00:18and international organizations and representatives of the diplomatic corps accredited in the
00:29Bolivarian Republic of Venezuela, Dr. Tarek William Saab, President of the Council and
00:36Attorney General, Dr. Elvis Amoroso, President of the National Electoral Council, Dr. Alfredo
00:45Ruiz, Ombudsman, Citizen Ivan Gil, Foreign Minister, Dr. Reinaldo Muñoz, Procurator
00:58of the Republic and Ombudsman, and Citizens Rectors of the National Electoral Council,
01:07Citizens Deputy Ministers of the Popular Ministry for Foreign Relations, Distinguished Representatives
01:19of Media Outlets.
01:21Ladies and gentlemen, today, on August 22, we have been summoned here to the headquarters
01:31of the Judicial Power to share information of interest.
01:37I want to take advantage of these words to thank the whole staff participating in this
01:48exhausting auditing process for their professionalism, and the support demonstrated, and the high
01:58training showed by the national and international experts.
02:03Following the legacy of Libertator Simon Bolivar, the Constituent Power gave birth to the nominated
02:16Judicial Power to dedicate and constitutionalize the transcendence of the public opinion in
02:26the public affairs, and in addition, it created the Electoral Chamber in the Supreme Court
02:35of Justice as an entity to discuss electoral controversies.
02:44The Supreme Court of Justice considers to reiterate the commitment and the will of providing
02:55justice to guarantee peace and tranquility of the Republic.
03:00That's why we won't stop in our sacred holy mission.
03:07In function of which, I read the final judgment that decides and concludes in a definite way
03:20the contentious appeal regarding the elections on July 28.
03:31Now I read the final judgment.
03:37For the reasons hereby exposed, this Electoral Chamber of the Supreme Court of Justice administering
03:45justice on behalf of the Bolivarian Republic of Venezuela, by the authority abided by law
03:53declared first, it is ratified the competency of this Electoral Chamber any time it was
04:02here the contentious appeal accepted to verify and validate, to certify unequivocally the
04:16results of the electoral process held on July 28, 2024.
04:23And so it is the attachment of this action in compliance with the Article 297 of the
04:33Constitution of the Bolivarian Republic of Venezuela, and the Article 27 of the Court
04:43of Justice that attributed the judicial control of actions of the parties that participate
04:54in the aforesaid election.
04:58And about the rights of elections, it is competent to say that it was asked to verify which has
05:12been the will of the turnout in the presidential elections as in which it was evident a cyber
05:26attack, a massive cyber attack against the electoral system, which resulted in a crystal
05:35clear transgression to the electoral power.
05:38And it is such competency, it is ruled by the Supreme Court, and to strengthen the electoral
05:55culture as a novelty means in this position of our citizenship for the state to guarantee
06:05its protagonism as it is stipulated in this Electoral Chamber.
06:10Beyond our borders, examining the right compared in similar situation for the election of head
06:24of state, other nations exercising their jurisdiction have issued pronouncements about the electoral
06:34controversies, as it is the case of the United States of Mexico, and they issued the judgment
06:48on the election in August 2024, declaring the elections and guaranteeing the social
07:00peace by these means.
07:02Likewise, it occurred in the last process of presidential elections held in Brazil on
07:11October 30, 2022, in which development there were claims referred to electoral fraud in
07:21which the High Court of Justice interfered as the maximum authority in electoral controversies
07:32which the court made decisions in an attempt to avoid a crisis in that country.
07:42And in the presidential elections in 2000, the results were controversial and the situation
07:59was solved by the Supreme Court of Justice.
08:06So it is clear that ahead of electoral controversies, the Supreme Court of Justice constitute the
08:17last entity for its resolution as guarantors of the state of right, and that the National
08:27Electoral Council as a ruling authority of the Bolivarian Republic of Venezuela, on August 5,
08:382024, appeared with the main rectors headed by its president, Eduardo Moro Elvis Amoroso,
08:53in compliance with this request by the electoral chamber of the Supreme Court of Justice, and
09:04they delivered all material attached to the elections on July 28, as set by the rector
09:16Juan Carlos de Opino, who didn't appear before the Supreme Court of Justice of Venezuela,
09:24and he didn't justify his absence.
09:30So having been summoned by August 8, 2024, 38 political parties have been appearing and
09:49only 33 delivered the affidavits required.
09:58The first is the Venezuelan Movement, Unidad Acción Democrática, Republican Movement,
10:07Red Flag, Derecha Democrática Popular, and so she is mentioning the political parties
10:17that appeared before this court.
