00:00After the new year and Christmas,
00:03as well as the next typhoon,
00:05during this time,
00:07many are in need of help and are asking for donations.
00:13But what if your donation
00:15ends up in the wrong hands of the wrong person?
00:18Now, online donations are popular.
00:20It's easier to be victimized by fake charity scams.
00:24Be careful with fake donations.
00:27Find out how to find out
00:29if a charity organization is legit
00:32or if it's just a scam.
00:35Be informed and be vigilant
00:37here at MIL-101.
00:43It's sad to think about it,
00:45but there are people who are victimized
00:47by other people's kindness
00:49through begging donations and charity.
00:51To avoid that,
00:52and to know the punishment
00:54for fake charity scams,
00:56let's talk to Atty. Tony Romain.
00:59Good morning, Atty.
01:00This is Proffy.
01:01Welcome to Rise and Shine Philippines.
01:03Or should I say, welcome back, Atty.
01:06Proffy, how are you?
01:07Good morning to you.
01:08Happy New Year to the cast of Rise and Shine.
01:11I'm doing good.
01:12How are you, Atty?
01:13Thank you so much for having us.
01:15Happy New Year.
01:17Let's go further with the question, Atty.
01:20What are the common ways
01:22that scammers use
01:25to pretend that
01:26charity organizations
01:28are really helping people
01:30to ask for money?
01:33You know,
01:34the common ways they use
01:35are not different from ours.
01:36Many of us have experienced this.
01:39First of all,
01:40there are fake websites
01:42or social media pages.
01:43It's very easy
01:44to create a social media page
01:46on Facebook
01:47and use other pictures
01:49that are generic
01:50to pretend.
01:52That's one form.
01:54Another one is
01:55when we receive text messages
01:57with links.
01:59Many people receive those
02:01especially during Christmas.
02:04Less common
02:06are the phone calls.
02:08There are also
02:10street scams
02:11where there are face-to-face solicitations
02:13that you can bring home.
02:16There are also social media fundraisers
02:18on Facebook or GoFundMe
02:20for example.
02:23There are also overpriced
02:24charity merchandise
02:25like fundraisers for a cause.
02:27But actually,
02:29scammers don't benefit
02:31from those.
02:35These are the common ways
02:37that we use
02:39especially on social media.
02:41We use social media
02:42for scams.
02:44Atty.
02:45How can we know
02:46if a charity organization
02:48or a cause
02:49that asks for donations
02:50is legit or a scam?
02:52Are there red flags
02:54that a charity post is fake?
02:56Tell us more.
02:58The first one is
03:00on Facebook.
03:01We know that it's easy
03:02to create a Facebook page.
03:04Sometimes,
03:06the profile picture is so beautiful
03:08that it's so beautiful.
03:10It could be a generic photo.
03:12There are ways to verify that.
03:16For example,
03:17you can reverse search
03:19on Google Images
03:21to know if you used
03:23a generic photo.
03:25I would go slow
03:27on texts and email scams.
03:29Don't click on them.
03:31If a charity organization
03:33like BSWD
03:35or Caritas or Red Cross
03:39go straight to the source.
03:41Call these
03:43charities
03:45to know if there's
03:47a fundraiser or solicitation
03:49that they're doing.
03:51Aside from that,
03:53if it's more personal
03:55like by phone or face-to-face,
03:57they usually send you money.
03:59So, don't
04:01ask for donations.
04:03They're very emotional
04:05and it's heart-wrenching.
04:07But, as they say,
04:09do not make an emotional decision.
04:11Investigate first.
04:13Those who are soliciting
04:15should have a permit from BSWD
04:17to solicit.
04:19Or they should have
04:21a Philippine Council for NGO
04:23Certification.
04:25Or if they're claiming
04:27that they're a company,
04:29they're SEC-registered.
04:31These are the things we can look at.
04:33Another sign,
04:35for example,
04:37spam emails
04:39or Facebook pages.
04:41There are grammatical mistakes,
04:43misspellings,
04:45too much space,
04:47unorganized text.
04:49These are the signs
04:51that those pages
04:53are likely to be spammed.
04:55There,
04:57what Atty. mentioned is very specific.
04:59Even the content
05:01and being vulnerable
05:03on social media,
05:05we need to be smart
05:07so that we won't be fooled,
05:09especially by those types of
05:11peck-and-charity organizations.
05:13How can we protect against
05:15peck-and-charity scams?
05:17What is the solution here?
05:19The trick here
05:21is a scam.
05:23It's penalized under
05:25the revised Penal Code, Article 315.
05:27If you're charged with a crime,
05:29you can be imprisoned for up to
05:316 years and be fined
05:33equivalent to
05:35the fine.
