00:00Mr. Banerjee, last time also when there was a discussion, I said that some people carry the constitution in their hands but could not tell how many pages are there in it.
00:11Because they have never opened it.
00:13Today, because this constitution which Rahulji shows to everyone, may be they have not even opened two pages of it.
00:23If you see its preface, who wrote the preface?
00:27Supreme Court's senior advocate Gopal Sankar Narayan wrote
00:32Our constitution was crafted by the finest and most emancipated minds of the time and thankfully not directed by the confused Nehruvian social policy that guided success governments.
00:46He raises a question on their Nehruvian ideology.
00:49And he writes that giants like B. R. Ambedkar, B. M. Rao, Sardar Patel, K. M. Munshi, allowed the debate provisions to protect the basic freedom.
00:57They have given credit to Mr. Ambedkar and Sardar Patel.
01:02Sir, what does Gopal Sankar Narayan write on the next page?
01:05And this is for him only. I am reading what he has shown in the house.
01:09It is written here, were it not for the strength of the document, Indira Gandhi would have been compelled to end the darkest episode in independent India by ending the emergency.
01:21That is, it was the power of the constitution which ended Indira Gandhi's emergency.
01:27So, it was the power of the constitution.
01:29And it is written in front of you.
01:31Rahulji is the one whom you roam around with.
01:33At least open it and read it.
01:35You have never even read it.
01:37It is written in front of you, sir.
01:39You say the chair.
01:41Say the chair.
01:43Say the chair.
01:45Aditya ji, it is written on Rahulji's copy that Indira Gandhi was compelled to end the emergency.
01:53So, the constitution of Babasaheb Ambedkar gave the job to the poorest of the poor.
01:58Sir, you go to his preface.
02:02Sir, after his preface, he wrote forward.
02:06He is also a very big lawyer of the Supreme Court.
02:08What does he write, sir?
02:10That when the constitution was made, after the independence of the country, from the very first day,
02:16Legislating and our bureaucracy.
02:19Sir, both of us have set the stage with the judiciary.
02:23Talking about putting the judiciary down.
02:25Sir, I am not saying this.
02:27This is the same book that Rahul Gandhi is roaming around with in his hand.
02:30Sir, I will read and tell you.
02:32From the earliest years itself, the legislative wing and the executive wing of the state,
02:37on the one hand, confronted the judicial wing, on the other,
02:42with the acquisition that they had vastly approached upon the powers,
02:46not given to them, but given to the executive.
02:49The then law minister, on 28 October 1976, issued a strident warning to the judges of the Supreme Court.
02:58And I quote, sir, I am quoting.
03:00An atmosphere of confrontation was thought to be created by those,
03:05whose duty it was to see that,
03:07they did not encroach upon the field,
03:09which did not legitimately belong to them.
03:12Nothing should be left undone now,
03:14to ensure that such a situation did not recur.
03:18If even after the amendments,
03:20confrontation continues, then I think it will be a bad day for the judiciary.
03:24Who is saying this to the then law minister?
03:26And what does he say, sir, again?
03:28We are trying to save them from the temptation to intrude into the powers which did not belong to them.
03:33What we are doing today is not to save the people from the judges.
03:37What is he saying?
03:38We are trying not to save the people from the judges,
03:41but really enabling the judges to save themselves,
03:46save them from themselves.
03:48This was said during the emergency which hit the nation like a tsunami,
03:51and brought about the realization that the constitution could not be subverted.
03:55Sir, if this constitution,
03:57which Babasaheb Mavedkar gave,
03:59saved the nation,
04:01Rahulji, read it sometime.
04:03Sir, Madhav...
04:33You carry the constitution in your pocket, sir.
04:35He has done the work of subverting the constitution.
04:38He should apologize to the nation.
04:40I wanted your protection so that he stops making false allegations.
04:44You have never protected the constitution.
04:46An emergency-like time has come,
04:48and the constitution has been repeatedly subverted,
04:51and reformed,
04:52which you and your party have done.
04:54Thank you, sir.