10:35United Socialist Party of Venezuela, Tupamaru, Green Party of Venezuela, Electoral Movement
10:51of the People, Mfisher Party, Communist Party of Venezuela, Popular Unity of Venezuela,
10:59for the change, and likewise, of the 10 presidential candidates, 9 appeared before the court.
11:08Citizens, Antonio Carrillo, Enrique Marquez, José Brito, Luis Eduardo Martínez, Daniel
11:14Ceballos, Javier Bertucci, Claudio Fermin, Benjamin Ronceu, and President Nicolás Maduro.
11:24So it has been submitted a record that the political parties, Pencil Party, and they
11:37didn't deliver the required documents, and Enrique Marquez didn't deliver the affidavits.
11:47So it is decided that all electoral material delivered by the National Electoral Council
11:56and the political parties are safeguarded in this electoral chamber of the Supreme Court
12:03of Justice.
12:04Third, that the former candidate, Delmundo González Urrutia, didn't attend any stages
12:13of this process at which he was subpoenaed.
12:17So he didn't comply with the orders of the Supreme Court of Justice, which is the highest
12:26entity in Venezuela, and he didn't deliver any tally sheets or any list of witnesses
12:35or any electoral material whatsoever.
12:38So in consequence, he disregarded the order, and he disrespected the authority of the Supreme
12:47Court of Justice.
12:49So his behavior, that's why there are the following sanctions against him.
12:59And the citizen, José Luis Cartaya, representative of the MESA, and Simón Calzadilla, representative
13:09of Movement of Venezuela, all of them members of the Alliance, a unitary platform, a democratic
13:18unitary platform, that supports the citizen, Delmundo González Urrutia, they didn't deliver
13:27any electoral material, arguing that they didn't have any electoral documentation.
13:37So they expressed that they don't have tally sheets or any list of witnesses of the polling
13:44stations, and so it is assumed that they didn't participate in the polling stations of this
13:56election, so as contrary to what is recorded in the videos of their attendance.
14:06So national experts and international experts, it constitutes a foolproof of this contentious
14:14electoral appeal, referred to the auditing process of all the documents delivered by
14:27the National Electoral Council, in physics or digital, related to the elections on July
14:3628th, and so executed in compliance with the highest technical standards, in which once
14:50it was examined, all material collected, such auditing determined that on the grounds
14:59of the results obtained in the auditing process, we can conclude that the bulletins issued
15:08by the National Electoral Council, regarding the presidential election in 2024, are backed
15:17up by the tally sheets issued by the electoral machines of the electoral process.
15:26Likewise, these tally sheets maintain full coincidence with the registrations of the
15:33database of all national totalization centers.
15:40Fifth, this electoral chamber declares that the present contentious appeal, on the grounds
15:51of the auditing process, carried out and verified that, on the grounds of the briefing of national
16:08and international experts, highly trained, who guaranteed the maximum level of excellence,
16:18this electoral chamber certifies that the electoral material, the auditing electoral
16:26material, validates the results of the election, of the election on July 28th, issued by the
16:38National Electoral Council, in which resulted elected citizen Nicolás Maduro Moros as president
16:45of the Bolivarian Republic of Venezuela for the 2025-2031 term, and so it is decided.
16:59Sixth, it is urged the National Electoral Council to publish the final results of elections
17:08on July 28th, 2024, for the election of the president of the Bolivarian Republic of Venezuela,
17:17to be issued in the Gazette of the Bolivarian Republic of Venezuela, which is stipulated
17:27in the Article 165, which says, Article 155, the National Electoral Council will order the publication
17:42of results of the electoral processes in the Electoral Gazette of the Bolivarian Republic
17:50of Venezuela, within the 30 days after the proclamation of the elected candidates.
18:01It is submitted a certified copy of this final judgment to the Attorney General of the Republic,
18:13Tarek William Saab, to the ends that be included to the penal investigations about the irregular
18:23events that this institution anticipates, as we cited, to determine the responsibility of the case
18:38ahead of the uncertainty caused by the population of those forgery of public documents,
18:50instigation of disobedience of laws, and conspiracy. I close quotations. In virtue of
18:59documents allegedly false or forged, uploaded in the website presidential results,
19:15as well as this massive cyber attack denounced against the National Electoral Council,
19:23that could link, unleash criminal behavior and crimes against the judicial order,
19:36issued and registered and communicate and comply with the requested, signed and sealed
19:48in the Electoral Chamber of the Supreme Court of Justice,
19:55and to 200 justices, President Carisla Beatriz Rodríguez Rodríguez, Vice President Fanny Beatriz
20:08Márquez Cordero, and Justice Inocencio Antonio Figueroa, and Clerk Tiana López. That's all.
