00:00We will talk about this with Salman Akram Raja, who is the general secretary and eminent lawyer of PTI.
00:05Salman, today is a very bad day for PTI legally.
00:09Firstly, the election commission has got permission from the Supreme Court to notify.
00:14So, earlier four judges had accepted for the tribunals which they had accepted.
00:19And now four will be those who will take the retired judges.
00:22So, this was a very critical point of the tribunals.
00:25There are serious political ramifications.
00:28As if that was not enough, today the review of the petition has been going on.
00:35And the public spat that has been going on for the past three days.
00:38Sometimes they write a letter to the Chief Justice, Justice Mansoor, and he answers it.
00:42Today, his letter was very strongly worded by Muneeb Akhtar.
00:45And he even said that the Chief Justice is doing a spare campaign against me.
00:50And exercise in self-adulation, he is busy in self-promotion.
00:54These are probably fights going on like children.
00:56But, the real thing is that the reality has changed.
00:59This is the bench of the review petition.
01:02In the previous bench, people used to think that there are at least three like-minded judges.
01:10Now, Mandu Khail will also be in this bench.
01:12Mia Khail will also be in this bench.
01:14They have already voted against it.
01:16If Faiz Issa will also lean here, then it is clear that the decision will be made.
01:22And if the fourth judge Muneeb Akhtar does not sit, we might be looking at 4-1 or even a consensus.
01:29So, if the Supreme Court has to take this petition in the review petition tomorrow,
01:35and there is a chance that the decision will be made on that day, a short order will be issued.
01:39And even if a detailed order is not issued, it is possible that the old one will be suspended.
01:43Then it will become an open field for the government.
01:47For the two-thirds majority, people will break from here and do this from here.
01:50So, how will you deal with this?
01:52Now, the tribunals are out of your hands.
01:55Now, if there is a miracle in the review petition, then it will happen.
01:59It is clear that the first decision of 63A will be made in this.
02:04So, what options do you have now?
02:09Options? Mr. Malik, this is not about our options.
02:13I think the people of Pakistan have options.
02:16We have to see this now.
02:17All these things are an attack on the democracy of Pakistan.
02:21To say that there is an open path for the revision of the constitution,
02:25that you put pressure on people, or give them greed,
02:28break them, and do the revision of the constitution in this way.
02:30Is this how the revision of the constitution happens?
02:32The revision of the constitution is the voice of a nation's conscience.
02:35Here we see that the revision of the constitution is done through greed,
02:40through greed, through fear.
02:43So, is this a place to laugh or a place to cry?
02:46In this, I think both of you should laugh or cry together.
02:51Similarly, when we fought the election,
02:56whatever happened on the night of 8th February, 9th February,
02:59the whole world knows about it.
03:01I don't need to say anything.
03:02But we had some hope that the present judge of the High Court,
03:06under the guidance of the Chief Justice,
03:08or through consultation,
03:10in which his opinion will gain a majority,
03:12and this is our law.
03:14If such judges are appointed,
03:16then we thought that in 2-3 hearings,
03:18this fraud will be eradicated,
03:20and these matters will be resolved.
03:22But then we came to know that fraud should not be allowed to be resolved.
03:26Here, it is not the intention of the instigators,
03:29that this fraud was done.
03:30It was not so that the matter would be resolved in the election tribunal.
03:33So, there was an attack on the election tribunals.
03:35The law was changed,
03:37that retired judges can also be appointed to the election tribunal.
03:40The judge who was appointed in Punjab by Shahzad Ahmed Khan,
03:43and there were 4 such judges,
03:45about whom the legal and political circles were very happy,
03:50that these are such judges who will not come under pressure.
03:53The Election Commission immediately objected to these 4 judges.
03:56There was no objection in any other province,
03:58on the names given by the Chief Justice.
04:00There was only an objection in Punjab.
04:02Is this why Justice Shahzad was not appointed as the Chief Justice?
04:07Can this be a dissatisfaction?
04:10It is clear to us,
04:12that Shahzad Ahmed Khan was first sent to the Supreme Court from the High Court,
04:17so that he was a hurdle in the way.
04:21He gave a judge who the Election Commission did not want.
04:25And the Election Commission had no excuse.
04:27The case I filed,
04:29which was decided by the Supreme Court,
04:31and which we won from the High Court,
04:33was that why the names given by Shahzad Ahmed Khan were not being notified.
04:37Either the Election Commission should come and give an excuse,
04:40and object,
04:41and say that his sons and nieces are the candidates,
04:44or they are his election petitioners,
04:46so they should not be heard,
04:48or they have some political affiliation.
04:50The Election Commission did not say anything in front of the High Court.
04:53Salman, tell me one thing.
04:54It was just an insistence.
04:56Yes, yes, now you finish, sorry.
04:58Yes, now their insistence was that we do not want this,
05:02give us the panel, we will choose ourselves,
05:04this was the insistence of the High Court.
05:06Okay, this is very interesting.
05:08Because the PDM's government had finished the case of the retired judges itself,
05:13in PDM 1,
05:14and now came back and brought the retired judges again.
05:17But, yes, now the whole process,
05:20see, whatever happened,
05:22I think, in the 18th amendment,
05:24we finished many things of the Zia and Musharraf era.
05:28We did not finish everything,
05:30but some of the luxuries were finished.
05:33And we were thinking that
05:35now there will be a journey towards a better democracy.
05:38But all that journey is now over.
05:40But Salman, tell me one thing.
