We will provide low and no interest loans to small businesses that want to expand.
18:27And we will.
18:28And this is very important.
18:29Cut the red tape that can make starting and growing a small business more difficult than
18:36it needs to be.
18:39Vice President Kamala Harris in New Hampshire yesterday laying out more of her economic
18:42plan.
18:43Let's bring in former president and CEO of Discover Financial Services, Roger Hochschild.
18:47He's a supporter of Vice President Kamala Harris.
18:49She joins us from Chicago.
18:50Roger, thanks for being here.
18:52I want to start by talking about one of the things that she talked about there, and that
18:56is how important it was to cut red tape.
19:00You know, critics listen to that from the vice president and say, if you look at her
19:04time for the past three and a half years, the Biden administration has been accused
19:07of adding red tape to small businesses and businesses across the country.
19:12How do you respond to that?
19:14You know, I think she was very clear in her support of small businesses and acknowledging
19:19that they are the backbone of the economy.
19:23They represent well over half of all job creation.
19:26So programs like increasing the startup expense deduction from 5000 to 50000, cutting the
19:34red tape, as you mentioned, will be critical to driving further economic growth and I think
19:41are a great example of the economic policies we can look forward to when she is elected
19:46president.
19:47Yeah, well, here's just to my point, as I was mentioning, this is from The Hill.
19:52New Biden administration regulations come at the worst time for small businesses.
19:56This is March 2023.
19:57If you're running a business, you know, the 2023 is a fight.
20:00Many small businesses are already seeing a drop off in demand and global economy slows.
20:04Here's some more bad news.
20:05There are a group of regulations that will appear in 2023 that will make it harder for
20:09small businesses to stay in business.
20:11I understand what she's saying on the stump.
20:12I guess what she's done over the last three and a half years as part of this administration
20:16is what the critics are pointing to.
20:19Yeah, look, regulations are burdensome, especially on small businesses.
20:25I was lucky enough to work for a large corporation.
20:27We had a lot of resources to put against that.
20:30Small businesses don't.
20:31But I think she was very clear in her commitment that she is going to do what it takes to help
20:37small businesses.
20:38Yeah.
20:39What about the whole taxing unrealized capital gains?
20:44I know you're president, former president, CEO.
20:47You know what that potentially might do to the market.
20:51Is that something you're signed on on?
20:54So I think there has been a lot of discussion around that.
20:57And you have to realize the way it's proposed, it's almost like an alternative minimum tax.
21:04Anyone who is paying taxes would not be impacted by that.
21:09So it's just targeting the most wealthy, right, going after the billionaires, but also only
21:15going after those who aren't paying income taxes through earned income, through dividends
21:20or other sources.
21:22So I think her policy she announced around capital gains tax bring us back, I would say,
21:28more towards the mainstream than where we were under Trump, are fair, but also are very
21:34balanced.
21:35OK, that the unrealized part, I think, has people really wondering how that's going to
21:40go.
21:41And lastly, inflation.
21:42She talks she talked in the CNN interview.
21:45She talks on The Stump about how proud she is about bringing inflation down to under
21:503 percent.
21:51If you look at the chart, though, when they took over Biden-Harris, it was at one point
21:54four percent.
21:56And it went up to nine percent during this time through the administration.
22:00So people still feel that that's a real uphill battle economically as she lays out these
22:04plans, isn't it, Roger?
22:06Yeah, I mean, without a doubt, having inflation come down doesn't mean things are getting
22:12cheaper.
22:13It just means they've stopped getting more expensive.
22:15But I would contrast her policies with what Donald Trump would do, which is bring back
22:20inflation.
22:22His tariffs, his mass deportations will drive up the cost of housing, the cost of food,
22:29the cost of everything we buy.
22:31Right.
22:32It's about a four thousand dollar hit.
22:34So I contrast the great progress she and the Biden administration made bringing inflation
22:40down with the inflationary policies that Trump has said he'll put in place if he's elected.
