00:29The Republic Act No. 11210, known as the 105-Day Expanded Maternity Leave Law,
00:35is a law that aims to broaden and improve the benefits of maternity leave for women workers in the Philippines.
00:43What are the benefits and benefits of the Republic Act 11210?
00:48The 105 days of maternity leave for women workers in the public and private sectors
00:59have the right to avail of this amount of days of maternity leave with a full salary.

02:06mothers have the right to avail of 60 days of maternity leave with a full salary.
02:12There are some important reminders here.
02:14In availing of maternity leave,
02:16maternity leave cannot be excluded and should be used before or after the birth of a child
02:24and should not exceed 105 days.
02:28This means that the weekends, Saturdays, and Sundays should be counted as 105 days.
02:33These are calendar days and non-working holidays.
02:37When giving notices to your employers,
02:41the female workers need to give the first notice to their employers
02:47about their pregnancy
02:49and the planning of availing of maternity leave that should include a proof like medical certificate.
02:57In terms of payment of benefits,
02:59the beneficiaries are provided by the Social Security System or SSS
03:03and the employer has an obligation to provide a salary differential
03:09so that the workers can receive the full salary while in maternity leave.
03:15It is also possible to avail of maternity leave for women in the informal work sectors,
03:21self-employed or FWs,
03:23and with a voluntary contribution from the SSS.
03:28In terms of the payment of maternity leave credits,
03:32for example, for mothers,
03:34mothers have the option to pay their 105-day maternity leave to the father of their child
03:42even if they are not married.
03:46These are added to the seven-day maternity leave
03:50that is given under the Republic Act 8187
03:54or the Paternity Leave Act of 1996.
03:58And for the Alternate Caregiver,
04:02for example, if the father of the child is not able to take care of the child,
04:06the mother can transfer the maternity leave credit to an Alternate Caregiver.
04:12The Alternate Caregiver can be a partner
04:16up to the fourth degree of consanguinity
04:21or the current partner of the mother who lives in the same house.
04:25The transfer of maternity leave credits to others
04:29is not applicable to cases of miscarriage or emergency termination of pregnancy.
04:33There are other benefits to applying for maternity leave credits.
04:37For example, the use of first aid.
04:41The mother needs to submit written advice to her employer
04:45and to the father's employer or Alternate Caregiver.
04:50And in terms of the use of the credits,
04:54the credits can be used continuously or gradually
04:58during the maternity leave period.
05:02Through this, a mother will be given enough time
05:06and her husband will be able to focus first
05:10on their subsequent birth.
