00:27It's easy to look up these time limits on the internet,
00:30but it's not always as easy to know when the time limit starts.
00:35Typically, the clock starts on the day
00:36that whatever you are suing about
00:38happened, or the day you find out that you were harmed.
00:42In Florida, injury, fraud, property damage,
00:45trespassing, and oral contracts have a four-year statute
00:49of limitation, while professional malpractice,
00:52wrongful death, libel, and slander
00:55all have a two-year statute.
00:57Written contracts have a five-year limitation.
01:00Sometimes, you can stop the statute clock on a case
01:03and then restart it.
01:05This is called tolling.
01:07Tolling is allowed only for good reasons, some of which
01:10include the accused being out of state, in hiding somewhere,
01:14or that the accused is currently a minor.
01:17There is also something called a statute of repose.
01:20A statute of repose differs from a statute of limitation
01:23because it's not related to when you first
01:25learned you had been harmed.
01:27A statute of repose can bar your action
01:30even before you have one.
01:31These statutes are designed to protect manufacturers
01:34and their insurers from liability for accidents
01:37that happen after the design life of the product.
01:40Say you bought a product over 12 years ago.
01:42Then, due to a design or manufacturing defect,
01:45the product injures you.
01:47In Florida, with a few exceptions,
01:49you can't bring a claim for that injury.
01:52Exceptions include products that are expressly
01:54unwarranted to have an expected useful life of more than 12
01:57years, or certain specified products,
02:00like airplanes, railroad equipment, and elevators.
