00:00At Punto de Vista, Professor Antonio Conteras will discuss how confidential funds of an agency can be easily abused.
00:08Professor.
00:14Thank you very much, Dayan, and good morning.
00:18Many people ask if confidential or intelligence funds are legal.
00:22We are saying that it is legal.
00:25And there is also the DBM Circular that was issued on January 8, 2015.
00:312015-01 Joint Circulars that were signed by the Department of Budget and Management,
00:37the Commission on Audits, the Department of National Defense, the DILG, and the Governance Commission of the GOCC.
00:44So therefore, there is a guideline for this.
00:47But it is also clear that it was abused.
00:52We saw in the hearing of the committee,
00:56that only 16 million pesos were spent every day to pay the rent of a safe house of 34 or 36 safe houses.
01:07Millions of pesos were spent every day on the medicines and food of DILGs.
01:14So this is clearly an abuse.
01:16But how did it become legal?
01:18Because if we read the DBM Circular,
01:21we were told by the COA,
01:23that the auditing mechanism is different when it comes to confidential and intelligence funds.
01:29There are special provisions or special procedures
01:32where it is not used for ordinary auditing.
01:37That is why many are wondering, especially those of us who work in the government,
01:41we know that it is disallowed.
01:43Sometimes, even if it is a 13th month pay or bonus,
01:47it is disallowed.
01:48The expenses of the projects are disallowed.
01:51Because it is being audited.
01:55The COA is auditing and assessing our expenses
02:00because it is the money of the people.
02:02But here in the confidential and intelligence fund,
02:05it is as if they spent millions of pesos in one day.
02:09But this is the money of the people.
02:11That is why what the COA said yesterday in the hearing is correct.
02:15Maybe it is time to review that Joint Circular.
02:19We understand that when it comes to intelligence funds,
02:22it cannot be done publicly.
02:24It cannot be left out because there are national security issues.
02:29But the confidential fund that we are giving
02:32to the NGAs, National Government Agencies,
02:34that really don't have a job related to intelligence,
02:37that is one way for us to implement it better.
02:42Because we are not taking out the expenses of the confidential
02:46and intelligence fund.
02:49But we are taking out the holes so that it can be abused.
02:54We are supporting and we should support
02:57the strengthening and revising of this DBM Circular
03:01so that in the coming days, it will not be abused.
03:05And we will be able to avoid the unreasonable
03:08and surprising expenses that are not real.
03:13And it is not millions anymore.
