00:00Philippine Creative Industries Month.
00:02This year, we will be talking with Atty. Anne-Claire Cabochan,
00:08Deputy Director General of the Intellectual Property Office of the Philippines.
00:13Atty. Cabochan, good afternoon.
00:17Good afternoon to you too, Ms. Ninia, and to all the listeners and viewers.
00:24Atty., for our countrymen to understand better,
00:27what is Philippine Creative Industries Month,
00:31and what is its purpose and importance in our cultural and economic landscape?
00:39Philippine Creative Industries Month is included in the Philippine Creative Industries Development Act, or PISIDA.
00:49So, every September, from the time the PISIDA was passed into law,
00:55it is reserved for Philippine Creative Industries.
01:01So, throughout the month, there are a lot of activities for us to support and strengthen our creative industries.
01:11So, it is included in the Republic Act 11904.
01:16The purpose of celebrating Philippine Creative Industries Month is to strengthen our creative industries.
01:26Our creators, performers, and artists will understand their rights and responsibilities as creators.
01:41And we, as Filipino citizens and citizens of the Philippines, will appreciate the creative industries more.
01:51Who is the organizer of the Creative Industries Month,
01:56and what is the theme of this month-long nationwide celebration this year?
02:02Under the law, the Republic Act 11904, there is the Philippine Creative Industries Development Council.
02:11That is the overall policymaking body that is really implementing the Philippine Creative Industries Development Act.
02:21They are primarily responsible for all the activities during the September Philippine Creative Industries Month.
02:30Now, their lead agency is the Department of Trade and Industry,
02:36but the Intellectual Property Office of the Philippines is one of the ten agencies
02:42that is a member of the Philippine Creative Industries Development Council.
02:47Okay.
02:48So, what is the specific role and contribution of the Intellectual Property Office of the Philippines in this celebration?
02:57Ms. Nina, I forgot because you asked about what the theme was.
03:01So, for this year, the theme is, we are a creative nation.
03:06I really want to highlight that because according to the Philippine Statistic Authority's 2023 figures,
03:16our creative industries contributed 7.1% to the gross domestic product.
03:24So, the value of creative industries in 2023 was more than Php1.7 trillion.
03:35In the workforce, 7.26 million Filipinos are part of the creative industries.
03:42So, that sector is important.
03:46Intellectual property is very important for us to strengthen our creative industries.
03:56Our creators look for products, services, and goods.
04:07This comes from their own minds.
04:14That's why it's called intellectual property because we consider it as a rich mind.
04:21IP in intellectual property has a big role to play because just like any kind of property,
04:32our personal and real properties, IP needs to be protected.
04:39Because if we don't protect it, it can be taken by other people or even other entities that have nothing to do with creating.
04:52And our creators, instead of being able to give credit, their name in the creative industries changed
05:01and if they see it, they won't be able to benefit from it if it's not protected by IP.
05:10So, attorney, what are the intellectual properties, can you give us examples, that are affected in our creative industries?
05:21And what are the copyrights that are affected?
05:24First, I would like to really zero in on copyrights.
05:30Because our copyrights include books, songs, sculptures, paintings, even performing arts, even computer programs.
05:45Those are considered as copyrights and related rights.
05:50Now, the copyright is created by the artist or creator himself.
06:02So, for instance, for a painting, it's the painter who creates it.
06:06The sculptor creates the sculpture.
06:09If you are a composer, you are also the one who creates the composition or song.
06:17So now, this is what we call, they are capable of being registered as a copyright.
06:28Although, the registration does not need to happen for it to be considered as copyright.
06:36So, it is protected from the moment of creation.
06:40Now, at IPOFIL, we are telling them to register so that you have a document showing that you are the owner of the painting, song, dance,
06:58maybe if you are a playwright, the play that you are making, you are the owner of that.
07:04So, it is already of a public record, it is a registration, and you are protected when it is registered.
07:13So, for our creative industry to understand better, what kind of protection will it give so that we can allow them to register?
07:25And how does the creative industry include other types of intellectual property?
07:34Now, for instance, when we come to think of writers of books, they are protected from the moment of creation,
07:44but if they are registered through the Bureau of Copyrights and Related Rights,
07:51they will have constructive notice to the world.
07:57And for instance, if they want to get a license or reproduce a certain portion or probably make it into a film,
08:07the other businesses or entities will know who they will approach.
08:16And what they will see is the real owner of the intellectual property.
08:23So, copyright is just one of them.
08:28Although, there are also other intellectual property that is still related to creative industries like trademarks.
08:39Trademarks are like branding so that a product will be recognized.
08:46So, the trademark or utility model or industrial design, for example,
08:53the furniture that a lot of Filipino furniture designers around the world are familiar with,
09:02their creation can be registered as an industrial design.
09:07So, the outer appearance, even the bottle, like soft drink bottles, they have a certain bottle,
09:19that can also be an industrial design.
09:22Utility models or even patents, they can still be applicable in our creative industries.
09:32But really, when we talk about the domains that are included in the Republic Act 11904,
09:40most of them are really under copyrights and related rights which are protected from the moment of creation.
09:49And along with the PCIM celebration this year, you will launch the Creative Industries website.
09:57Can you give us more details about this?
10:01Ms. Nina, actually because the lead agency here is DTI, they would be in a better position to talk about that.
10:08But just to say that for this celebration of Creative Industries Month,
10:14the Philippine Creative Industries Development Council launched the website.
10:20It is a one-stop shop.
10:23So, if you visit www.philippinecreativeindustries.com,
10:28you will see a lot of information there.
10:32There are creators, even creative businesses, government agencies.
10:38If you need funding, and maybe you can tap for funding, you can see it there.
10:47There are a lot of interactions happening on the online platform if you visit that platform.
10:56And it also shows all the activities that are ongoing for this month.
11:02Okay. For those who want to visit the Philippine Creative Industries Month this year,
11:09where and how can they register?
11:17If you go to the Philippine Creative Industries website, the one-stop shop,
11:25there will be links there that will allow you to register for a particular activity.
11:31So, please visit that website so you can access all the activities for this month
11:38and register for the activity that you want to be a part of.
11:43Attorney, where is the main venue for these activities?
11:48Or where are the venues?
11:52Actually, Madam, the venues are different.
11:55Because we are also in the Intellectual Property Office of the Philippines.
11:59As one of the agencies, a member of the Philippine Creative Industries Development Council,
12:06we also have activities that are being rolled out in support of the Creative Industries Month.
12:13So, our bureaus have seminars on basics of IP or even on IP valuation and commercialization
12:24because we want the creations to know how to value.
12:31So that they also know if they will sell or license it,
12:35that they have an idea of what it is worth so that they will not be shortchanged
12:41in their savings of sweat and time.
12:46And in our other activities, the venues are different
12:56because the opening of Misnina was at Trinoma Mall Activity Center.
13:03We wanted, well, I think that the council really wanted that it is something that is close to all Filipinos.
13:14So, if it's in a mall, people can pass by.
13:18So, that was the opening of Creative Industries Month.
13:24There are many other activities all over the country that you can see on the website that we are mentioning.
13:33And whether you are in the Visayas or Mindanao or NCR, you can go to activities.
13:41And for the part of the IPO Phil, we have an activity not in September but in support of Creative Industries.
13:50This is the second Philippine Copyright Summit that will take place from October 21 to 25 in Novo Telpo.
