The Kuala Lumpur High Court on Tuesday (May 14) issued a gag order for Bersatu Information Committee member Badrul Hisham Shaharin, or Chegubard, restraining him from issuing any statements or comments on his ongoing criminal defamation case.

Judge K.Muniandy made the decision after allowing the prosecution’s application to review the Sessions Court’s decision to reject the gag order.

00:26 In his judgment, Judge Muniandi said it was best if the trial judge heard the case
00:31 in accordance of the rule or law and procedure, without heeding to any statement, comment and criticism,
00:37 which might be levelled in the entirety against the case.
00:41 The court said unlike a civil case, where the aggrieved party was in a position to apply
00:46 for an injunction to prevent and restrain the offender from repeating the defamatory statement,
00:52 such an avenue was not available to the prosecution in a criminal proceeding.

01:01 to review the Sessions Court's decision that did not allow a speech ban order for Badrul Hisham
01:08 to issue any comments or statements for the charge of issuing defamatory statements

01:18 On April 29, Badrul Hisham was charged with publishing a seditious publication
01:24 on his Facebook page in Taman Bukit Ceras on April 6.
01:29 He was charged with issuing defamatory statements, with reason to believe that the defamatory statements
01:35 would damage the good name of the young Dipertuan Agong.