22:48Even though he gave them one point four percent when he left office.
22:51You know, I think he also destroyed more jobs than any president.
22:55Right.
22:56We ended at the end of a pandemic and a deflationary period.
23:00So I would say if you look at what Trump did for the economy, he was clearly the worst
23:06president since the Hoover administration.
23:09So that that one point four percent came with also record unemployment.
23:14Well, we have someone that's probably going to refute that.
23:17Roger, I appreciate the time.
23:19I mean, now is John Paulson.
23:22He is the former president Trump's economic agenda.
23:26He's Paulson and company founder and president is a Trump surrogate.
23:31You've heard Roger's take, John.
23:34Worst president since Hoover on that front is what he ended with your reaction to what
23:39he just said.
23:40Yeah.
23:41Good evening, Brett.
23:42I think you have to look at the facts.
23:45Trump's economic program is is much stronger than what either Biden or Harris has proposed.
23:51Under the Trump presidency, inflation was very low.
23:54It averaged only one point nine percent per year.
23:58Under Biden, it averaged over five percent per year so far.
24:03So that's why everything costs so much today, so much more than it did when Trump left office.
24:09Furthermore, real wages grew under President Trump.
24:14They've declined under President Biden.
24:18So it's it's clear to me that Americans were better off under Trump and they'll be better
24:23off again if Trump when Trump is elected president.
24:28Here is Vice President Harris talking about corporate tax cuts and what that means for
24:32the debt.
24:33Big picture.
24:34He plans to give billionaires massive tax cuts and to cut corporate taxes by over a
24:40trillion dollars.
24:42His plans will add more than five trillion dollars to the national debt.
24:47And that is on top of the two trillion dollar tax cut he gave them when he was president.
24:56So neither party is is running away with great plans to deal with the debt or deficit.
25:02To her specific charges, how do you respond?
25:05Well, I think it's gibberish.
25:08You know what?
25:09What Trump has proposed is to extend and make permanent the tax policy that was passed in
25:162017, which has proven so beneficial for the economy.
25:21The big deficits are under Biden.
25:24Last year, it was at least two trillion dollar deficit.
25:29Trump has a plan to reduce that by first reducing wasteful spending.
25:35He mentioned today wants to eliminate the Green New Deal, which is expected to cost
25:42about a trillion dollars.
25:44He wants to not give benefits to illegal immigrants, which will reduce government spending.
25:49And he wants to raise revenues by both higher growth and revenues from tariffs.
25:55So these things will reduce the deficit and lead to lower inflation.
26:01Here's a Reuters write up saying Goldman Sachs sees biggest boost to U.S. economy from
26:05Harris when U.S. economic growth would likely get the biggest boost in coming two years
26:10from the Democrats headed by Kamala Harris, winning the White House and Congress in November's
26:14elections, according to Goldman Sachs.
26:16Under a Republican sweep or even a divided government led by Donald Trump, economic output
26:20would take a hit next year, mostly from increased tariffs on imports and tighter immigration
26:26policies, Goldman said in a note.
26:28There is some concern about talk about tariffs and what that means, because tariffs obviously
26:35eventually get passed down most times to a consumer.
26:39How do you deal with that?
26:41I think Trump's plan is to turn the U.S. into a manufacturing powerhouse.
26:46Trade today is very lopsided.
26:48We charge less than 2 percent on average for all our merchandise imports.
26:54This country is where we try to sell to them.
26:57They charge us over 100 percent.
26:59So we need to level the playing field to support domestic manufacturing.
27:04Right now, we have a 1.2 trillion dollar merchandise trade deficit.
27:09It's very unfair.
27:10By raising tariffs, we'll support American manufacturing, create more jobs here, more
27:15manufacturing here, and create more growth, higher wages, and turn America back into
27:21a manufacturing powerhouse.
27:23Well, we'll continue to dive deep into economic policies, John.
27:28We appreciate it.
27:29And, Roger, before that, we appreciate a fair and balanced discussion.
