15:43Morocco presides over the 57th Ordinary Session of the Council of Human Rights,
15:48which is therefore one of the most valued of this Moroccan presidency.
15:56Well, since the presidency in January 2024 until today,
16:00even beyond, Morocco was one of the first countries
16:04to be elected to this council when it was instituted in 2006, progressively.
16:09So there were, let's say, some priorities, themes,
16:13for example, the issue of climate change,
16:16its consequences on the protection of human rights,
16:19there are other aspects, such as the military enrolment of children, among others.
16:24There are also incessant questions.
16:26But today, you know, on the occasion of the 57th Ordinary Session
16:31of the Council of Human Rights,
16:33which is a UN meeting in Geneva,
16:36well, the fundamental, crucial theme is forced disappearances.
16:40These are forced disappearances.
16:42As a result, it is a question that concerns the entire international community.
16:45So we know very well, from the point of view of philosophy
16:48and the ontology of human rights,
16:50there is what we call the hard core or intangible of these rights.
16:54This includes the international pact on civil and political rights,
16:58the international pact on socio-cultural economic rights,
17:01there is the question of torture,
17:03the protection of the rights of migrant workers, etc.
17:06But there is also this question of forced disappearances,
17:10and so the Tindouf camps have been challenged.
17:13I listened to a lot of petitioners, including Moroccans,
17:18who ultimately draw the attention of the international community
17:22of the need to activate protection mechanisms
17:25because the situation is extremely dramatic and very worrisome.
17:29The issue of violations of fundamental rights,
17:33and therefore in the Tindouf camps, is at the heart of the discussions.
17:36What is your take on this?
17:39So, you know, there is a confusing situation
17:42because at one point in time, Algeria,
17:45which has transgressed the spirit of the conventions
17:49that it is part of,
17:52and in particular the Geneva Conventions on International Humanitarian Law,
17:57but also the International Statute of Refugees,
18:00called the 1951 Convention,
18:03with its additional protocol,
18:05by delivering to the police the right to legally manage
18:09and also, there are other aspects, the Tindouf camps.
18:12However, in doing so, they break away from these commitments
18:16stemming from the conventions that I have just mentioned.
18:19As a result, it is legally responsible,
18:22and we know very well, from the point of view of the international responsibility of the States,
18:26there are three elements combined, cumulatively, that are activated
18:29when it comes to triggering this responsibility.
18:32First, a misdemeanor in relation to a commitment taken.
18:35Secondly, a damage caused, bodily or otherwise.
18:38Thirdly, a link of causality or correlation between the first aspect and the second aspect.
18:42These three elements come together.
18:45Today, there are representatives, Moroccans, petitioners,
18:48Moroccans and others, who say that there are, first of all, forced disappearances,
18:52attacks by drones that have physically eliminated
18:55protesters, if you will, people who shout,

19:04concerning the dramatic situation in the camps.
19:07And thirdly, Algeria declares a kind of ban

19:22that this notion of responsibility to protect,
19:25which was enacted as a resolution by the General Assembly in 2005,
19:29in my opinion, should be activated today
19:32to protect vulnerable populations,
19:35including, unfortunately, children.
19:37And I remember what I said earlier,
19:39the forced military engagement of these children,
19:41not to mention the problems of human trafficking,
19:44organ trafficking, connections with terrorist networks, etc.
19:48So, we can see very well that the situation calls for an international emergency.
19:53Precisely, the petitioners also present at the General Debate
19:57denounced with irrefutable evidence
20:00the inhumane and arbitrary practices,
20:03perpetrated against the Sahrawi,
20:06which have been sequestered for decades.
20:08Will these practices remain unpunished, and until when?
20:12Unfortunately, we are looking at what is happening.
20:16First, we have to address this confusing situation
20:20in terms of the responsibility that falls to the Algerian state
20:24as long as we are the host state,
20:29so that, first of all, it does something,
20:32and secondly, it will have to respond to these acts
20:35legally in front of international bodies.
20:37Soon, the Sahara-Morocco Resolution will be adopted
20:40at the end of October 2024 by the Security Council.
20:44I think that it is absolutely necessary,
20:46knowing that Algeria is a non-permanent member of this Council,
20:49that a special clause be included to responsible Algeria.
20:53Because we do not know the course of things,
20:56the course of events,
20:58because we have to face extremely serious and dramatic situations.
21:02There are slavery practices, forced disappearances,
21:05there are many sexual exploitation cases,
21:08including pedophilia,
21:10there are trafficking networks
21:12and dubious connections with criminal networks,
21:15but also linked to irregular immigration.
21:18The European Union must also intervene,
21:22because some time ago,
21:24the question of the detournement of aid
21:26directly allocated or destined to the kidnapped Sahrawis
21:30has also been debunked.
21:32Unfortunately, it must be said that there is a certain passivity
21:35of the international community.
21:37This also applies to the nature of the commitments,
21:39but also to the nature of the functions of the Council
21:41and of human rights, which, alas,
21:43have no effective means to intervene.
21:45In my opinion, a resolution,
21:47a recommendation must be transmitted
21:49to the United Nations General Assembly,
21:51because the ordinary session of the Assembly opens in New York,
21:56so that the Assembly can eventually seize the Security Council,
22:00which has the means to intervene,
22:03probably, I would not say militarily,
22:06but by means of coercion,
22:08in order to correct these extremely disturbing situations.

22:16aimed at those who denounce abuses
22:18in the camps of Tindoufa?
22:20As long as the camps are inaccessible,

23:36but in relation to the Convention
23:38on the International Status of Refugees,
23:41and so, by extension,
23:42we can say that it has responsibilities,
23:44knowing that, I know,
23:45even if a state is not part of a Convention,
23:48it has not ratified it,
23:49it must behave in a way
23:51compatible with the objectives and goals
23:53of this Convention,
23:54and so here we address the mind
23:56and not the letter of the international texts.
23:58In this same dynamic,
23:59the NGOs have called for pressure on Algeria
24:02so that it assumes its responsibilities.
