00:18The House Committee on Ways and Means approved the two Chinese officials of the National Grid Corporation of the Philippines, or NGCP, to report to the Communist Party of China.

00:50The committee recommended that the NGCP chairperson be called a Chinese national.
00:56The committee also emphasized the ownership and management of the NGCP.
01:01According to the Constitution, only up to 40% of the ownership of land should be given to any public utility.
01:10But the committee said that aside from 40% of the NGCP, which is owned by the State Grid Corporation of China,
01:17there is another percentage that is held by foreigners.
01:21The Synergy Grid and Development Philippines, which owns 60% of the NGCP, has more than 7% foreign ownership.
01:31We are also questioning the legality of their stature,
01:38because they are violating the law of the PSA, as well as the Constitution,
01:45as well as the 60-40 ruling when it comes to public utilities.
01:49The NGCP is also reviewing the payment of taxes.
01:53For now, the NGCP is only paying franchise tax.
01:58Unlike other public utilities, which also pay corporate income tax, VAT, and others.
02:06Is that enough to revoke the franchise?
02:08I think there needs to be a reorganization to re-establish the Philippine ownership of NGCP.

02:18We request that NGCP give it time to submit a response to address the concerns of the committee.
02:25The committee also pushed for a retroactive refund of the National Grid Corporation of the Philippines to consumers.
02:33This includes the disallowed expenses of the NGCP and the 3% franchise tax of the NGCP
02:40allowed by the Energy Regulatory Commission to be paid to consumers in 2011.
02:47In 2018, the commission reversed the decision.
02:51But the refund was only decided in 2023.
02:55What the committee wants is not only the 204 billion pesos that the NGCP earned
03:01from 2016 to 2020 to be paid to consumers,
03:06but also a retroactive refund of the franchise tax paid to consumers since 2011.
03:14That's almost 3 billion.
03:17So, the franchise tax to ordinary consumers.
03:22Sir, but it looks like the PRC is not amenable because they said their resolution is for 2023 onwards.
03:29We suspended the passing on of charges moving forward, so from the August 2023.
