00:00As is often the case with high-profile suspects, the issue on rightful custody arises.
00:06This is exactly the situation with dismissed Bamban Mayor Alice Guo
00:10as concerned agencies debate where she should actually be detained.
00:14Luisa Arispe has more.
00:19One of the openly discussed issues right now is the question on the jurisdiction of custody
00:24for former Bamban Tarlac Mayor Alice Guo.
00:27This due to several pending charges and complaints against her by different petitioners
00:33and in many courts of law or venues.
00:36But the Department of Justice believes Guo should remain in the custody of the Bureau of Immigration
00:41because she is facing charges for violation of immigration laws.
00:46If there is someone who should be detained by Alice Guo,
00:51it should be the Bureau of Immigration.
00:54Because an immigration case takes precedence over everything.
01:01If we are going to prove it, an immigration case should take precedence over everything.

01:09It is clear that we are dealing with an immigration case.
01:13And that's very, very important.
01:15Immigration case has a primacy over all others.
01:19Guo is also facing violations of Philippine Passport Act
01:23for allegedly being an illegal alien and her misrepresentation of her true citizenship status.
01:28Remulia stressed, Guo may be subjected to deportation over these cases
01:34which take ascendancy or primacy over her other cases.
01:38Remulia also stressed being worried that Guo may end up in custody of Tarlac Regional Trial Court
01:44considering her anti-Grafton corruption case was filed there by the Ombudsman.
01:49Remulia said it is hard to disregard the extent and power of Guo's influence in her home province.
01:55She would be more influential in that area which has been in her sphere of influence
02:01because she's the mayor of a town in the province where she's being taken as a detainee.
02:07That's why I have discomfort since the beginning of this case.
02:13As of now, Remulia has already written a clarification letter
02:17asking the Ombudsman for guidance on why the case was filed in a Tarlac RTC
02:22and they are waiting for a response.
02:25Meanwhile, one of the alleged cohorts of Alice Guo, Cassandra Lee Ong,
02:29has sought the help of the Supreme Court for the Congress
02:33to recognize her right against self-incrimination in the QUADCOM hearings.
02:38In the petition for certiorari filed by her party, they insist Ong has the right to remain silent.
02:44There are things that we believe violate the constitutional rights of our client, Ms. Cassandra Lee Ong.
02:53That is what we are stopping, especially our invocation of the right to remain silent
02:59and the right against self-incrimination.
