00:00Accidents happen, whether you're a serial klutz or not.

00:42that decide whether you have a legitimate slip and fall case.
00:45A landowner or business must keep their property safe
00:48and fix hazards on site as quickly as possible.
00:51If it doesn't get fixed and someone is hurt
00:54because of this, it is known as negligence
00:56and can be taken to court.
00:58Generally, an injured person needs to fully prove
01:01four things in court when it comes to a slip and fall case.
01:05One, the owner or business owed
01:07what's known as a duty of care,
01:09which means that if a store is open for business,
01:12they are essentially inviting you into shop,
01:14making them responsible for your experience in that space.
01:18Two, the owner or business didn't maintain the property
01:21with reasonable care,
01:23consequently causing a dangerous environment.
01:26Lawyers call this a breach of duty of care.
01:29Three, that the person who fell was actually injured.
01:34Lawyers call this damages.
01:36And four, that the injury came as a direct result
01:40of the breach of duty of care.
01:42This is called proximate cause.
01:45If you do win your case,
01:46the jury decides the amount of compensation
01:49the defendant must pay.
01:51The compensation can include medical costs,
01:53lost wages, disability,
01:55and psychological or emotional distress.

02:01the jury's job is to determine just the right amount
02:04to bring you back even,
02:05as if the accident never happened.
