00:00An ICC-accredited lawyer was arrested following the arrest of former President Rodrigo Duterte.

00:08He was accused of giving justice to victims of war on drugs.

00:13This is what Kenneth Paciente reported.

00:17It was the International Criminal Court accredited lawyer, Atty. Joel Butuyan, who said

00:22that the process of arresting former President Rodrigo Duterte was followed.

00:27The court order from the Philippine Court of Appeals was rejected yesterday

00:33before the former President was arrested.

00:35Butuyan explained that there is no power of a domestic judicial authority

00:40to question an arrest warrant from an international body like the ICC.

00:45What he can do is to point out who the subject of the arrest warrant is

00:49and make sure that his rights are respected.

00:52Something that was given to the former President.

00:55He was given Miranda Rights.

00:57So that's pursuant to our domestic law on arrest.

01:01And then he has a lawyer there.

01:03Not just one, but two.

01:04We fully complied with our domestic law

01:08because the Philippine government has the discretion to directly surrender

01:13the suspect to the international court.

01:16Okay, so the court order is no longer needed, as you said.

01:21According to our law, the court order is no longer needed.

01:24Atty. Butuyan also argued that the arrest warrant was not warrantless

01:28because he showed a valid electronic arrest warrant from the ICC.

01:33According to our law, the physical warrant of arrest, the time of the arrest,

01:39does not need to be shown.

01:40For as long as there exists a warrant of arrest.

01:43In fact, we can have an e-warrant as stated in the revision of our Rules of Court.

01:52Even in the ICC, the physical warrant of arrest does not need to be shown

01:58because it can be e-warranted.

02:00In fact, the proceedings of the ICC, even their trials, are all paperless.

02:05Everything is e-documented.

02:13Because of that, it does not matter if the former President received a Diffusion Notice or a Red Notice

02:19when he was arrested.

02:21So whether it's a Diffusion or a Red Notice, it doesn't matter

02:27because the Red Notice gives a shotgun to all the members of the Interpol.

02:36Diffusion is usually country to country.

02:39But regardless of the terminology, the Interpol is just a coordinating agency.

02:47The important thing is that the Interpol gave us a valid warrant of arrest,

02:52regardless of how it gave it to us.

02:54But is it possible for the former President to return to the country?

02:57I don't think he can return.

02:59Either he will be dismissed from the case or he will be given an interim release

03:03which I think is very, very slim.

03:07The Palace has also given, and the current administration will approve,

03:10the giving of justice to the victims of the drug war.

03:14Now, we are seeing how the administration is working.

03:19Maybe it's just a coincidence that there was a case in the ICC

03:23because justice was served to other people.
