00:00The Suprema Court declared that the assault on an employee
00:04due to being positive to the Human Immunodeficiency Virus or HIV
00:10in a decision written by Associate Justice Benjamin Caguiwa,
00:14the third division of the Supreme Court decided
00:18that dismissing a former overseas Filipino worker
00:23because of this is discriminatory.
00:26The respondent will also receive a salary
00:30from the unfinished part of his two-year contract
00:34and the respondent will also receive moral and exemplary damages.
00:39The Supreme Court also stated that the Philippine law will still apply
00:43even if the laws implemented in other countries
00:46in his contract violate our laws.
00:50In 2019, when he underwent a routine medical exam
00:55and the respondent tested positive for HIV,
00:58the respondent was dismissed from his foreign employer
01:02because of the laws in Saudi Arabia
01:05where a person who tested positive for HIV is considered unfit to work.
01:10Under Section 49, Paragraph A of Republic Act 11-166,
01:16the Philippine HIV and Age Policy Act violates the law
01:20to dismiss an employee because of his HIV status.
