00:00The Writ of Habeas Corpus Petition that was filed by the brothers Paulo, Veronica, and Sebastian Duterte

00:07in the Supreme Court for the former President Rodrigo Duterte,

00:11according to the Department of Justice,

00:13in the case of the D.O.J. Consolidated Compliance in the High Court,

00:17they said that the petition is invalid because the former president is not in their custody.

00:23The agency also insisted that the petition has no merit because the Writ of Habeas Corpus

00:28is only for those who were illegally arrested and not for those who went through the judicial process.

00:34The D.O.J. also added that the transfer of the former president to the High Court is in accordance with the law.

00:40The Republic Act No. 9851 or the Philippine Law on Crimes against International Humanitarian Law states in Section 17

00:46that the government may no longer investigate if an international tribunal has a case against an individual.

00:56The Philippines may also extradite an accused or a suspect in the case.

01:01After the D.O.J. submitted the petition to the Supreme Court,

01:04there was a special session of judgment and they decided

01:08that the Duterte's camp will be given five days to ask the D.O.J.'s answer.
