00:00LL Malaysia Taman Temah Sendirian Berhad, the operator of the Legoland Resort in Johor,

00:07was entitled to dismiss its retail manager, Shafiq Sani, for refusing a COVID-19 vaccination

00:13required for the theme park's reopening post-lockdown.

00:16The decision was supported by the Johor Industrial Court, adding that the Tourism, Arts and Culture

00:21Ministry's directive for staff vaccination outweighed the health ministry's voluntary

00:26stance.

00:27The court, led by chairman Azwar Nida Afandi, determined that Shafiq's refusal constituted

00:32insubordination as there were no medical reasons given for his non-compliance.

00:38The court said the company had adequately informed Shafiq about the importance of vaccination

00:42and compliance deadlines, and even arranged medical consultation for him, yet he persisted

00:47in his refusal.

00:48Azwar Nida said Shafiq's continued non-compliance posed operational risks, jeopardizing the

00:54park's approval to reopen, which ultimately led to his dismissal in January 2022.

01:00The court found that Shafiq had failed to fulfill his duties responsibly, affecting

01:03the business adversely.

01:05It concluded that the company had legitimate grounds to dismiss Shafiq, maintaining the

01:09safety of employees and visitors against COVID-19.