05:37Now, if you use it,
05:39because we live in an age of social media,
05:41most of the schemes
05:43and scams are done
05:45using online,
05:47the penalty increases
05:49if you violate the
05:51Cybercrime Prevention Act of 2012
05:53by 1 degree.
05:55That means if you're jailed for up to 6 years,
05:57you'll be jailed for up to 12 years
05:59aside from the fine
06:01ranging from Php 200,000 to Php 1,000,000
06:03depending on the severity of the case.
06:05We are also protected
06:07by the Consumer Act of the Philippines
06:09or R.A. 7393
06:11which is for
06:13misleading charity drives.
06:15I was jailed for imprisonment
06:17up to 6 months
06:19and a fine ranging from Php 500,000
06:21to Php 10,000.
06:23Presidential Degree 1564
06:25also requires
06:27a Solicitation Permit Law
06:29that whoever is asking
06:31for a donation must get a permit
06:33from the DSWD
06:35or Department of Social Welfare and Development.
06:37Those who violate the law
06:39may be jailed for up to 1 year
06:41and a fine ranging from
06:43Php 1,000 to Php 10,000.
06:45Those are the
06:49applicable laws.
06:51But the most basic one is the
06:53ESTAPA, either committed
06:55under Article 315
06:57if it is not done online
06:59or if it is done online or using computer gadgets
07:01then as a violation
07:03of the Cybercrime Prevention Act of 2012.
07:05So,
07:07to our RRSP,
07:09I hope we don't have
07:11RRSP scammers,
07:13but to those who are used to being scammed,
07:15if you are in front of the police,
07:17it's up to you,
07:19you can face them.
07:21So Ernie, what steps
07:23should we take
07:25from the public
07:27if they receive a lowly solicitation
07:29or if they were fooled
07:31by a pecking charity, where and how
07:33should we start?
07:35First, verify the charity.
07:37If it mentions
07:39Red Cross,
07:41DSWD, or any
07:43organization, then go straight
07:45to the organization
07:47if there is a fundraiser
07:49or solicitation.
07:51You can also
07:53search on the internet.
07:55For example,
07:57let's say ABC Corporation
07:59is soliciting. Put ABC Corporation
08:01on Google
08:03Scam as an additional search
08:05term or fake.
08:07Maybe there are people who are already complaining.
08:09There are reviews.
08:11But what are these reviews?
08:13Is this legit or not?
08:15The internet
08:17is a rich source of information that we should
08:19use.
08:21The profile pictures
08:23I mentioned earlier,
08:25you can reverse image search
08:27on Google Image.
08:29You can
08:31look for information
08:33on the
08:35solicitation.
08:37Do they have a permit from DSWD?
08:39Are they SEC registered?
08:41If they are SEC registered, you can
08:43go to the SEC webpage and
08:45search
08:47if they are really SEC registered.
08:49These are the things
08:51you can do.
08:53Or you can also
08:55go to the victim's account
08:57or if it's clear
08:59to you that they are a scammer,
09:01you can go to PNP,
09:03Anti-Cybercrime Group, or NBI.
09:05There are Anti-Cybercrime Division.
09:07Aside from DSWD
09:09and SEC, if they are
09:11a company.
09:13Atty., what is your advice
09:15to our netizens to
09:17be more observant of
09:19posts, advertisements, and charities
09:21so that they can't avoid
09:23or of course, we know that
09:25there are programs that are pitiful
09:27and there are people
09:29who are deceiving you. What can we do
09:31to them?
09:33First of all, don't let them deceive you.
09:35We want to
09:37do good deeds
09:39but we don't want to
09:41be deceived.
09:43Just basic due
09:45diligence. Let's use
09:47common sense.
09:49There are things like
09:51red flags.
09:53If someone is asking for
09:55money or is just
09:57deceiving, like what I said.
09:59Basic research, use
10:01the internet, ask
10:03reviews on
10:05DSWD. Let's go straight
10:07to the source, the official sources.
10:09If there are
10:11fundraisers
10:13or DSWD,
10:15that's my advice.
10:17We want to help but
10:19we want our help to go home
10:21Attorney, thank you so much
10:23for the specific details
10:25and very important information
10:27about fake
10:29charity scams. Thank you so much
10:31and I hope we can visit there in Mataan.
10:33Attorney, thank you so much.
10:35Thank you very much, Profi.
10:37RSV, be careful with peck and
10:39charities that only use donations
10:41for their own interest.
10:43Make sure that the organization
10:45is helping
10:47so that the help
10:49can reach those in need.
10:51That's what we're talking about
10:53here at
10:55MIL-101.
