A lorry driver was charged in the KL Sessions Court on Tuesday (July 16) over communication offences on TikTok linked to the death of social media influencer A. Rajeswary, better known as Esha.

B. Sathiskumar, pleaded guilty to a charge of posting lewd comments on TikTok using the profile "@dulal_brothers_360" with the intention to annoy others at 10.12pm on June 30.

00:14B. Satish Kumar pleaded guilty to a charge of posting lewd comments on TikTok using the

00:29The 44-year-old was charged under section 233 bracket 1A of the Communications and Multimedia
00:36Act 1998.
00:39He faces a fine of up to 50,000 ringgit or imprisonment of up to one year or both, with
00:46an additional fine of 1,000 ringgit for each day the offence continues after conviction.
00:53Satish Kumar also faced a second charge of posting lewd comments with the intention to
00:58outrage the modesty of Esha's mother P.R. Pushpa at 10.15pm on the same day.
01:05The offence is framed under section 509 of the penal code, which provides for imprisonment
01:11of up to five years or a fine or both upon conviction.
01:16Satish Kumar claimed trial to the second charge.
01:18DPP Mohammad Sabri Othman said what the accused had done was cyberbullying, causing severe
01:25emotional stress to the victim.
01:27He added that in this case a victim was found dead after the lewd communication was posted
01:31by the accused and requested for bail at 25,000 ringgit in one surety for each charge.
01:38Satish Kumar, who was unrepresented, told the court his wife is disabled while two of
01:43his three children are still studying.
01:46He said he earns about 1,000 ringgit monthly and suffers from chest pains, diabetes and
01:52high blood pressure.
01:53Sessions Court Judge Siti Amina Ghazali fixed bail at 36,000 ringgit for both cases.
02:00She also ordered the accused to surrender his passport to the court until the disposal
02:05of his case and to report to the police station monthly.
02:09The case is set for mention on August 16.
