00:00The federal court has overturned a court of appeal decision compelling a minor to undergo
00:06a DNA test to establish her paternity.
00:10Justice Zabaria Yusuf said a forced test would violate the personal autonomy of the 16-year-old
00:15girl, anonymized as C. Zabaria said it was absurd that C had a right to know her biological
00:22parents but not to object to a forced DNA test.
00:27The judge said the teenager was not even aware about the court application, which was sought
00:31by a man claiming to be her biological father.
00:35Zabaria warned that the DNA test could subject C to humiliation and stigma if it revealed
00:40she was born from her mother's extramarital affair and would impact her existing relationship
00:45with her parents.
00:46She also said the courts did not have the authority under statutory or common law to
00:50compel anyone to undergo a DNA test in civil cases.
