00:00Next, we will hear from the Senate and Congress about the major issues in the country
00:06like smuggling and abuse in aid of legislation.
00:12But why is this important and what will the public benefit from it?
00:17This is what Professor Antonio Contreras will tell us in Punto de Vista, Professor.
00:22Thank you very much, Dayan, and good morning to all of you in the studio.
00:33It has been a long time since Congress or the Senate or the House of Representatives
00:40established that there is a right to conduct an inquiry in aid of legislation.
00:43Because their job is to make laws, and before they can make laws,
00:48they need to study the issue.
00:50Or they need to review the current laws to see what is lacking,
00:54is there a gap, is there anything that needs to be changed.
00:57And because of this, they need information.
01:00That is why they conduct an inquiry, to gather information.
01:07And it has been a long time since we accepted and established,
01:11even by the Supreme Court, that Congress has a right to cite contempt,
01:15especially those who are invited as resource persons or witnesses,
01:19because it is interchangeable,
01:22they do not say the truth or their process is obstructed
01:27or does not appear in the invitations.
01:30And especially, they are not able to find the right information
01:34because of what the resource persons and witnesses are doing.
01:39Because what is important here is to get the right information
01:42in order to make laws.
01:44That is the purpose and purpose of these hearings.
01:49It is saddening because now we can see what is happening.
01:55Congress has run out of time in listening
01:59and sometimes the questions are not relevant
02:03when it comes to discussing the violation of the law.
02:06And we continue to see people lying again and again.
02:11Resource persons who do not tell the truth
02:15to questions that are not relevant to the law.
02:19What is the effect of this?
02:22The effect of this is that the legitimacy of this hearing is lost.
02:27In the eyes of the people, it seems that the resource persons are not taking it seriously.
02:32They are smiling and making faces.
02:34And the effect is even worse because
02:38we can clearly see how the Vice President
02:41has a high view of the House of Contents
02:44but is not a site for contempt.
02:46So, there are mixed messages here.
02:50Other congressmen and senators are abusing their privileges.
02:55They are exploiting their resource persons.
02:58But some of them are only on the site of contempt,
03:01while others are not.
03:02Just like the high positions like the Vice President.
03:06The Congress should be careful
03:09that because of this,
03:11the hearing in aid of legislation is not done properly.
03:16The legitimacy of this is lost in the eyes of the people.
03:20It seems that the congressmen are becoming trigger-happy
03:23when they are on the site of contempt.
03:24I don't understand why they have to force the witnesses
03:28who know that they will lie.
03:30Is that the only source of truth?
03:34For example, the Senate knows that
03:38according to their documents,
03:40Alice Goh is not Filipino.
03:42There is documented evidence.
03:45There is the signature, the thumbprint, everything.
03:48It says that she is not a Chinese national.
03:51Why does she still need to be admitted?
03:54Isn't that the only source of truth?
03:57And they go to other resource persons,
04:00other issues, and other personalities
04:03The job is to take care of the well-being of the people
04:06because those are government officials.
04:08You know, you know what I can say.
04:12Maybe we should look, the congressmen or us,
04:15we should look and examine properly
04:18how these hearings in aid of legislation are really done.
04:22We have a process.
04:24That is taken care of by the court of law,
04:27their rules, and the Supreme Court said that it is right.
04:32But let's look at what is happening in the United States.
04:35In the United States, their congressmen cite contempt.
04:38But their contempt citations are approved by the entire plenary.
04:43And that's not all.
04:45The contempt citations in the US Congress
04:48are a form of appeal.
04:50They will appeal the one they cite in contempt to the court.
04:54And the court will decide if the person should be punished.
04:57Because of the court, there is a due process,
05:00they will give arguments, they will give rights for the lawyers to object.
05:04Because of what is happening in our country, let's think about it.
05:08The congressmen are the complainants in the contempt citations.
05:12They are the judges.
05:14They are the executioners.
05:16I don't think that is right in a democracy.
05:19That only happens in authoritarian systems.
05:22I repeat, let's reflect and study what is happening now
05:27and to the current congressmen and senators.
05:31Let's be careful not to lose the dignity of the people
05:36in the process that is very important
05:39in upholding our democracy
05:43and the well-being of the citizens of the Republic.
05:47That's all for Punto Libista for today.
05:49Back to you in the studio, Dayan.
05:53Thank you very much, Professor Contreras.
