00:00No man is an island, especially when it comes to court.
00:05It takes several to tango.
00:08When you are taking pretrial action against your opponent, they must be notified.
00:13After all, if only one softball team shows up for a game, it's not really a game, is
00:18it?
00:19This notification is called a Notice of Hearing.
00:22It is a legally required document that tells all parties when and where the judge will
00:26hold a hearing on a motion.
00:29Notification is basically when someone asks the judge to make a ruling on an issue.
00:33Either party can make a motion, and if they want to present an argument to persuade the
00:36judge to rule on that motion in their favor, they need to set it for hearing and send the
00:41required notice.
00:43A Notice of Hearing must contain the basic information of the hearing, specifically when
00:47and where it is, who will be holding the hearing, such as a judge or magistrate, and what motion
00:53is going to be argued.
00:55The notice itself, like any document submitted to court, should be perfectly legible, specifically
01:00typewritten in black ink.
01:03You know, instead of that hot pink glitter marker you prefer to use.
01:06Once the document is complete, the original should be filed with the court clerk, while
01:10keeping a copy for your own records.
01:12It is your responsibility that the opposing party receives this notice, or that you made
01:17every reasonable attempt to get it to them.
01:20This means sending it by email or physical mail, depending on how your opponent has elected
01:24to receive notices, or having it hand-delivered.
01:27If your opponent has an attorney, you should deliver the notice to the attorney.
01:31Even if a default has been entered, because the opponent didn't show up, for example,
01:35a notice still must be sent to them, letting them know of a final hearing.
01:40You should try to make a reasonable attempt to find a date and time that works for both
01:43you and your opponent.
01:45Plus, you know, it should be during hours which the court is actually open and when
01:50the judge is available.
01:52And different circuits might have additional procedural requirements before setting a hearing.
