00:00A private college has been ordered to pay 17 lecturers a total of almost 1.4 million
00:07ringgit as compensation for unfair dismissal after the industrial court held it was unclear
00:12whether their retrenchment was justified.
00:14Court Chairman Nurfawza Mokhtar said she was not satisfied that the lecturers' position
00:19at Widat College had become redundant to justify their retrenchment, and was not convinced
00:23that the selection of the lecturers was made in line with the general principles of retrenchment.
00:29She said Widat Education Sindhiyan Berhad, which operates Widat University College and
00:33Widat College, did not show evidence of significant cost-cutting measures and did not offer the
00:38lecturers alternatives to dismissal.
00:40She added that no clear retrenchment criteria were provided and that the dismissals appeared
00:44not to be in good faith.
00:47The lecturers, who had served around four years, were retrenched on June 30, 2021 without
00:52prior notice or discussion about the college's financial situation.
00:56Despite the college's claim of financial losses, it continued to organize events which
01:00the lecturers cited as evidence against the college's financial hardship argument.
01:05They were awarded compensation for reinstatement, back wages, and unused leave, with individual
01:10amounts ranging from 51,150 ringgit to 114,767 ringgit.
