00:00The Petaling Jaya Sessions Court on Monday dismissed the preliminary objection raised
00:05by the parents of the late Zain Rayyan Abdul Mateen in their child neglect trial.
00:10The court ruled that the charge against Zaim Ikhwan Zahari and his wife Ismaneera Abdul
00:15Manaf, both aged 30 years old, was not defective and was in accordance with legal provisions.
00:21The court said there is no element that indicates the accused are denied a proper defence.
00:26It added that therefore, the hearing will continue as usual.
00:30The defence team said the elements of neglect were not sufficiently detailed, therefore
00:35placing the accused at a disadvantage.
00:38They asked if the accused allowed their child to run away or left him unattended, as those
00:43are the details that should be included in the charge.
00:46However, the prosecution said at this stage, it was not necessary to specify the precise
00:51manner in which the alleged neglect occurred.
00:54In June last year, Zaim Ikhwan and Ismaneera pleaded not guilty to a charge of neglecting
01:00their autistic child in a manner that may have caused physical harm.
01:04The offence allegedly occurred in Damansara Damai on December 5th in 2023.
01:10Zain Rayyan was reported missing and his body was discovered in a stream near his home at
01:15Edaman apartment the following day.
