Toh Puan Na'imah Abdul Khalid has failed in her bid to retrieve her passport permanently after the Kuala Lumpur High Court dismissed her application.

In his dismissal, Justice Ahmad Bache said there was no injustice in the Sessions Court's decision when it imposed additional conditions regarding Na'imah's passport.

00:11 In his dismissal, Justice Ahmad Bacis said there was no injustice in the Sessions Court
00:17 decision when it imposed additional conditions regarding Naima's passport.
00:22 The judge noted that Naima's husband, Tundaim Zainuddin, was also charged at the Sessions
00:27 Court but was allowed to hold on to his passport.
00:30 He said if Naima's passport was released, there was a possibility that both husband
00:34 and wife would go abroad and not return.
00:38 On whether or not the Sessions Court decision had contravened Naima's rights under the
00:42 federal constitution, Justice Ahmad said those rights as a citizen changed after she was
00:47 charged in court.
00:49 Justice Ahmad also said the Sessions Court decision on Naima's passport was valid, fair
00:54 and there was no injustice.
00:56 He also said Naima could liaise with the prosecution if she needed access to her passport in the
01:01 event she wanted to go abroad.
01:04 In January, Naima had claimed trial at the Sessions Court for failing to comply with
01:08 the notice by not declaring her assets.
01:12 She is currently out on RM250,000 bail and had to surrender her passport to the court
01:18 as part of the bail condition.
