00:00The first thing that came out of the news was the possible re-election of Dismissed Mambantarlak Mayor Alice Buo.

00:06But can she still be a candidate again?

00:09This is what Professor Antonio Contreras will discuss in Punto de Vista, Professor.

00:27Can she be a candidate?

00:29Well, the question is if she can file her Certificate of Candidacy.

00:34According to my research, she can.

00:37That's why a lot of people are asking, why is that?

00:40On the left and right, there are cases that were filed against her or were planned to be filed against her.

00:46The information that came out of the various hearings of the Congress,

00:50whether it's the Senate or the lower households,

00:53it was proven that she was involved in illegal activities in her town,

01:03and that she is not a Filipino.

01:06That she is not a Filipino citizen.

01:09So the answer to that is this.

01:11Our system is presumption of innocence.

01:15As long as a person has not yet been convicted,

01:18the presumption in the law is that he is innocent and not guilty.

01:23This also proves that the information we obtained from the Senate hearings is not final.

01:32It is not valid if we look at the issue of the legal process of disqualification.

01:38Because the purpose of the hearings in the aid of legislation,

01:42because we saw the evidence that Alice Goh is not a Filipino,

02:33Komelek can initiate a motu proprio.

02:36It does not mean that Komelek will file her own motu proprio

02:40when no one is complaining.

02:42Or any interested party can also file their own motu proprio.

02:46Evidence can be used against her,

02:49especially if she is not a Filipino citizen.

02:53Because they can cancel her COC

02:55because we have what we call misrepresentation.

03:00There is a case where if you misrepresent your identity

03:05and you file your COC that you are a Filipino,

03:08and it is proven that you are not a Filipino,

03:10Komelek can cancel that COC.

03:14And only Komelek can make that decision.

03:18And it is not final.

03:20Because Alice Goh can be dismissed from the Supreme Court.

03:26And the Supreme Court has a final say on that.

03:29So the process is still long.

03:32But even if it's long, we still have a remedy.

03:36And let's let the law, let the courts decide

03:40on the validity of Alice Goh's candidacy.

03:45But I repeat, she can file her COC.

03:50Our Solicitor General, Solicitor General Minarto Guevara, said she can.

03:56Because her dismissal is not yet final

04:01according to Ombudsman.

04:04And the cases filed against her are not yet final.

04:14But only Komelek and the Supreme Court can decide on that.

04:18If Alice Goh loses to Komelek

04:22and says that she is not a Filipino,
