The Kuala Lumpur Sessions Court on Tuesday (Feb 18) dismissed the application by the widow of the late former finance minister Tun Daim Zainuddin to refer questions of law regarding the validity of charges she is facing for failing to declare her assets to the High Court.

Judge Azura Alwi found that Toh Puan Na'imah Abdul Khalid's application lacked merit, as there were no constitutional issues raised in the case.

00:08widow of former Finance Minister Tundaim Zainuddin, to refer constitutional questions to the High
00:13Court. Judge Azura Alwi ruled the application, filed under Section 30 of the Judiciary Act
00:201964, lacked merit, stating, no constitutional issues arise in this case and the principle
00:27of basic justice towards the applicant is still guaranteed by law. Na'ima had filed
00:33a motion on February 29, seeking to challenge sections of the Malaysian Anti-Corruption
00:38Commission Act and the Anti-Money Laundering Act. Her challenge questioned whether certain
00:43provisions violated rights against self-incrimination and the right to a fair trial. In delivering
00:50the ruling, Judge Azura agreed with prosecutors that Na'ima's application was unfounded and
00:56disruptive. Following this decision, the Court scheduled a nine-day trial to begin
01:02on November 19. On January 23 last year, Na'ima pleaded not
01:08guilty to a charge of failing to comply with a notice to declare her assets, which included
01:14Manara Ilham, as well as several other assets around Kuala Lumpur and Penang. The Court
01:20granted bail at RM250,000 and ordered her to surrender her passport.
