(Adnkronos) - "Con la nostra battaglia legale, i legali di Anief sono riusciti ad arrivare in Corte di Giustizia Europea che dirà se sono state violate le norme europee, in particolar modo sul principio di non discriminazione, rispetto a questo personale di docenti che lavorano nel sistema paritario. Se dovesse essere positivo, la sentenza dei giudici di Lussemburgo sarà vincolante per i giudici nazionali”. Così Marcello Pacifico, presidente nazionale Anief - Associazione sindacale professionale, ai microfoni dell’AdnKronos, riguardo al reclamo del diritto a conservare l’anzianità di servizio da parte dei docenti del sistema paritario, rinviato alla Corte di Giustizia Europea, per stabilire se sia stato o meno violato il principio di non discriminazione tra lavoratori dello stesso settore, sancito dagli articoli 20 e 21 della Carta dei diritti fondamentali dell’Unione Europea, firmata a Nizza il 7 dicembre 2000. La sentenza da parte della Corte di Giustizia Europea è prevista il 12 marzo.

00:43Yet, after 2000, after the law that instituted the national education system changed
00:48the name from equal to equal, it would seem that it is no longer possible to recognize
00:54this service.
00:55For this reason, however, we continued our legal battle through the Padua Tribunal,
01:00where the legal experts managed to reach the European Court of Justice.
01:04The European Court of Justice will say whether the European norms have been violated,
01:09in particular on the principle of non-discrimination, compared to this staff.
01:13If it should be positive, the sentence of the judge of Luxembourg will be binding for
01:18the national judges.
01:20What does this mean?
01:21That the law remains as it is.
01:23However, those who will appeal may ask to disapply the law and apply the principles
01:28of the sentence.
01:29So, we all look forward to this, which is the umpteenth battle that ANEF is fighting
01:34for all the school staff.
01:36These are the last days to present their candidacies for the next RSU elections,
01:40a fundamental appointment for all the school staff.
01:44Why?
01:45Because in addition to voting for the RSU, which will change, will write with the school
01:49staff the next contracts of the institute for the next triennium, the vote that is given
01:53to the candidate is given to the union list in which it is presented.
01:57We remember that one can run for office even if he is not registered in the union,
02:02and therefore, however, the vote given to the candidate is the vote given to the list.
02:06What does this mean?
02:08That at the end of these elections, the degree of representativeness of each union will be measured,
02:13which is that useful data that is then used for the signing of the contracts.
02:16It is enough to think that at the moment, in the public employment, only the contract
02:20for the employees of the ministries, that is, of the central functions, has been signed,
02:24while the other contracts on health and local functions, therefore the regions, the municipalities,
02:29have not been signed because 51% of the unions that agree with this signature have not been reached.
02:35So, when we launch this appeal as ANEF, why do we do it?
02:38Because we want to carry out the instances of the school world, we want to carry out
02:43some fundamental battles, such as, of course, an indemnity of residence and leave of absence,
02:49which could be approved by the Parliament for those who work in the local communities,
02:53but in general for all those who work in residences and leave of absence
02:57or, in any case, far from their homes, an indemnity of transfer.
03:01Also, to restore the first salary level that existed until a few years ago,
03:06in the class 3-8 for unemployed people, who today have to wait 9 years to be able to take office,
03:11the good meals, which is a fundamental thing for us, which is the only staff that is excluded,
03:16and this. Then, of course, we want the recognition of the burnout.
03:19We have collected 120,000 signatures to go to retirement,
03:23as well as the staff of the Armed Forces of the Army, and to have the free ransom
03:27or the easing of the years of graduation.
03:29These are appeals that we launch to politics, we want this burnout to be recognized,
03:33we want to have the same dignity as the other staff.
03:36We have noticed that, unfortunately, in recent years, the staff of the school earns less
03:41than the staff, for example, of the ministries, when before it earned more,
03:44now it earns 6,000 euros less. We do not understand the reason,
03:47we want to make our battles, certainly, to improve all the school staff
03:52and therefore to value all, from the support teachers to the ATA staff,
03:56which is very often forgotten.
