00:00More than a month ago, the target of Comelec for the list of candidates to be placed in the ballot box was one-of-a-kind.
00:14More than a hundred petitions were sent to Comelec to declare their aspirants as nuisances.
00:20Sandra Aguinaldo reports.
00:24Comelec and Bank accepted the recommendation of their law department for the 66 senatorial aspirants who passed their examination and may be included in the ballot box in the upcoming election.
00:38This is a mix of individuals, may be incumbents, may be independents.
00:44There are political parties but they are not that well-known.
00:47Labor leaders, lawyers, doctors, we included all of them based on qualifications and our determination.
00:55Our determination is based on the assessment of the law department whether they have a political party or they are independent candidates.
01:03It was not based on including them.
01:08Of the 183 who obtained the Certificate of Candidacy or COC as a senator, there are 117 who were not included in the list.
01:17Comelec will issue a petition to declare them as nuisances.
01:22There were 24 petitions filed by the law department for the senatorial aspirants.
01:30The law department still needs to issue a due process for the 117 out of the 183 senatorial aspirants so they can explain why they should not be declared as nuisance candidates.
01:46Therefore, this 66 is a partial list of those who may be included in the ballot box.
01:53Pastor Apolo Quibuloy was included in the list. He is currently in prison and facing a case.
02:00Currently, he has a grievance with the Workers and Peasants Party or WPP, which gave him a CONA or Certificate of Nomination and Acceptance.
02:10The Senatorial Aspirant, Sani Matula, canceled Quibuloy's CONA, which was issued without authorization.
02:18He also asked to disqualify Quibuloy.
02:21But Attorney Mark Christopher Tolentino, the political spokesperson of Quibuloy, filed a petition to declare Matula and some others as nuisances and to cancel their COC and CONA.
02:34The WPP president, Matula and Tolentino, introduced each other.
02:39According to Comelec, there are 80 petitions filed by Comelec for the declaration of nuisance in a local position.

03:12How was Comelec able to include the 66 Senatorial Aspirants who could be included in the ballot box in the election of 2025?
03:19Sir Rafael, we based that on the provision of the Omnibus Election Code, where Section 69 defines the nuisance candidacies.
03:28And we said, like what we are protesting, we will not disqualify these candidates because of poverty or lack of resources to campaign.
03:38We said that we will disqualify or cancel a candidate as a nuisance candidate because they are causing mockery of the electoral process.
03:47They are making fun of our electoral process. Number two, there is no real intention to have a real campaign to become a Senator.
03:55We based that, Sir Rafi, not only on their Facebook accounts, not only on their background, not only on the principles they defend,
04:03if we don't know if they have a political party. Even if they don't have a political party, can they become a serious candidate?
04:12We put all of that together, Sir Rafi, why we have 66 official but partial list of candidates.
04:21Sir Rafi, 17 were filed yesterday by our law department with petitions to declare them as nuisance candidates.
04:30And therefore, they will have a chance to explain themselves.
04:35So even online presence is being watched by Comelec.
04:38How long will it take before you make a decision on the nuisance and disqualification cases that you mentioned?
04:45How many hearings will it take to defend the nuisance candidates themselves?
04:51Sir Rafi, according to our estimates and according to the decisions of the Supreme Court, it's enough to listen to them.
04:57We will answer them and after that, we can decide on their cases.
05:02Even if it's a local case, we will adopt the same principle and process,
05:07aside from calling our Comelec division, the respondents.
05:12Expect that in the national and local, before the end of November this year,
05:17we will be able to issue the decisions regarding the nuisance candidates.
05:22Because of our commitment, there should be no nuisance candidates in our balotas because it's a mess and there will be problems.
05:30Because sometimes, they get votes that should be votes for legitimate candidates.
05:35That's what I want to ask. What is the effect if nuisance candidates are included in the balota?
05:40If they are included, they will be voted.
05:43Later on, if Comelec or a high court like the Supreme Court says that they are intended to be nuisance candidates,
05:49all the votes given to them will be given to the legitimate candidate.
05:55What if if you vote for the legitimate candidate and the nuisance candidate,
05:59the one who was proclaimed and won will come out?
06:02We will cancel the proclamation when the candidate who was initially proclaimed should lose
06:08and after that, we will proclaim the one who really won.
06:11That will be a mess, Sir Rafi. That already happened in Negros Oriental.

06:18A group called Right to Know Right Now Coalition said that there should be no campaigning
06:22and that a big party is no longer in the joint venture.
06:25How does Comelec intend to comply and complete the terms of agreement for the election of 2025?
06:31Sir Rafi, St. Timothy is the third joint venture partner in the Philippines.
06:36Their participation is only financial.
06:39They provided what we call NFCC,
06:42which is like a guarantee that if Comelec is not able to pay,
06:45they have a fund for their commitment to us.
06:49Don't worry because our remaining joint venture partners are capable, able and financially capable
06:56because they submitted to us last Friday their NFCC,
07:01which is also the commitment of the third party that withdrew.
07:07In fact, their NFCC is worth more or less P20 billion,
07:13while our contract is P17.88 billion.
07:16They submitted to us a higher amount.
07:20So we have no problem.
07:22At present, we already have almost 78,000 machines, 110,000 machines,
07:28and the other peripherals have already been delivered to the Commission on Elections.

07:35there will be no problem even if their partner withdrew.
