00:00You may collect baseball cards, stamps, model trains, or exotic animals.
00:05But there may come a time when your collecting skills must be put to important use,
00:09namely, in a civil court case.
00:12During a case, the process of discovery allows you to collect information in support of your case.
00:17One of the ways to get this crucial information is not by using CIA torture tactics,
00:22but by something called request for production.
00:26Request for production is when one party asks the other to provide any documents,
00:30electronically stored information, or other tangible items.
00:33Things like hard copy files and email messages.
00:36As long as they are not legally privileged, protected,
00:39then the responding party must supply these requests.
00:42If they can't or won't, they must explain to the requester why this is the case.
00:47If the requester isn't satisfied with the explanation,
00:50they can file what's called a motion to compel.
00:53This is an attempt to try and obtain the documents anyway.
00:56Some of the most common things requested for productions are
00:59copies of bills, copies of policies, copies of records, audio and video recordings,
01:05photographs, other multimedia items associated with the claims.
01:09Also, you may seek permission to inspect land or property owned by your opponent,
01:14if it has to do with the case.
01:16Remember, legal you can help you with any and all matters of discovery,
01:20including request for production.
01:22Because you can't defend what you can't prove,
01:24and proof isn't going to be handed to you,
01:27you have to go get it.
